      Spillman's Will
      This last will and testament William Spillman being in perfect sense and memory tho weak.
      Imprimis, I give to my youngest daughter Margaret Spillman, one bed and furniture and one cow and calf and 10 shillings worth in pewter.
      Item I give to my daughter Lettice Dulin one cow and calf.
      I make my loving sons Thomas Spillman, William Spillman and John Spillman my whole executors and my land and improvements to be equally to be divided between the three brothers, my beloved sons, this being my last will and testament.       Being in perfect sense and memory , thou weak in body, but Blessed be God in perfect ___, as followeth:
      Imprimis: I bequeath my Soul to God in Jesus Christ who was my Creator and Redeemer, in whom I trust to be my Creator, to save me again at the last day in Glory. I also bequeath my body to the earth from whence it had its being, to be orderly and decently buried and my worldly goods, as follows:
      Imprimis: I give unto my grand daughter Margaret Spilman, a certain parcel of land lying on E/S Modoro Branch, commonly known as Whitins during her lifetime; and after her decease to return to my grandson Robert Frank., and if my grandson Robert Frank should die without issue lawfully begotten of his own body, to return to my grandson, William Plunkett
      Impremis: I give unto my grandson John Grinning, a certain parcel of land lying between the Church path and Modoro branch, to him and his heirs forever..
      Impremis: I give unto my grandson Robert Frank, my plantation and land belonging thereto, and to inherit the same at the age one and twenty, to him and his heirs forever; said land to be in possession of John Plunkett, until such time he comes of age.. If he should die without heirs of his body, this land to return to my grandson William Plunkett
      Impremis: I give unto my grand daughter Margaret Spilman , one cow and calf.
      Impremis: I give unto my grandson, William Plunkett, bed and funishings, which I commonly ly on.
      Impremis: I give unto my grand daughter Elizabeth Knighton, my next best bed and furnishings.
      Impremis: I give unto my grandsons, Thomas Grinning and John Grinning, all my wearing cloathes, after my decease, to be equally divided between them.
      Impremis: I give unto my grandson Thomas Frank, my horse, bridle, and saddle.
      All the rest of my personal effects I give to my friend, John Plunkett .
      Also, I make my loving friend, John Plunkett my whole and sole Exr of this last Will & Testament. In Witness whereof I have hereunto set my hand and fixed my Seal this 17th day of November, 1725.

      William Spilman that married Margaret Frank bought two tracts of land that he was living on one from Robert Jr. Frank and the other from William Plunkett. (it was land of Robert Sr. Frank) This land passed to John Spilman. On Nov. 24 1767 John Spilman of King George Co. in the parish of Brunswick deeded this land to William and Thomas Spilman of Washington parish in Westmoreland Co. Rec. Nov 1767

      LAST WILL AND TESTAMENT
      WILLIAM SPILMAN OF WESTMORELAND COUNTY (d.1760).

      THIS Last Will and Testament William Spillman Being in Perfect Sense and memory thou weak in heth, Blessed be god in Respect Sence as followeth:
      IMPRS. I bequeath my Soul to God in Jesus Christ who was my Creator and redeemer in whom I trust to be my Creator to raise me again at the last day in glory. I also bequeath my Body to the Earth from whence it had its being to be order by and Decently buried and worldly goods as followeth.

      IMPRS. I give to my daughter Lettice Dulin one cow & Calf.

      IMPRISE I give to my youngest Daughter Margarett Spillman One bed and furniture and One Cow and Calf and ten Shillings worth in Pewter.

      THIS INDENTURE made the 20th day of February in the year of our Lord 1738 and in the Eleventh year of our Sovereign Lord George the Second by the grace of God of Great Brittain France and Ireland, King, Defender of the faith: Between ROBERT FRANK and MARY his Wife of Parish of Washington in County of Westmoreland of one part, and WILLIAM SPILLMAN of the same place of the other part; Witnesseth that ROBERT FRANK and MARY his Wife in consideration of Six hundred pounds of tobacco & 15£in hand paid by WILLIAM SPILLMAN, the receipt whereof ROBERT FRANK and MARY his Wife doth own & acknowledge, hath and by these presents doth bargain and sell to WILLIAM SPILLMAN his heirs a parcel! of land which his Grandfather, ROBERT FRANK, left him by Will. being by estimation 160 acres more or less, scitaute in Washington Parish in County of Westmoreland, the land entirely lying on Eastern side of the head of APPOMATTOCK CREEK, which Land all entirely of the Eastern side of the Creek ROBERT FRANK & MARY his Wife doth unto WILLIAM SPILLMAN his heirs sell with all houses tobacco houses barns orchards & appurtenances belonging; To have and to hold the tract of land with rights members and appurtenances unto WILLIAM SPILLMAN his heirs, And ROBERT FRANK and MARY his Wife for themselves their heirs shall warrant & defend the premises from the claim of all manner of persons; In Witness whereof ROBERT FRANK'S, MARY his Wife hath set their hands and seals the day and year above written

      THIS INDENTURE made the twentyfourth day of November in the year of our Lord Christ one thousand seven hundred and sixty seven and in the seventh year of the reign of Our Sovereign Lord George the third by the grace of God of Great Brittain, France, and Ireland, King, Defender of the faith, between John Spilman of the County of King George and Parish of Brunswick in the Colony of Virginia, planter, of the one part and Thomas Spilman of the Parish of Washington and County of Westmoreland, and William Spilman of the same Parish and County aforesaid, which said John Spilman, Thomas Spilman, and William Spilman are the three sons of William Spilman their late father deceased of the other part. WITNESSETH that the said John Spilman for and in consideration of the sum of twenty five pounds current money of Virginia to him in hand paid by the said Thomas Spilman and William Spilman party hereto, the receipt whereof the said John Spilman doth hereby confess and acknowledge and discharge the said Thomas Spilman and William Spilman party hereto, their executors and administrators, hath granted bargained, sold, aliened and confirmed and by these presents doth grant, bargain, sell, alien, and confirm unto the said Thomas Spilman and William Spilman party hereto, and to their heirs, all that one undivided third part (the whole in three equal parts to be divided) of and in all containing two hundred acres be the same more or less, scituate, lying, and being in the Parish of Washington and County of Westmoreland, the aforesaid land being part of a tract of land belonging to Robert Frank and on the north side of the main branch of Mattox Creek and bounded as followeth, beginning at a marked black oak and extending west to the line of William Piper to marked red oak, thence along the said Piper line N by W to marked hickorie, thence down the main branch of the said creek and then along the said dam to the uppermost line, thence No. to a black oak, thence East to a live oak in a small branch, finally to the first station, which said tract of land was given and devised to the said John Spilman, Thomas Spilman, and William Spilman party hereto, in and by the last will and testament of the said William Spilman the father, deceased, and all houses, buildings, orchards, ways, watercourses, profits, commodities, hereditaments and appurtenances whatsoever to the said premises hereby granted or any part thereof belonging or in any wise appertaining, and the reversion and reversions, remainder and remainers, rents, issues and profits thereof and all the estate, right, title, interest, use, trust, property claim and demand whatsoever of him the said John Spilman, of and in and to the same premises and all deeds, evidences, and writings touching or in any way concerning the same TO HAVE AND TO HOLD the said one third part of the said tract and all and singular other the premises hereby bargained and sold and every part thereof with their appurtenances unto them, said Thomas Spilman and William Spilman party hereto, their heirs and assigns, to the only proper use and behoof of them the said Thomas Spilman and William Spilman party hereto, their heirs and assigns forever, as tenants in common and not as joint tenants, and the said John Spilman for himself, his heirs and assigns, doth covenant, promise and grant to and with the said Thomas Spilman and William Spilman party hereto, their heirs and assigns by these presents, that he and the said John Spilman now at the time of the sealing and delivery of these presents is seized of a good, sure, perfect and indefeasible estate of inheritance in fee simple, of and in the said third of the said tract of land hereby granted and hath in himself good right, full power, and absolute authority to grant and convey the same to the said Thomas Spilman and William Spilman, party hereto, and their heirs in manner and form aforesaid, and that the said premises now are and forever hereafter shall remain and be free and clear of all former and other gifts, grants, bargains, sales, dower rights and titles of dower intails, judgements, executions, titles, troubles, and incumbrances whatsoever made, done, committed, or suffered by the aforesaid John Spilman or any other person whomsoever claiming under him (the quit rents here-after to grow due for the same premises only excepted) and further that he the said John Spilman and his heirs all and singular, the third part of the said premises hereby bargained and sold with their appurtenances unto them the said Thomas Spilman and William Spilman, their heirs and assigns, against him the said John Spilman and all other persons and persons whomsoever, shall and will warrant and for-ever defend by these presents, and lastly it is hereby declared and agreed between the said Thomas Spilman and William Spilman party here-to, that the remaining two undivided third parts of the said tract of land and premises so given and devised by the will of their said late father William Spilman and also the said third part of the said land bargained and sold unto them as aforesaid shall remain, continue, stand, and be to the use and behoof of them the said Thomas Spilman and William Spilman party hereto, not as joint tenants but in such sort, manner, and form that each of them, their heirs and assigns, shall hold their respective moieties in severally and that the law of survivorship at the death of either of them shall not take place. IN WITNESS WHEREOF all the said parties have hereunto set their hands and seals the day and year first above written.
