      THIS INDENTURE made the first day of August in the year of our Lord one thousand seven hundred and thirty five Between WILLOUGHBY NEWTON of County of Westmorland in Cople Parish on one part and HENRY NETHERTON of the same place on the other part; Witnesseth that WILLOUGHBY NEWTON and HENRY NETHERTON are seized in their demense in common and undivided one tract of land scituate in County aforesaid which was formerly granted to BALDWIN SHIPARD as by Patten dated the 9th day of June 1665 for One thousand acres of land, Five hundred of which was conveyed by BALDWIN SHIPARD unto JOHN TUCKER as by Deed dated the eight day of December one thousand six hundred and sixty eight may appear under which the said NETHERTON now claims and Five hundred acres, the remaining part of the Patten, was conveyed by QUINTILLIAN GOTHERICK, ELIZABETH GOTHERICK and the above BALDWIN SHIPARD to ROSE GERRARD, Widow and Relict of THOS: GARRARD, as by Deeds dated the twenty seventh day of July 1674 may appear under which the said WILLOUGHBY NEWTON claims; which land has not as yet been divided. Now to this end, a perpetual division made between the parties in the tract of one thousand acres of land and other the premises agreed by and between the parties to these presents in manner and form following. Begining for the division between the said parties at a Locust Post put up by them in the line of GAWIN CORBIN and extending thence Southwest by a marked Gum tree one hundred and fifty poles to a Locust Post, thence South sixty two degrees West to the back line of BALDWIN SHIPARDs Patent, wch. sd. lines is marked and agreed on by each party to be division between them and their heirs; and first said WILLOUGHBY for himself his heirs that said HENRY NETHERTON his heirs &c. shall from henceforth hold in severalty to him and his heirs all that part of the land whereon said NETHERTON now lives and also WILLOUGHBY NEWTON nor his heirs shall henceforth claim or demand any right in the same; And HENRY NETHERTON for himself his heirs that WILLOUGHBY NEWTON his heirs shall from henceforth hold in severalty to him and his heirs the tract of land whereon WILLOUGHBY NEWTON and SAMUEL OLDUM now live on and all the Land on the Northwest side of the Dividing Line now made by the parties as a Division between them and that HENRY NETHERTON nor his heirs shall from henceforth claim or demand any right in the land on the Northwest side of the Dividing Line; In Witness whereof ye parties to this Indenture have sett their hands and seals the day and year above written

      THIS INDENTURE made this twenty fourth day of Aprill in ye ninth yeare of ye reign of our Sovereign Lord George the Second, King of Great Britain &c., And the yeare of our Lord Christ one thousand seven hundred and thirty six Between HENRY NETHERTON of ye Parish of Cople and County of Westmorland of ye one part and WILLOUGHBY NEWTON of the same Parish and County of other part; Witnesseth that HENRY NETHERTON in consideration of the quantity of five thousand pounds of tobacco and fifty pounds current money of Virginia to him in hand paid by WILLOUGHBY NEWTON the receipt whereof he doth hereby acknowledge, hath and by these presents doth bargain sell and release unto WILLOUGHBY NEWTON his heirs a certain parcell of land containing as by estimation One hundred and twenty three acres be the same more or less being part of Five hundred acres of Land HENRY NETHERTON now lives on, which came to said HENRY NETHERTON as heir to his Grandfather, Mr. JOHN (scratched on film) and is bounded, Begining at a Locust Post in ye line of Collo. GAWIN CORBIN wch: said post was put up by said NETHERTON & NEWTON for the begining of the division lines of theire lands which may appear by an Indenture of partition made by them & acknowledged in Court, and extending thence along said CORBINs line South East seventy five poles crossing a large Swamp to a Sassafras between a Locust & white Oak tree standing on South East side of ye sd. Swamp, thence South forty eight degrees West fifty eight poles to a red Oak by a Branch & Path yt: goes through ye sd. NETHERTONs Orchard to his house, thence crossing a Branch into a Fork between two Branches South sixty seven degrees (part of line not on film) seven poles to three Chesnutt trees standing together above & by a Spring, thence (more not filmed) crossing YEOCOMOCO CHURCH ROAD to a Pesimen and red Oak in ye side of a Hill by a Branch, thence South East forty eight poles to a Hiccory Stump, ( ) groeing out of it wch: is marked & a Stone put by it on the side of the Great Hill next to next to JAMES ( ) house, thence South West to the back line of a Patten formerly granted to BALDWIN SHEPPARD, deced., ye 5th day of June 1665, under which the said NETHERTON claimes, thence along the back line of the Patten North West to the division line yt: was made between the said NETHERTON & NEWTONs Land and thence down the dividing line to the begining post, together with all houses orchards profits and appurtenances belonging; To have and to hold the one hundred and twenty three acres of land and all the premises with appurtenances unto WILLOUGHBY NEWTON his heirs And HENRY NETHERTON for himself his heirs the land wth: all its appertinances unto WILLOUGHBY NEWTON his heirs shall warrant and for ever defend by these presents against the claim of any person; In Witness whereof ye

      THIS INDENTURE made this fourteenth day of September in the Tenth year of the Reign of our Sovereign Lord George the Second, King of Great Britain &c,, And in the year of our Lord Christ one thousand seven hundred and thirty six, Between HENRY NETHERTON of Parish of Cople and County of Westmorland of one part and WILLOUGHBY NEWTON of the same Parish and County of other part; Witnesseth that HENRY NETHERTON in consideration of Two hundred and fifty pounds Sterling money to him in hand paid by WILLOUGHBY NEWTON, the receit whereof he doth hereby acknowledge, hath and by these presents doth bargain sell and release unto WILLOUGHBY NEWTON his heirs a certain parcel of Land containing Three hundred aikers on which HENRY NETHERTON now lives being the remaining part of Five hundred aikers of Land formerly sold by BALDWIN SHEPARD to Mr. JOHN TUCKER, deceased, Grandfather of the said HENRY NETHERTON,which Land became the right of HENRY NETHERTON as heir to said JOHN TUCKER, bounding; Begining at a Sasafras between a Locust and white Oak trees standing on South East side of a Swamp corner to a parcel of Land sold by said NETEHRTON to said NEWTON by Deed dated the 24th day of April last, thence along Colo. CORBINs line Southeast to the said NEWTONs Mill Pond, thence up the several courses and meanders of the Pond and TUCKERs RUN to a small piece of land containing Seventy seven aikers which was given by JOHN TUCKER to BENJAMIN TUCKER as by Deed may appear. thence along the several courses of the said Deed to the back line of a Patten granted to BALDWIN SHEPHERD dated the 9th day of June 1665, thence along the said back line which divides this Land from the Land of GARNER Northwest to an Oak corner of the land before sold by said NETHERTON to said NEWTON, thence runing the several courses thereof to the begining Sasafris, Together with all houses orchards profits and hereditaments to said parcel of land belonging; To have and to hold the three hundred aikers of land and all the premises unto WILLOUGHBY NEWTON his heirs; And HENRY NETHERTON for himself his heirs the three hundred aikers of land with all its appurtenances unto WILLOUGHBY NEWTON his heirs &c. shall warrant and forever defend by these presents against the claim of any person; In Witness whereof the parties to these presents have interchangeably set their hand and seal the day and year above written Signed sealed and delivered in presence of

      At ye Request and by the directions of HENRY NETHERTON and Mr. NICHOLAS MINOR, Attorney for HENRY TUCKER, have surveyed and layed out two bounds of a Deed of Gift from JOHN TUCKER to BENJAMIN TUCKER for Seventy seven acres of land more or less dated the 26th day of August 1696, scituate in Parish of Cople and County aforesaid, Begining at an old forked Poplar at (A), corner to the Land of GARNER now fell down on the side of TUCKERS RUN in the room of which is marked a Holly Bush, Chesnutt and Gum tree. and extending thence down TUCKERS RUN the several courses and meanders thereof reduced to a right line N. 32d. E. 200 poles to a Chesnutt tree white Oak sapling and Sassifras on side of said Run at (B), thence N. W. 30 poles and cornered in the Road that leads out of YEOCOMOCO NECK to NOMINY CHURCH in the angle of two red Oaks and a white Oak Sapling at (C), thence W. S. W. 205 poles to a Stake in GARNERs line between two Red Oaks and two Hickory Saplings at (D), thence South East 77 poles along GARNERs line to the begining, including sixty five acres as by the Platt annexed
