      John Augustine Washington's Will
      In the name of God Amen, I John Augustine Washington of Bushfield in Westmoreland County being in perfect health due in my own hand make and constitute this my last will and testament.
      Imprimis, I bequeath to my beloved wife Hannah Washington during her natural life, the use of one third of all the Negroes I am possessed of among which are to be included my waiting man Jevey and his wife Suck, my seamstress Jenny and her husband Billy and her daughters Betty, Jenny and Venus, I impower my wife to devise to such of my children by her as she pleases. I give to my said wife one half of all my furniture both house and kitchen, all my plate, my chariot in the four horses that belong to it, all the plough horses and the stocks of cattle, sheep and hogs on the Bushfield estate and all the plantation utensils. I also give to my beloved wife 30 pounds a year during her widowhood to be raised out of the estate hereafter devised to my sons Bushrod Washington and Corbin Washington regularly paid to her and are intended in lieu of her dower in my estate.
      Item for the purpose of discharging my just debts and payment of the legacies hereafter devised to my daughters it is my will and desire that my executors make sale of and lawful conveyance for my lands in Loudoun County purchased of George Carter’s [of Middle Temple] estate and containing 2500 acres, one half my stock of cattle, houses, sheep and hogs in Berkeley County and Loudoun County, the residue of my furniture, my crops on hand at the time of my death and debts due me to be applied also to the same purpose, also sold any Negroes to be sold out of those hereafter bequeath to my sons Bushrod Washington and Corbin Washington as may be found necessary.
      Item I give and bequeath to my daughter Jenny Washington and her heirs 600 pounds specie and confirmed to her the gift of the Negroes she has received from me; the sums of money advanced my son-in-law William Augustine Washington in the presence and other things made since her marriage.
      Item I give to my granddaughter and Ann Aylett Washington a Negro girl between the age of six and 10 years old.
      Item I give to my daughter 1000 pounds specie to be raised as soon as possible after my death by my executors and put to interest on good land is security for her use and until that is done, she to be allowed 50 pounds yearly out of my estate, but provided my said daughters should die before she comes to age or marriage then it is my will that the legacies giving her be equally divided between her surviving brothers and sisters. I also give my daughter a Negro girl.
      Item I give and devise to my son Bushrod Washington his heirs and assigns the following tract of land in Berkeley County patented in my own name joining the lands of Rutherford, Nourse, Blackbourn &c, containing 643 acres. My land in Stafford County conveyed to me by my mother Mrs. Mary Washington adjoining the lands of Downman’s estate and Col. Burgess Ball on Rappahannock and containing 400 acres, two surveys made for me near the waters of Redstone Creek each survey containing 320 acres, one of them in my own name called the Forks, the other, I had surveyed in the name of Lawrence Washington and is called Bears Range, the surveys are adjoining each other and form a square. I also give to my son one half my Negroes not otherwise disposed of after my debts and legacies are paid and one half my stock not otherwise disposed of.
      Item I give and devise to my son Corbin Washington his heirs and assigns all the lands I hold in Berkeley County not otherwise disposed of and the remaining half of my Negroes and stock not otherwise disposed of reserving to my son Bushrod Washington the use of the tract of land I purchased of Mr. James Russell of London and a field on the land I purchased of Robert Worthington known by the name of Smoote’s field to assist in working his Negros on during his mother’s natural life and in case my son Bushrod should be deviated in his just expectations of inheriting his mother’s land which she possesses under her fathers will and her her death then it is my will and desire that one third of the lands given my son Corbin Washington be laid off according to quality for my son Bushrod Washington which upon that contingency I give him and his heirs and assigns forever.
      Item the one third of my Negroes lent to my wife during her natural life at her death should be equally divided between my sons Bushrod Washington and Corbin Washington.
      Item it is my will and desire that in case either of my sons should die without lawful issue that the lands and negroes devised to such son so dying shall descend to the survivor.
      Lastly, I constitute and appoint my beloved wife Hannah Washington during her widowhood and no longer, executrix and my much-esteemed brother General [George] Washington and my son Bushrod Washington and Corbin Washington executors of this my last will and testament in witness whereof I have hereunto set my hand and seal this 22nd day of June 1784.

      Memorandum; be it known that since the making and executing my last will and testament contained on this sheet of paper and bearing date this 22nd day of June 1784 a deed of gift has been made my son Bushrod Washington by me for 41 Negroes, which said Negroes I do by this codicil direct shall be deducted from the population the Negroes he would be entitled to under the gift of the Negroes to him contained in my will.
      Whereas since making and executing my will aforesaid I have purchased a tract of land near Bath of Robert Throckmorton, Jr., containing by a late survey to hundred and 13 acres, and in my said will omitted to devise two lots with their and improvements which I am possessed of in the town of Bath; I do by this codicil direct that the said tract of land and the two lots with their improvements be sold by my executors on reasonable credit and proper deeds of conveyance made by them and the money arising from the sale be applied to the payment of my debts and legacies contained in my will.
      I confirmed to my grandson Augustine Washington and his heirs the gift of a Negro called Griffin and to my granddaughter Hannah Bushrod Washington the gift of a Negro girl called Harriet.
      The above codicil shall be considered as an addition to my will, given under my hand and seal this 19th of November 1785.

      At a court held for Westmoreland County 31st day of July 1787 this will and codicil was presented to the court in allowed to be the handwriting of the testator, the same is therefore ordered to be recorded; and on the motion of Bushrod Washington and Corbin Washington two of the executors therein named who made oath thereto according to law and together with William Augustine Washington their security entered into and acknowledged bond with conditioned as the law directs, certificate is granted them for obtaining a probate thereof in due form.

      Washington & Wife to Washington Indenture
      This indenture made the 22nd day of April 1789 between Bushrod Washington and Ann Washington his wife of the County of Fairfax of the one part and Corbin Washington of the County of Westmoreland of the other part. Witnesseth that Bushrod Washington and Ann Washington his wife in consideration of 1000 pounds in hand has sold and released unto Corbin Washington all that tract of land lying in the parish of Cople and County of Westmoreland being parcel of the Bushfield Tract which said land is at present vested in Hannah Washington during her natural life and after the death of of her to revert to the said Bushrod Washington and which said lands is bounded as followeth; beginning at a stake standing on the head of a creek that makes out of Nomini River just below the tenement now in the possession of John B. Steele, thence South 28 ½° East 19 44/100 poles, thence South 43 ¾° East 8 pole thence South 36 ½° East 14 64/100 pole, thence South 29° East 12 poles, thence South 49 ¼° East 25 6/10 poles to a black gum standing on the south side of the road leading from Nomini church to the Glebe, thence South 57° East 117 8/10 poles to a stake at the corner of the woodyard, thence with the lines of Rowand, Henry Lee and John Turberville to a dead pine tree standing on the bank of Nomini River a little below the mouth of a small creek called the Old Dead Floods Creek, thence along the shores of the Nomini River to the mouth of the creek on the head of which is the beginning, from thence up the South West side of the said Creek to the beginning containing by estimation 500 acres. [any surplus or shortfall in acreage to be calculated at the rate 40 shillings per acre]. In witness whereof the parties to these presents have set their hands and affixed her seals the day and year first above written.

      The commonwealth of Virginia to Joseph Pierce, John Rochester and Richard Lee, Gent. Whereas Bushrod Washington and Ann Washington his wife by their indenture bearing date the 22nd day of April 1789 have sold and conveyed unto Corbin Washington the fee simple estate of a tract of land lying in the parish of Cople and County of Westmoreland and whereas the said Ann Washington cannot conveniently travel to our quarter Westmoreland to make acknowledgment of the conveyance. Therefore, we do give unto you or any two or more of you power to receive the acknowledgment which the said Ann Washington shall be willing to make. Witness James Bland, clerk of our said court at the courthouse the 22nd day of April 1789.
      Pursuant to the within commission we the subscribers personally went to the within named Ann Washington and received her acknowledgment of the deed hereunto annexed and she having and thereupon freely made her acknowledgment of the said deed and that she did the same without the persuasion or threats of her husband and further that she was willing that such acknowledgment should be certified by us to the justices of the County of Westmoreland. Given under our hands and seals this 22nd day of April 1789.

      At a Court held for Westmoreland County the 27th day of October 1789 this indenture of bargain and sale and receipt thereon endorsed were proved by the oaths of Joseph Pierce, John Rochester and John Brown Steele three of the witnesses thereto and together with a commission annexed to take the privy examination of Ann Washington wife of the within named Bushrod Washington and a certificate of the execution thereof or together with the said indenture ordered to be recorded.
