      I JAMES DONALDSON of parish of Truro and county of Fairfax made this 8th day of September 1761 .. give and bequeath to my son, STEPHEN DONALDSON, one negro boy .. unto MILDRED DONALDSON, my granddaughter who is the only daughter of my son, WILLIAM DONALDSON, deceased, the sum of one shilling sterling .. residue of my estate to be equally divided among my children, STEPHEN DONALDSON, JOHN DONALDSON, DANIEL DONALDSON, BAILY DONALDSON and JANE DONALD- SON .. appoint my loving wife, ANN DONALDSON, sole Executrix ..       WESTMORLAND ss. George the Second by the Grace of God of Great Britain France and Ireland, King Defender of the faith &c. to ROBERT JONES, WILLIAM HACKNEY, JOHN ALLEN and THOMAS OSBORN, Gentlemen Justices (or any two of them) of the County of PRINCE WILLIAM Greeting. Whereas by one Act made at a General Assembly ((see pages 36-37 of this book for the material for the authority for granting a Commission for the private examination of the Wife of the Grantor) And whereas JAMES DONALDSON of the County of Westmorland has desired that a Commission might issue for the privy examination of ELIZABETH CONWAY of County of PRINCE WILLIAM touching her willingness for her passing & acknowledging with her Husband their rights to a certain devident of two hundred twenty five acres and a half of Land in Parish of Washington in County of Westmorland by them to be conveyed to JAMES DONALDSON, Therefore you the said ROBERT JONES, WM. HACKNEY, JOHN ALLEN & THOMAS OSBORN, Gent., are hereby required in obedience to the Act of Assembly afore. said and desire of JAMES DONALDSON at some convenient time before the last Tuesday in February next being the day on which this Court is to be held for the County of Westmorland take the privy examination of ELIZABETH CONWAY, Wife of THOMAS CONWAY, apart from her Husband touching her free and unconstrained assent to the passing the said Deed unto JAMES DONALDSON and herein you are not to fail: Witness GEORGE TURBERVILE. County, pursuant to the above directions, wee, WM: HACKNEY & JOHN ALLEN, examined the above named ELIZABETH CONWAY, Wife of THOMAS CONWAY, and she acknowledged to us that she is free and willing to acknowledge her whole right and title of two hundred twenty five & half acres of land which her Husband and she have assigned Deed for to JAMES DONALSON without any compulsion of her Husband, or any other person; Given under our hands this 20th day of February 1735

      THIS INDENTURE made the Seventeen day of November Anno Domini one thousand seven hundred and thirty five and in the ninth year of the Reign of our Sovereign Lord George the Second by the grace of God of Great Britain France and Ireland, King Defender of the faith &c., Between THOMAS CONWAY of County of PRINCE WILLIAM, Planter, and ELIZABETH his Wife of one part and JAMES DONALDSON of County of KING GEORGE, Silver Smith, of the other part; Witnesseth that THOMAS CONWAY and ELIZABETH his Wife in consideration of the sum of Eighty pounds current money of Virginia to said THOMAS in hand paid by JAMES DONALDSON, the receipt whereof THOMAS CONWAY doth hereby acknowledge, path and by these presents doth bargain and sell unto JAMES DONALDSON his hcirs all those two parcels of land containing by estimation Two hundred twenty five acres and a half of Land scituate in Parish of Washington in County of Westmorland, to wit, One hundred fifty one acres and a half thereof granted by an Escheat Deed from the Proprietors of the Northern Neck of Virginia to LEWIS MARKHAM, deced., as fallen to Escheat by the death of GEORGE THORNE, who dying without disposing thereof and leaving no heir behind him as appears by the said Deed bearing dated the first day of December one thousand seven hundred and Eight whereby it fully appears the land reverted again to the Chief Lord of the Fee and is bounded; Begining at a marked red Oak standing on South side of a Path that leads from MATTOX to NANJATICO, extending South 180 poles to the line of the land of Mr. STARK, then West 160 poles; then North to the line of WILLIAM BALTHROP 122 poles, finaly along BALTHROP's line to the first station; And seventy four acres, the other part, being also granted to LEWIS MARKHAM, deced., by an Escheat Deed from the Proprietors of the Northern Neck bearing date the seventh day of December one thousand seven hundred and eight as fallen to Escheat by the death of THOMAS CARTER, who dying without disposing thereof and leaving no heir behind him was vested in the Chief Lord of the Fee, and is bounded, Begining at a marked white Oak close upon the Westward side of Starks Dam, extending thence North 27 degrees and a quarter West 119 poles to a corner red Oak between this Land and the Land of BENJAMIN WEEDON, thence North 67 degrees East one hundred fifty eight poles to a red Oak corner tree to the land of GEORGE THORNE standing in the line of Mr. WILLIAM BALTHROP, thence South 93 poles to a white Oak corner tree to the land of said THORNE close upon the Dam, thence up along close upon the South side of the meanders of the Dam to the first begining; both which parcels of land containing together two hundred twenty five and half acres and LEWIS MARKHAM not disposing thereof the same became the proper Estate of WILLIAM MARKHAM, his Eldest Son and heir at Law, who by his Last Will and Testmanet gave and devised the same to ELIZABETH his Wife, to be sold by her for money to clear debts as by the said Will more at large may appear; together with all houses orchards profits and appurtenances to the parcel of land belonging; To have and to hold the parcel of land and premises with appurtenances unto JAMES DONALDSON his heirs and THOMAS CONWAY and ELIZABETH his Wife and their heirs the parcel of land unto JAMES DONALDSON his heirs against all persons shall warrant and for ever defend by these presents; In Witness whereof the parties have hereunto interchangeably set their hands and seals the day and year above written

JOHN FOX, MANNERIN JONES and WILLIAM DONALDSON, the said ELIZABETH CONWAY being first privately examined as appears by a Certificate under the hands of WILLIAM HACKNEY and JOHN ALLEN, two of his Majesties Justices for the County of PRINCE WILLIAM, annexed to a Commission (pursuant to the late Act of Assembly) to them for that purpose directed, the inheritance of the said land being in the said ELIZABETH CONWAY, and she a resident in the said County of PRINCE WILLIAM, all which on moron of the said JAMES DONALDSON are admitted to Record
