[Md. Calendar of Wills, v. 2, Page 88] Hillary and Anne Ball sold "Wheelers Purchase" to William Hutchison, 21 Nov. 1706, in which deed Anne is identified as the Anne Wheeler of John Wheeler's will. Memorandum that on the special petition of Richard Ball preferred to the justices of Prince George's County, Maryland on the 4th Tuesday in June in the 8th year of our Dominion and this Lordship's commission was issued by order of the justices of the county court in these words following, to wit; PGCo, Frederick Absolute Lord and Proprietary of the Province of Maryland and Avalon Lord Baron of Baltimore vizt; to Messrs Francis King, Jonathan Burch, John Sutton and Nathaniel Newton of PGCo Gentleman, whereas Richard Ball, is seized of a tract called "Brothers Delight" and preferred his petition in writing to our county court held at Upper Marlborough Town to prove and perpetuate the memory of the bounds of the said tract of land. Therefore, we command you any three or two of you to examine all witnesses or persons concerned touching their knowledge of the bounds of the said tract. By virtue of a commission to examine evidences to prove the bounds of "Brothers Delight" hereby give notice that we intend to meet at the lands on Saturday, February 17th next. Witness our hands and seals this January 5, 1759, Francis King, John Sutton
Being on a south hill side near a small old field and on the east side of the Quarter Branch where there is put a large stone we took the following depositions
James Wheeler aged 81 or thereabouts deposes that about 55 years ago Hilleary Ball showed this deponent a bounded gum standing at or near the place where is now put a large stone and told him it was the first bound tree of "Brothers Delight" and that Dorman Walker had several times showed him the same gum and further saith not
being now on the north side of a small branch that runs into Quarter Branch at a red oak stump where now is put a stone we took the following deposition
Anm Scandall aged 80 deposes and says that the tree which he now sits on the stump of about 47 years ago her former husband Hilleary Ball showed her and told her it was the last bound tree of "Brothers Delight" in the 1st bound tree of "Sisters Delight" and further saith not.
