      IN THE NAME OF GOD, Amen, I CHRISTOPHER BLACKBURN of ye County of Essex being sick and weake but of perfect sence & memory thanks be to God for it, doe make ordain constitute & appoint this to be my last Will &Testamt: revoking & annulling all other Wills either by word or writing by me formerly made, & this onely to be & stand in full force & vertue & no other as in manner & forme following Imprimis. I surrender and give my soul into the hands of Almighty God my Heavenly Father in perfect hope of pardon in & through the alone meritts of my dear Saviour; & my body to be decently buried at the discretion of my Exrs. hereafter named

      - Whereas EDWARD BERRY of this County died seized in fee of a certain tract of land scituate & being on the South side the Rappa: River, wch: sd. land is now in the occupacon of Mr. XPHR. BLACKBURNE, & Whereas the sd. BERRY did by his last Will & Testamt. devise the sd. land to the Children of KATHARINE his then Wife & his own to be equally devided amongst them and suit being made to this Court by EDWARD GEORGE, who marryed MARGRET, one of the Daughters of the sd KATHARINE, that devision might be made of the sd land according to the intent of the sd BERRYs Will, the Court have ordered that the land be forthwith devided into three equall parts according to quantity & quality and that JOHN BERRY Son of sd EDWARD BERRY deced have the first choice after such devision shall be made, and the other two parts to come & vest in EDWARD GEORGE in right of the sd MARGRET his Wife & SUSANNA BERRY, Daughter of the sd KATHARINE, Also that the charge of this Devision be equally borne amongst them

      - Whereas at a Court held for this County March the 5th: 1684/5 it was made appeare that EDWARD BERRY of this County dying seized in fee of a certaine large tract of land scituate and being on the South side of Rappa: River and now in the occupation of CHRISTOPHER BLACKBURNE did by his Last Will & Testament devise the sd land to the Children of CATHERINE his then Wife and his own to be equally devided amongst them, And Whereas EDWARD GEORGE who Marryed MARGRETT, one of the Daughters of the sd CATHARINE, made humble suit to the Court that devision might be made of the sd land according to the intent of the sd BERRYs Will; That Court did then and there order that the sd land should be divided into three equall parts according to Quantity & Quality and that JOHN BERRY, Son of the sd EDWARD BERRY, should have the first choise after such division made and the other two thirds to come and vest in MARGRETT & SUSANNA, the two Daughters of the said CATHERINE, But the said EDWARD GEORGE representing to this Court that the sd JOHN BERRY hath been unheard of and in remote parts for many years last past, and none of him impowered appearing to claim right in the sd land, the Court have ordered that the sd EDWARD GEORGE forthwith take into his possession in the right of the sd MARGRETT, his Wife, and SUSANNA & the sd JOHN BERRY all and singular the abovesd Tract of land wth houses orchards &c. thereunto belonging and that he give in Bond to this Court wth good & sufficient security for the quiet and peaceable resignacon of one third part of the sd land to the sd JOHN BERRY if he shall hereafter appeare to demand the same as also for the peaceable delivery & quiet possession of the one half part of the sd tract of land until such time as the sd JOHN BERRY shall come & claime his third part of the whole

      - Whereas at a Court held for this County March the 5th: 1684/5 it was made appeare that EDWARD BERRY of this County dying seized in fee of a certaine large tract of land scituate and being on the South side of Rappa: River and now in the occupation of CHRISTOPHER BLACKBURNE did by his Last Will & Testament devise the sd land to the Children of CATHERINE his then Wife and his own to be equally devided amongst them, And Whereas EDWARD GEORGE who Marryed MARGRETT, one of the Daughters of the sd CATHARINE, made humble suit to the Court that devision might be made of the sd land according to the intent of the sd BERRYs Will; That Court did then and there order that the sd land should be divided into three equall parts according to Quantity & Quality and that JOHN BERRY, Son of the sd EDWARD BERRY, should have the first choise after such division made and the other two thirds to come and vest in MARGRETT & SUSANNA, the two Daughters of the said CATHERINE, But the said EDWARD GEORGE representing to this Court that the sd JOHN BERRY hath been unheard of and in remote parts for many years last past, and none of him impowered appearing to claim right in the sd land, the Court have ordered that the sd EDWARD GEORGE forthwith take into his possession in the right of the sd MARGRETT, his Wife, and SUSANNA & the sd JOHN BERRY all and singular the abovesd Tract of land wth houses orchards &c. thereunto belonging and that he give in Bond to this Court wth good & sufficient security for the quiet and peaceable resignacon of one third part of the sd land to the sd JOHN BERRY if he shall hereafter appeare to demand the same as also for the peaceable delivery & quiet possession of the one half part of the sd tract of land until such time as the sd JOHN BERRY shall come & claime his third part of the whole
