William Flemming's Will
In the name of God Amen, I William Flemming of the parish of Cople in County of Westmoreland being sick and weak of body but of sound and perfect memory do make this my last will and testament in manner and form following.
Item my will is that my loving wife have the use of all my estate during her natural life or widowhood she making no willful waste of the same and if she marry my will is she have no more of my estate than the law allows.
Item I give and bequeath (after the marriage or death of my loving wife Abigail Flemming) to my beloved son John Fleming Negro woman Frank, Negro man Ned, Negro boys Tom and James.
Item I give and bequeath to my beloved son William Flemming Negro man Abbo, Negro woman death (or young Negro Frank if he chooses in lieu) and Negro boys Daniel and Adam.
Item I give and bequeath to my beloved daughter Elizabeth Jackson and her husband Thaddeus Jackson the use of my Negro girl Winne during their natural life and afterwards my will is the said Negro go to the heirs begotten and born of the said Thaddeus Jackson and my daughter Elizabeth.
Item I give and bequeath to my beloved daughter Peggy Pritchett and her husband Rodham Pritchett the use of my Negro girl Hannah during her natural life and afterwards my will is the said Negro go to the heirs begotten and born of the said Rodham Pritchett and my daughter Peggy.
Item I give and bequeath to my beloved daughter Martha Fleming Negro girl Nan and in case either of my said daughters die without heir my will is the survivor of the deceased have the Negroes.
Item my will is my daughter Martha Fleming have 7 pounds current money paid out of my estate to make her estate equal to her two sisters who have each of them had a horse a piece.
Item my will is that my two daughters Peggy Pritchett and Martha Fleming have each of them made out of my estate one feather bed and furniture a piece.
Item my will is after my son William Flemming has taken his choice of my aforesaid Negroes, Bess and Frank that the others not chosen and Negro George be the property of my grandchildren by Thaddeus Jackson and my daughter Elizabeth Jackson and Rodham Pritchett and my daughter Peggy Pritchett after the marriage or death of my loving wife on condition the said Thaddeus Jackson and Rodham Pritchett or their heirs purchase a Negro for my daughter Martha Fleming in proportion to that legacy.
Item I give and bequeath to my beloved son John Fleming my still.
Item my will is after the marriage or death of my loving wife that the remainder of my estate not yet given be equally divided between all my children.
Lastly, my will is that my loving wife Abigail Flemming my beloved sons John Fleming and William Flemming be the executors of this my last will and testament. In witness whereof I the said William Flemming have hereunto set my hand and seal the seventh day of January 1767.

At a court held for Westmoreland County the 28th day of April 1767 this will was proved by the oaths of Peter Smith, Jr., and Hugh Thomas, Jr., witnesses thereto and ordered to be recorded and on motion of John Fleming and William Flemming the executors named in the said will who made oath according to law and together with James Bailey and Peter Smith their securities entered into and acknowledged bond with conditioned as the Law directs, certificate is granted them for obtaining a probate thereof in due form.
