      - CALLAHAN v CHILTON
      In the Ejectione Firma brought to this Court by JOHN CALLAHAN for three Plantations with ye appurtenances and three hundred acres of land scituate lying and being in the Parish of White Chapple and County aforesaid and now or late in ye possession of WILLIAM BARKER, THOMAS MARSHALL and SCARBOROUGH MARSHALL which JOHN CALLAHAN claimes by demise from JOHN SHARP which JOHN SHARP made for a term not yet expired and allsoe for three hundred pounds sterling damages for ejecting him, JOHN CALLAHAN, therefrom, Oath being made by JOHN MULLIS that he carried a copy of ye Declaration and Endorsement thereon signed by GEORGE CHILTON and desireing them or those under whom they claimed to appear att ye next Court to defend their title; and whereas nobody hath yett appeared to defend ye suite, it is therefore ordered that unless WILLIAM BARKER, THOMAS MARSHALL and SCARBOROUGH MARSHALL or those under whom they claime do appear att ye next Court and confess lease entry and ouster and make him or themselves Defendts and insist only on the title of ye premises, he or they haveing had notice thereof by the Sheriff or his Deputy then Judgment shall be entered for ye Plaintiff and her Majesties Writt of hahere possessionem issued

      In the Ejectione Firma brought to this Court by JOHN CALLAHAN against GEORGE CHILTON for three Plantations with the appurtenances and three hundred acres of land scituate lying and being in the Parish of White Chapple in ye County aforesaid and now or lately in the possession of WILLIAM BARKER, THOMAS MARSHALL and SCARBOROUGH MARSHALL which JOHN CALLAHAN claimes by demise from JOHN SHARP which JOHN SHARP made for a terme not yett expired and allsoe for three hundred pounds sterling damages for ejecting JOHN CALLAHAN therefrom; and WILLIAM BARKER, THOMAS MARSHALL and SCARBOROUGH MARSHALL come into Court in their proper persons and for each of themselves severally pray to be admitted Defts. to their several parts of the three hundred acres of land and premises and every one confest lease entry and ouster and doe allsoe severally pray ye lycence of Imparlance may be granted them and each of them for himselfe personally or by his or their Attorney to insist only upon ye title of ye premises which according to their prayer is granted them
