Joseph Joy's Will
I, Joseph Joy of CC, planter, am sick and weak of body but of sound and disposing mind, memory, and understanding. Firstly, I want my debts and funeral charges paid. I devise 50 £of my estate to remain in the hands of my executors, to be by them applied towards the education of such children of William and Mary Parish, objects of charity, as they may think proper.
To my niece Eleanor Joy, daughter of my brother William Joy - I pair of good bobs.
To my son Benjamin Joseph Joy - the rest of my real and personal estate, when he turns 21. If he dies underage without heirs, then my real estate is to be sold, and the sale money along with my personal estate is to be equally divided between the children of my sister, Anne Ford, and my nephew, Phillip Joy Ford, son of my sister, Elizabeth Ford.
It is my desire that the whole of my estate shall be at the risque of my son, Benjamin Joseph Joy, and that my executors shall he neither gainer nor loser by their executorship. I desire that my sd son, Benjamin Joseph Joy and his estate, shall remain under the guardianship and care of my executors until he turns 21.
Executors: my friends John Ford, Jezreel Penn, & Jonathan Yates.

Codicil:
I, the afd Joseph Joy, having continued in a sound mind and judgment, and having reconsidered my former will, have thought it prudent to make this codicil to it, by way of explanation - viz - I stipulated that if my afd son died without heirs and underage, that my whole estate should be sold and divided between the children of my sister, Anne Ford, and my nephew, Phillip Joy Ford, son of my sister, Elizabeth Ford. My will now is that if my son dies underage and without heirs, and if my sd nephew, Philip Joy, should also die without heirs before he is of full age, and my sd sister Elizabeth should have no child surviving, then the whole produce of my estate shall be equally divided, as afd, among the children only of my sd sister Ann.

I, Arthur Lee of CC, far the love 1 have for my wife, Ann Lee, and also that I may fulfill my promise to her before marriage, and for the great regard 1 have for my 2 sons-in-law, Robert and Jonathan Yates, and for divers other good causes, I confirm unto my son-in-law, sd Robert -Yates, 1 large silver punch bowl which did belong to his father, the late Major Robt Yates, deceased. And for like reason, give my son-in-law Jonathan Yates, 1 Negro girl, about 10 years old, called Judeth, daughter of Negro Moll, now my proper slave. Signed May 24, 1744 - Arthur Lee. May 4, 1761 from James Smith of CC, planter, to John Fendall of CC, Gentleman, for 232 £10 shillings & 6 pence, a parcel of land commonly called Smith, situated in William and Mary Parish in CC, and on the north side of Potomack River on Petites Cr, and bounded on the south by sd Cr, on the east with a line drawn north from Smiths Bight into the woods, on the north with a line drawn west from the end of the former line until it intersects a parallel [line] drawn from Bennetts Branch, on the west with sd Branch and parallel [line], containing and now laid out for about 100 acres. At the request of Luke Philip Barber the following Release was recorded June 21, 1804
Whereas it appears by the account of my uncle by consanguinity Jonathan Yates that upon his administration of my father Robert Yates that their remains unsettled of the said estate a balance of 672 pounds 14 shillings and 7 pence half penny. And whereas he has had possession and used my landed property for a great many years and with regard to the possession and use of my land. I having lived with him all that time and having been well maintained and kindly treated by him and his respective children, Townly Yates now deceased, Rebecca Morgan Yates now wife to Henry Hawkins Young, Jane Bruce Yates now wife to Luke Philip Barber and Elizabeth Yates being my near relations by consanguinity and the objects of my love affections and bounty and instead of depriving them of property it is my wish and intention greatly to increase it by all the prudent means in my power, and knowing that either myself or my representatives should charge the securities of Jonathan Yates upon his administration aforesaid or the administrators on the said Jonathan Yates estate, that they will have recourse to the representatives of my said uncle. Therefore, in consideration of all the premises, I do hereby voluntarily release and relinquish all claim and demand I could or may have upon the estate of Jonathan Yates and his securities or administrators. And I hereby voluntarily give up and transfer to my cousins by consanguinity children and grandchildren to my uncle Jonathan Yates, to wit; , Rebecca Morgan Yates now wife to Henry Hawkins Young, Jane Bruce Yates now wife to Luke Philip Barber and Elizabeth Yates and the representatives of Townly Yates (Jonathan Yates, Judith Townly Yates and Maria Yates) all dues debts charges and claims which I may have against the estate of Jonathan Yates.
