      517. WILLIAM BARTON son of NATHAN BARTON of this County late deced made petition to this Court that FFRANCIS HAMMERSLEY detains and keeps from him his two Brothers and one Sister Orphans of the said Nathan Barton deced under a specious pretense that the said orphans was left to his care and Tuition from their deced Father and seeing that the said ffrancis Hammersley is a Roman Catholic he doubts that the said Orphans may be brought up by him in the Roman religion he therefore prays that the said orphans may be delivered from the said Fras. Hammersley into his care and tuition or that the said boys be bound out to some Trade according to Law in such cases hath provided concerning orphans And the Court having Throughly considered the premises doe accordingly order therefore tis ordered that NATHAN BARTON the oldest of the two boys orphans to Nathan Barton deceased shall remain in the custody of AUGUSTINE KNEATON until the next Court that he may then be by the Court bound out to the afsd Kneaton or some other good trade and that THOMAS the Younger son of Nathan Barton shall remain in the custody of Majr. ANDREW GILSON until the next Court to be bound out to him or some other Trade according to Law and that WILLIAM BARTON the Petr as afsd shall have the tuition of his Sister MARTHA the other orphan she being to be delivered from Mr. Fras. Hammersley as afsd William Bar-ton paying the costs.

      p. 14(25) The The Repo: of FRANCIS HAMERSLEY aged Twenty two yeares or thereabouts saith that hee was upp ye River sometime in December last about businesse for Mr, GEO BRENT and said RALPH PLATT by JNO: MATHEWS his Order kill a Browne Cow whose marke was to ye best of my remembrance swallow forke on one eare and cropt and two slitts on ye other: and furthr: saith that JNO: MATHEWS when ye Cow was living said that it was his and that his mrke: was swallow forked on one eare and cropt & one slitt in ye other; and when ye Cow was killed this is my Daughter, ANNs, for shee had two slits as before I tould your worships and further saith not.

      Northumberland County Court November 22, 1689
      Whereas Mr. FRANCIS HAMMERSLY brought his account to this Court by his attorney CHARLES HARRIS against Capt. GEORGE COOPER for three thousand five hundred pounds of tobacco and cask and produced a note signed by the said COOPER drawn upon Major HENRY SMYTH to pay the said sum unto the said HAMMERSLY dated January the 5th, 1682 and whereas the said COOPER has made oath that he had at the time of drawing the said note sufficient effects to answer the said debt in the hands of the said SMYTH and also that he also that he never countermanded the said note, nor that the said note was ever before this time produced to him, A Nonsuit is therefore granted the said COOPER against the said HAMMERSLY with costs and Damages according to Law alias execution.

      221. Mr. JOHN WITHERS and Mr. MATTHEW THOMPSON was by the Court chosen Feoffees in Trust for the Towne or Port of this County and did accept of the same according to act of assembly.
      222, This Court taking into consideration the purchase of fifty acres of land for the Port of this County being in Peales neck and Mr. GILES BRENT who hath the fee simple thereof not being of age came here in Court and choose Mr. FRANCIS HAMMERSLEY for his Guardian Whereupon the Court treated with Francis Hammersley Guardian for and on behalf of the orphan for the price of the fifty acres of land and it was by the Court together with the feoffees for and on the behalf of the County and Francis Hammersley for and on the behalf of the said Giles Brent did agree that thirteen thousand pounds of tobacco and caske being the full demands of the said Hammersley shall be paid for the land out of which sum Capt. MALACHY PEALE being tenant thereon is to have such part as the Law in that case doth direct and appoint Therefore tis ordered that the sum of thirteen thousand pounds of Tobacco and cask shall at the next Court be levied out of this County and by the sheriff in due time paid to Francis Hammersley and Capt. Malachy Peale shall make good and authentick deeds of the fifty acres of land unto Mr. John Withers and Mr. Matthew Thompson Feoffees to and for the use of the County.

FRANCIS HAMMERSLY of this County was attached to answer WILLIAM DENT of the Province of Maryland in a plea of debt that whereas the said HAMMERSLY stands indebted to the Plt aforesd by bill obligatory under his hand and Seale for the sum of seven thousand six hundred and eighty pounds of Tobacco bearing date the 26th of February Anno 1688 and refuses Payment though often thereto demanded wherefore the Plt by George Mason and MATHEW THOMPSON his attorneys hath brought his action against the said Francis Hammersley and Craves Judgment .. And the said Francis Hammersley the deft came into Court and confessed Judgment to the said William Dent for the sum of four thousand and Twenty six pounds of Tobacco Therefore tis ordered that Francis Hammersley shall make present payment of the said sum .. of Tobacco unto the said William Dent being in full the Ballance of all accounts between them with costs
