      Thomas Mudd, by his petition, sets forth that he is seized of a tract of land in CC called Hales Place, on the east side of Zachiah Swamp, the bounds whereof being very uncertain, he prays the Court to appoint Commissioners to examine witnesses to prove and perpetuate the bounds thereof. Ordered that Commission issue to William Middleton, Henry Hawkins, Thomas Hawkins, and Saml Hawkins, Gent, to examine witnesses touching the premises.

      Pursuant to the order of last Aug CC Court, Commission issued to examine witnesses touching the bounds of a tract of land called Hulls Place, in possession of Thomas Mudd, as follows: to William Middleton, Henry Hawkins, Thomas Hawkins, and Samuel Hawkins of CC, Gent. Whereas Thomas Mudd, seized of a tract of land called Hailes Place, lying in CC, did, on Aug 11, in the 27th year of our Dominion, prefer his petition to CC Court before Robert Hanson, Gent, and his associates, CC Justices, for Commission to examine witnesses to prove and perpetuate the memory of the bounds of the sd tract of land, know that we have given you (not being any way related to the petitioner, contiguous proprietor, nor interested in sd land) power to examine witnesses as afd. Signed Aug 14, 1741 - Edm'd Porteus, Cl.
      And now here, Thomas Hawkins and Sam Hawkins, return to this Court the Commission afd with the certificate and depositions thereto annexed, viz - We, being nominated to examine witnesses about the bounds of the afd tract of land called Halls Place, we therefore met on Apr 8 last, on sd land, and then and there took the depositions of all such witnesses as were produced to us in relation to the bounds thereof, and also the bounds of a tract thereunto contiguous called Halls Lot which are hereunto annexed.       CC. Richard Edelen, aged about 70, declares that the bound stone by which he now stands, Mr. Benjamin Hall showed to him to be a boundary of a tract of land called Halls Lot.

      William Boarman, aged about 32, declares that the bound stone on which this deponent now lays his hand, he has always understood to be the 1st boundary of a tract of land called Halls Lot.

      Francis Sims, aged about 77, declares that near the place where he now stands, about 36-37 years ago, Luke Garner showed him an old stump and told him it was a former bound tree of the tract of land the sd Garner was then surveying, which this deponent understood to be Mr. Hall's.

      Francis Ignatius Boarman, age about 41, declares that an old lying stump, on which this deponent now lays his hand, he understood by Richard Lamaster and several other persons, to be a boundary of a tract of land belonging to Mr. Benjamin Hall.

      At the request of Benjamin Jameson, the following deed was recorded on Jun 17, 1745.
      Indenture tripartite made Mar 28, 1745 between Thomas Mudd of CC, planter, and Wm Boarman of CC, Gentleman, of the 1st part, Marsham Queen of CC, planter, of the 2nd part, and Benjamin Jameson of CC, planter, of the 3rd part. Thomas Mudd and Wm Boarman, for the docking and barring of all estates tail and remainder entail of and in the lands and tenements hereinafter mentioned, and for settling and assuring the same, and for 4 shillings to Thomas Mudd paid by Marsham Queen and Benjamin Jameson, and for divers other good causes, Thomas Mudd has sold to Marsham Queen, in his actual possession now being by virtue of the preceding lease, a parcel of land called Hall Place, being part of Boarmans Manor called Content, lying in CC, bounded by Mr. Robert Green, the north side of Green Run, Zachia Swamp, Matthew's Run, containing about 450 acres. To have and to hold, for the purpose that Marsham Queen may become tenant of the freehold of the said land and may stand so seized with a good recovery with double vouchers. It is agreed that Marsham Queen will permit Benja. Jameson, before the end of the next Provincial Court, to prosecute against Marsham Queen one Writ of Entry Sur Disseisen in le post returnable before the Justices of the Provincial Court, demanding against Marsham Queen sd parcel of land. The intent is for Benja Jameson to recover the land and premises against Marsham Queen, and for Marsham Queen to recover in value against Thomas Mudd and Wm Boarman, and for Thomas Mudd and Wm Boarman to recover value against the common voucher to the end one common recovery with double voucher may be thereupon had.
