Subject: Re: [MDSTMARY-L] re: Peter Smith Sr & Hannah
Hate to be the bearer of bad news, but this whole family needs to be taken apart and reconstructed. Dorothy ______(and there's no proof that she was the daughter of James Martin) was not the mother of the children of Peter Smith. Dorothy was married first to Thomas Roson and when she died (1743) her will named only her grandchildren--by her daughter Thomasine who married Thomas Winstead. If she'd had children by Peter Smith, surely she wouldn't have left them out. There's another hint that she's not their mother. The will of Peter Smith in 1717 says "Wife: Dorothy, personalty and use of dwelling plantation during life. No part of her estate to be claimed by Executor as belonging to testator, she having relinquished her dower rights." Sounds to me as if there had probably been a prenuptial agreement to protect Dorothy's estate.
James Martin died by 6/6/1716. His administration accounts show only the appraisers, who were John Gardiner and John Baptist Carberry. The creditors of the estate were Thomas Racey and Henry Spink. No administrator is named, no widow's name given, no children. There is a second set of accounts for him.
7/30/1718: Admin. accts. of James Martin, SMC. Admx.: Elizabeth Burrell.
James Martin's wife was not Frances. A Frances Martin died before 6/18/1701 and this is the one to whom Ms. Donnelly refers. First, this Frances Martin was deceased prior to James Martin and it is doubtful that his wife would have had administration accounts unless she survived him and secondly, this Frances Martin appears to have been from Somerset County.
Ms. Donnelly lists three children for James Martin and Frances: Milicent, Dorothy, and James. No proof. She states that James Martin (son of James and Frances) married a daughter of Joseph Stratford (I find no proof). Dorothy (I find no proof). Milicent. (No proof).
As for Milicent, the best clue we have to her identity is the Bowling family.
Will of John Bowling, CA, 4/30/1711-6/19/1711. To James Martin and heirs 1/2 of "High Parke" in St. Mary's Co;
To sons, William and John and heirs, all other land by patent deed and certificate in St. Mary's Co.;
to dau. Mary and heirs, 100 acres "Keets Rest" in Charles Co;
to son, Thomas and heirs, parts of "Charley" and "Chessam", a south side of Myrie branch.
To wife, Mary, executrix, residue of tracts "Charley" and "Chessam", including "Charley's Addition" dwelling plantation aforesaid during life, to pass at her decease to said son, Thomas. 600 acres of "Widow's Mite" to be sold for benefit of the estate.
To dau, Mary, personalty at age 16, and to priest James Haddock, personalty.
Sons are to be of age at 20 years. Capt Benjamin Hall and brother James Hagan to have charge of children's estate should wife
die during their minority. Benjamin Hall to have charge of Thomas, and James Hagan to have charge of all other children.
Test: James Hagan, William Simons, Thomas Hagan.
*Note that James Martin had a daughter named Milicent and John Bowling had a sister named Milicent. Is there a connection? I think there is.
Here are my notes on Milicent (who Ms. Donnelly says was a Martin) who married John Nevitt:
8/1/1692--John Nevitt of SMC and his wife Milicent conveyed a parcel of land in SMC called "Nevitt's Desire" adjoining the land of Edward Swann (Early Settlers of Chas. County, Bates).
8/1/1692: From John Nevitt of SMC to Capt. John Bayne of same County, Gent. for 7000 lbs. tobacco "Nevitt's Desire" in SMC adjoining the land laid out for Edward Swann, 200 ac.
Wit: Gilbert Clarke, Philip Clarke, Robert Mason, Thomas Hebb, James Williams.
Ack. on 8/1/1693 by John Nevitt and Milicent, his wife.
Recorded at the request of Joseph Allen of CC on 12/4/1738. (CC Land Rec.).
11/28/1693: Milicent Nevitt, Susanna Norris, and Stephen Gough witnessed the will of Andrew Wheatley, SMC.
Colonial Settlers of St. Clement's Bay by Mary Louise Donnelly gives her maiden name as Martin.
Flowering of the Maryland Palantine, Newman gives her as a daughter of John Nevitt and referred to her witnessing the will of Andrew Wheatley. She's not a daughter, she was the second wife. He states that the wife of John Nevitt was Elizabeth ____. Mary Louise Donnelly states that John Nevitt married only Milicent Martin.
