-to have after the decease of "his Mother" all that part of the testator's land where Thomas now lives to the fence which runs along the side of the main branch and up the branch until it comes to the small branch that runs down towards Joseph Hagan's and is all the land lying to the westward of the fence.
2. Francis Hamilton --son
-to have the remainder of the land whereon testator's dwelling plantation is --to have after widow's decease and to the northward of the fence and small branch above mentioned
-to have Negro man "John" after widow's decease
3, Mary Ann Hamilton -wife
-to have for her natural life or widowhood all of testator's personal estate
-named executrix of the will
4. Ann Hamilton --daughter
-to have after widow's decease Negro "Jack" and Negro woman "Jude"

In the name of God Amen I James Hamilton of prince Georges County in the State of Maryland Being weak & sick in Boddy but of perfect mind and memory thanks doe make & Ordain this my Last Will and testament in Manner and form following
Imprimis I recommend my Soul into the hands of Almighty God Who gave it unto me and my Boddy to be Burried by My Executor herafter mentioned, and my Worldly Goods I doe dispose of them in manner and form following
Item I will and Bequeath unto My Son Thomas Hamilton ^ after the death of his mother all that part of my Land wheron he now Lives to the fence that Runneth alond the Side of the main Branch and up the Said Branch till it comes to a Small Branch that runeth down from towards Joseph Hagans, that is all the Land that Lies to the Westward of the Aforesaid fence to him and his Heirs for Ever
Item I will and Bequeath unto my Son Francis Hamilton all the Remainder ofmy Land whereon my now Dwelling plantation is after the death of his mother, and to the North ward of the Fence & Small Branch of above mentioned in Thomas Hamilton's part, to him and his Heirs for Ever

Item I will and Bequeath unto my Beloved wife Mary Ann Hamilton for and During her Naturall Life all my personall Estate of what kind Soever to make use of the Same at her own Discretion Excepting the following Articles Vizt

Item my will is to have no Administration on this my Last will but what Ever of my personal Estate may remain at my Wifes Death (Excepting the above Legacies) to be Equally divided amongst all my Children

Then came Francis Boone[,] Alexis Sandsbury and Joseph Boone the three Subscribing Witnesses to the within last Will and Testament of James Hamilton late of Prince Georges County deceased and Severally made Oath on the Holy Evangels of Almighty God that they did see the Testator therein named Sign and Seal this Will and they they heard him publish, denounce and declare the Same to be his last Will and Testament; That at the time of his So doing he was to the best of their Apprehensions of sound and disposing mind and memory and understanding, and that they Respectivly Subscribed their names as Witnesses to this Will in the presence

John, William, and James Hamilton, by their petition, set forth that they are seized of a tract of land called spye Park, in CC, the bounds whereof they want to perpetuate, and ask for a Commission to perpetuate the bounds thereof. Whereupon, it is ordered that Commission issue, to Samuel Hanson, William Middleton, Thomas Hawkins, & Samuel Hawkins, Gent, to examine witnesses touching the premises.

Pursuant to the order of last Mar Court, Commission issued to examine witnesses touching the bounds of a tract of land called Spye Park, lying in CC, in the possession of John, William, and James Hamilton, as follows: To Samuel Hanson, William Middleton, Thomas Hawkins, and Samuel Hawkins of CC (not being any way related to the petitioner, contiguous proprietor, nor interested in sd land). John, William, and James Hamilton, on Mar 9 in the 27th year of our Dominion, preferred their petition to this Court on the day afd, before Robert Hanson, Gent, and his associates, for Commission to examine witnesses to prove and perpetuate the memory of the bounds of sd tract of land. Signed Mar 13, 1741 - Edm'd Porteus.
And now here, William Middleton and Samuel Hawkins, return to this Court the Commission afd, with the certificate and depositions thereto annexed, viz -
We did, last Apr 22, meet on the sd land, and took the depositions of all such witnesses as were produced to us. Signed Jun 19, 1742 - William Middleton, SHawkins.
CC, Apr 22, 1742. Edward Neale, age about 38, declares that that stone by which he now stands, lying at the root of a small black oak standing on Portobacco Branch, about 16 years ago, John Thomson, late of CC, decd, showed him and told him it was the 1st beginning boundary of a tract of land belonging to Alexander Hamilton, which this deponent understood the sd Hamilton bought of Mr. Diggs. And this deponent also declares that the bounded poplar on which he now lays his hand, standing on the hillside near the abovesd branch, the abovesd Thompson showed him to be the 2nd bound tree of the sd land.
Francis Green, age about 47, declares that about 6-7 years ago, the bounded poplar on which this deponent now lays his hand, was shown him by the above John Thompson to be the 2nd bound tree of Hamiltons Land.

Aug 11, 1768 from John Hamilton, William Hamilton (Hamelton), James Hamilton, and Patrick Hamelton of CC, planters, to Samuel Hamilton of CC, planter, for 6000 lbs of crop tobacco and for divers other good causes, part of a tract of land called Spye Park, lying on the south side of Pourtobacco Branch, bounded by William Coombs' land, Coombs Purchase, containing about 80 acres. Sarah, Annastatia and Mary Anne, wives of sd John, William, and James, relinquished their rights of dower. Recorded Dec 3, 1768. Editors note: There is no punctuation in this sentence in the deed, so it is not possible to be sure how many wives acknowledged this deed. Perhaps due to transcription error, Patrick is not mentioned except once - he does not sign his name and his wife is not mentioned. We guess that 4 wives relinquished their dower rights, and one of them was the wife of Patrick.

Henry Darnall, late of the county to the aforesaid Henry Culver reference to his will make more fully and at large appear. Now the condition of the obligation is such that if Mrs. Boone wife of Henry Boone should after his death calim and recover her right of dower in the said land then I oblige myself to pay James Hamilton all or any right she shall have unto the land in virtue of her right of dower. To have and to hold for the use and support of Mary Mitchell his wife and her children in case of a separation should happen between them after the date of these presents. Indenture made June 12, 1784; Joseph Hagan, planter of PGCo in consideration of one Negro girl from 16 to 20 years of age to be delivered by Philip Selby, school master of Frederick County, Maryland as also in consideration of the rents and covenants hereafter mentioned has demised and to farm let unto him part of a tract called "Sim's Delight" containing 50 acres and lying on the north side of the dwelling house where the said Joseph Hagan now lives in PGCo and beginning at James Hamilton's beginning stone standing near the Spring Branch and bounded by Patrick Sim's line and the main road leading from St. Paul's Chapel towards Upper Marlborough. To have and to hold for the term of 56 years commencing January 1st next paying yearly the public tax or assessment and one ear of Indian corn on December 25th if demanded.
