Sep 23, 1777 from John Poole of M, planter, to Joseph Newton Chiswell (Chisle), planter, of M, for 78 £, a part of a tract of land now called Pooles Rectification, lying in M now but when taken up was called Frederick County, containing and now laid out for about 119 acres. Chiswell will make all such further assurance and conveyance or other instrument of writing for the further securing and conveying the hereby granted land and premises (except it be the encumbrance of a lease thereon unto him, the sd Chiswell) as by sd Chiswell or his Counsel learned in the Law reasonably advised, devised, or required. Sep 3, 1777 from Stephen Newton Chiswell of M, planter, to Joseph Newton Chiswell of M, planter, for 5 f, all the following tracts of land called What You Will, beginning on the east side Broad Run and near the head of the sd run, containing and laid out for 50 acres. Likewise, a parcel of land called Joseph Choice, containing and being laid out for 90 acres. Likewise, a parcel of land called part of Pools Rectification, bounded by a tract of land called Dowdens Luck, containing and now laid out for about 29 acres. Signed - Newton Chiswell. Montgomery County Land Records, 1777-1781; Liber A1, Page 611. Lease, recorded at the request of Thomas Green. Mar 15, 1781 from Joseph Newton Chiswell of M, planter, to Thomas Green of M, shoemaker, [the lease of a tract of land] .. containing and laid out for 55 acres, during the term of 29 years, starting next Nov 15, paying yearly, by Nov 15, to sd Chiswell, 5 £, to be paid in silver or gold, the 1st payment to be made by Nov 15, 1782. Thomas Green shall not, at any time, sell or make any unlawful waste with any timber on the premises. Thomas Green may sell the lease at the end of 15 years on the following terms, that sd Chiswell shall choose 1 man and sd Green shall choose another man to value the houses and tan yard and what the 2 men so chosen shall value the houses and tan yard to, if sd Chiswell doesn't think fit to give it, then sd Green may sell the lease for so long a time as will pay the sum valued by the 2 men, and sd Thomas Green also covenants to keep the orchard in good repair and to keep it well fenced, and in case of nonperformance of the above covenants, to forfeit and pay to sd Chiswell, 1 year's rent.
