1790-1791 Prince George's County, Maryland Land Records Liber JJ 2 [Abstract by Mike Marshall]; Page 36. At the request of William Dent Beall the following Land Commission was recorded April 19, 1790
Memorandum that on the special petition of William Dent Beall of PGCo preferred to the justices of the county on the Monday before the 4th Tuesday in June 1789 for a land commission was issued on June 30, 1789; to Messrs Robert Bowie, Edward Boteler, William Newman Dorsett and William Morton of PGCo Gentleman, whereas William Dent Beall on behalf of Thomas Alexander Brooke is seized of part of a tract called "Brookefield" and preferred his petition in writing to our county court held at Upper Marlborough Town for a commission to examine evidence to prove and perpetuate the memory of the bounds of the said tract of land. Therefore, we command you any three or two of you to examine all witnesses or persons concerned touching their knowledge of the bounds of the said tract. Witness David Craufurd, Gentleman, June 29, 1789, issued June 30, 1789, John Read Magruder, clerk
In pursuance of a commission to examine evidences to prove the bounds of "Brookefield" we met September 15, 1789 at a stump of a white oak standing by Mattapany main branch between a spring run and an old road that formerly crossed the main branch towards where Capt. Leonard Brooke, deceased lived.
Jonas Austin aged 58 years, saith that 11 years ago being a tenant of Isaac Brooke went to Dr. Richard Brooke to know where he might cut logs to repair the fence between them who told him that he claimed the fence between them and if he wanted logs he might go down the spring branch where Polly Taylor lives and nearly where it intersected the main branch was the division boundary and that his negro man Boatswain had cut it down unknown to him but he had ordered him to drive a stake down in the stump which was hollow. Accordingly this deponent went to the stump with a stake which he deemed to be a boundary and is the stump he now deposes to.
Wm D. Beall question: describe on what part of Dr. Brooke's plantation Mary Taylor then lived and in what direction of the compass from his house?
Jonas Austin answer: near the head of a small spring branch which enters into the main branch where we now are described before and north west from his dwelling house
Wm D. Beall question: did Dr. Brooke ever cut any of the wood on the west side of the small branch that runs from Mary Taylors whilst you was Isaac Brooke's tenant?
      Jonas Austin answer: No
Wm D. Beall question: did his people ever cut any of the wood near the said branch on the other side of the branch
      Jonas Austin answer: Yes
John Frederick Augustus Priggs aged about 62 years at the same place saith that about 9-10 years ago Mr. Walter Brooke Cox was in a treaty of purchase or exchange with Isaac Brooke, since deceased for the plantation whereon Jonas Austin then lived as tenant that Mr. Cox and Mr. Brooke applied to him to run the division lines of the plantation that divided the same from the plantation then in possession of Dr. Richard Brooke. We went to Dr. Richard Brooke for information where the division boundary stood, but him being at that time sick, his sister Mrs. Lucy Estep who was at that time with her brother directed us to go to the mouth of the spring run that run from near the house where Mary Taylor lived that was built for an overseers house and that between the mouth of said run and the old road that crossed Mattapany Main Branch and on the bank stood the division boundary, but she understood her brothers negro Boatswain had cut the tree down. This deponent begun to run the division line from the stump of a hollow white oak described in Jonas Austin's deposition and after running the lines he was at Dr. Brookes who told him he had run the division lines wrong. This deponent understood from what the doctor then said that he expected a line drawn direct to the beginning tree was the division line.
Mr. Beall question: do you remember when you run the division lines how did it answer with the line that formerly stood as a division fence when you first knew it?
John FA Priggs answer: that he thinks the lines then run by him was rather to the westward of the place where the fence formerly stood except that part of the fence which stood opposite the doctors young orchard which the main road divided and where was formerly a lane. The line of the fence formerly was near the old orchard of Dr. Brooke's and the main road run along the lane between the old orchard and the line of fence that was formerly Mrs. Mary Brooke's, grandmother to the late Mr. Isaac Brooke, deceased
      Adjourned to Monday, September 28, 1789;
Capt. William Bowie, Sr., aged 69 years or thereabouts that upwards of 40 years ago Mr. Isaac Brooke, brother of Dr. Richard Brooke carried him to the head of a small branch running into the main branch of Mattapany which is near a house called Boatswain or Molly Taylor's and pointed out to him a tree and said the line between Mrs. Belt (his {Isaac Brooke's} brother Walter {Brooke} widow) and Dr. Richard Brooke at nearly the same time told the line above mentioned was nearly as the fence then run and he further declares that he has known the land on the east side of the fence as it now stands to be in the possession of Dr. Richard Brooke and the family for upwards of 40 years .
Mr. William Trueman Greenfield aged 34 or 35 years saith about 25 or 26 years ago the line of fence that then divided the plantation whereon Mr. Thomas Marlow now lives and the plantation whereon Wm. D. Beall now lives was standing near to where the road between the above plantation now runds and at that time Mrs. Brooke, the widow of Mr. Walter Brooke tended the ground inside the fence next to her house which stood where the said Beall now lives.
Adjourned to Monday, November 23, 1789
Mr. Wm Crooke aged about 48 years at the same place deposed that in the spring of 1780 being an overseer (and living in the house called Polly Taylor's house) for Dr. Richard Brooke he desired me to plant a stake in a stump. Says the fence formerly run between Dr. Brooke and the Hill plantation where Major Beall now lives
Mr. Wm Taylor aged about 52 years saith about 21 years ago I overlooked Col. Belts plantation on the Hill (as it is called) and in the spring and Dr. Brooke told me negro Charley boy could tell me where the line run and I immediately moved the fence for fear of loosing the logs to where the fence now stands
March 24, 1790; we met at the request of Mr. Thomas F. Brooke. Wm Taylor aged about 53 years saith about 21 years ago being an overseer for Col. Jeremiah Belt on his plantation adjoining Dr. Richard Brooke and where Major Beall now lives that there was a piece of tobacco ground on the west side of a fence which then run near the main road and that Dr. Richard Brooke told him to move the fence out from the road or else he would do it for him. Dr. Brooke told me negro Charley boy who shewed me the line. Before I moved the fence I went to Col. Jeremiah Belt and Mrs. Belt and told them what Dr. Brooke had said and Mrs. Belt appeared to be angry and that either she or the Col. Belt told him to run the line as Dr. Brooke and Charley boy directed. Mrs. Belt said she did not know whether Charley boy had ever seen the land run, she had never seen it herself. (Wm Taylor was overseer for both Col. Jeremiah Belt and Dr. Richard Brooke the same year
March 24, 1790; at the request of Mr. Thomas F. Brooke. William Crooke aged about 48 years deposes the same as his earlier deposition
