IN THE NAME OF GOD, Amen, ye first day of Aprill in ye year of our Lord one thousand six hundred & ninety & eight, I DANIEL DISKINS being sick & weak of body but of sound & perfect memory blessed & praised be Almighty God for ye same, doe make & ordaine this to be my last Will and Testament in manner & forme following;
First & principally I comend my Soul into ye hands of Almighty God that gave it hopeing by ye meritorious death & passion of my blessed Lord Saviour Jesus Christ to receive full pardon & remission of all my Sins and my body to ye Ground to be decently & Christianly buried at ye discretion of Enz. hereafter named; And as for the worldly goods that God hath lent me, I dispose of in manner & forme following:
Imprimis. I give unto my Loveing Wife ye best bed & beding
Item. It is my will that the rest of my Estate be brought to an appraisement & then be divided into three parts, my Wife to have one third part threof & ye other two parts to be divided between my three Children, and that part of the Estate that shall belong to my two Eldest Children, if it be valued at so much as will by Three hundred acres of Land, then it is my desire that my Wife by so much land & keep their part of the Estate, but if it will not by so much land, then that she by two hundred acres of land yt: sd Land purchased to be equally divided between my two Eldest Children, JOHN & MARY DISKINS;
Item, ye land that I now live on dureing her natural life I give unto my Wife & after her decease to my youngest Child, DANIEL DISKINS;
And I do make my loveing Wife JOAN DISKINS Exex. of this my last Will & Testament hereby revokeing all Wills Testaments Legacies or bequests by me at any time made given bequeathed & publish this to be my last Will & Testament; In Witness whereof I have hereunto set my hand & fixed my seale ye date first above written

Know ye that wee for the quantity of Six thousand pounds of tobacco and cask to us already paid or secured to be paid by MATHEW KELLEY of the said County, Plantr., have sold unto the said MATHEW KELLEY his heires & assignes all that parcell of land & Plantation where the said KELLEY now dwelleth. mentioned in certain Deed of Gift from RICHARD COLEMAN made unto DANIELL DISKIN deced Father, bearing date the 27th of Decembr: 1666, according to the several! bounds & courses in the same Deed specified conteyning One hundred & fifty acres being in the County aforesaid which said land was given to be equally divided Betweene us by the last Will and Testament of DANLL. DISKIN or: said deced Father, bearing date the 23th of March 1668: To have and to hold the said One hundred and fiftie acres of land and plantation with the rights belonging; unto him the said MATHEW KELLEY his heires and assignes forever without disturbance of us or either of us our heirs & will warrant from the clayme of all persons whatseover. - SAMUEL THACKER for and on behalfe of CALEB COCKLEY, Plantiff and DANIEL DISKIN as Intermarrying with ye Executrix of CALEB LYON, Defendt., came into Court & joyned issue by consent for tryall of the following difference set forth by ye Plantiff in his Declaracon viz: That sd CALEB LYON by his Last Will and Testament bearing date ye 4th: day of February 1686 did bequeath unto his God Son, ye sd CALEB COCKLEY, now liveing with ye Plt., one Mare foale of about a yeare old, and to be delivered to them that hath the tuition of ye sd CALEB COCKLEY by the Executrix of the said CALEB LYON. Now so it is the said Executrix of the said CALEB LYON hath not yet delivered ye sd Mare foale according to ye Will of ye said CALEB LYON and refuseth to deliver it to ye damage of the said CALEB COCKLEY Two thousand pounds of tobo: as it shall appeare; Wherefore ye Plt. pray'd order against ye DANIEL DISKIN, who intermarried ye Widdow and Exx., of said CALEB LYON, for ye present delivery of the said foale according ye Will of ye said LYON with cost &c., Whereupon this Court have ordered that ye sd DANIEL DISKIN deliver to ye sd SAMUEL THACKER for ye use of ye sd COCKLEY a mare foale according to ye express words of ye said Will with costs als Exo.

In Oct 1711 John Barker of St Ann's parish gives to his kinsmen, Daniel and John Diskins each a heifer. The boys were grandsons of the first Daniel, and would have been in their early teens. The deed of gift was signed by John and Penelope Barker. I am trying to figure out who this Penelope may have been, and how related to these boys. The mother of the two Diskins boys was Joanna Barker.;
