      TO ALL CHRISTIAN PEOPLE to whome these presents shall come, Know yes that we SIMON TAYLER and ELIZABETH my Wife, THOMAS JESPER and ANNE my Wife, CHRISTOPHER PRIDHAM and MARY my Wife of the one partie and JOSEPH DEEKE and WILLIAM LYNTON of the other party. Wittnesseth that the said SIMON TAYLER & ELIZA: his Wife, THOMAS JESPER & ANNE his Wife & CHRISTOPHER PRIDHAM & MARY his Wife have for the valuable consideration of Three thousand pounds of tobbo: to them in hand paid have granted and sold unto the said JOSEPH DEEK and WILLIAM LYNTON all theire whole Estate right title & interest of in and to Two Letters Pattents dated att WESTMSTR: the Eight day of May in the one and twentieth yeare of the Reigne of our Sovereign Lord King Charles ye Second granted by PHILLIP LUDWELL Esqr., Agent & Attorney of the Lords Proprietors unto THOMAS LEWIS, WILLIAM MORGAN & EDWARD LEWIS, the one containeing Three hundred and sixty acres of Land scituate and being part in RAPPA; and part supposed in NORTHUMBERLAND and the other granted unto THOMAS LEWIS and EDWARD LEWIS of RAPPA: County for Five hundred twenty and eight acres of Land scituate and being part in the aforesaid County of RAPPA: and part in NORTHUMBERLAND; To have and to hold as well all the messuages tenements and hereditaments mentioned in the said Pattents as also our whole estate right and interest of and to the same from us the said SYMON TAYLER and ELIZA: my Wife, THOMAS JESPER & ANNE my Wife & CHRISTOPHER PRIDHAM & MARY his Wife our heires and assignes unto JOSEPH DEEKE and WILLIAM LYNTON theire heires and assignes saveing and reserving to our selves that the said JOSEPH DEEKE and WILLIAM LYNTON pay the yearely rents reserved for her Majesties use her heires and Successors and we joyntly and severally oblidge ourselves our heires to acknowledge this Deed of Indenture att the next Court held for the County of Richmond and likewise to make such other or further assureances as the said JOSEPH DEEKE and WILLIAM LYNTON or theire Attorney learned in the Law shall reasonably devise or advice for the confirmation of the premisses above mentioned.       THIS INDENTURE made this 2d. day of March 1712 and in the eleventh yeare of the Reigne of our most gratious Lady Anna of Great Brittaine, Queene defender of the faith &c. betweene JOSEPH DEEKE of Parish of Farnham in County of Richmond and KATHERINE his Wife of one part and WILLIAM LINTON of Parish of COPELEY in County of WESTMORELAND and JOHANNA his Wife of the other part; Wittnesseth that JOSEPH DEEK and WILLIAM LINTON hold joyntly are and do stand seized in their demeasne as of fee in common and undivided of and in one messuage or tenement and Three hundred Ninety & seven acres of land thereunto belonging; formerly granted to THOMAS LEWIS, WILLIAM MORGAN & EDWARD LEWIS by Patent bearing date the one and twentieth day of August 1691; scituate in ye County of Richmond and NORTHUMBERLAND upon a Branch or Swamp comonly knowne or called by the name of the MARSHY SWAMP, which said land the parties above mentioned bought and purchased of SIMON TAYLOR and ELIZABETH his wife, THOS: JESPER and ANNE his Wife, XOPHER PRYDHAM and MARY his Wife, Coheirs of JOHN LEWIS, the sole heire of EDWARD LEWIS as by a Deed of Bargaine and Sale under their hands in Writing bearing date the third day of March in the third yeare of the Reign of our gracious Sovereign Lady Anna then of England Scotland France & Ireland, Queen defender of the faith, more att large may appeare; AND NOW to the end a perpetuall portion and division shall be had and made betweene the said parties in the said Lands and other the premises, it is hereby covenanted concluded and agreed upon by and betweene said parties to these presents in manner and forme following; And first the said JOSEPH DEEK for himself his heirs that WILLIAM LINTON his heirs shall from henceforth have hold and peaceably enjoy in severalty to him and his heirs the one moyety or halfe part of the said tract of land (that is to say) that part or portion that lyeth on the Southward side of the MARSHEY SWAMP in Richmond County with Fourty seven acres more being the reversion of another Patent ioyning to ye above premises; And that the said JOSEPH DEEK nor his heirs shall from henceforth clayme nor demand any right title to possession in or to the same; And the said WILLIAM LINTON for himselfe hisheirs doth likewise covenant and promise by these presents that JOSEPH DEEK his heirs shall from henceforth have hold possess and peaceably enjoy in severalty to said JOSEPH DEEK his heirs. the other moyety or half part of ye said messuage tenement of 397 acres of land with the appurtenances, that is to say, that portion that lyeth on the Northward side of the aforesaid MARSHEY SWAMP in NORTHUMBERLAND County with all the appurtenances thereunto belonging; and that ye said WILLIAM LINTON nor his heirs shall from henceforth clayme nor demand any right title in the same; And further it is agreed upon betweene the parties that a penalty be had and made to be paid by him or them shall make any breach of the covenants and agreements by dawning or pretending to lay any manner of clayme to any parcell of the aforesd. portion; And if JOSEPH DEEK his heirs shall lay any manner of clayme to that portion allotted to WILLIAM LYNTON shall forfeit and pay unto WILLIAM LINTON his heirs the full and just summe of Twenty thousand pounds of good tobacco in cask convenient to Water in Richmond County; and WILLIAM LINTON doth oblige himself that if any any time hereafter said WILLIAM LINTON or his heirs shall lay any clayme to that part allotted to JOSEPH DEEK shall forfeit and pay to ye said JOSEPH DEEK his heirs the full summe of Twenty thousand pounds of good tobacco in cask convenient to Water in WESTMORELAND County; In Wittnesse whereof the parties abovesaid have sett their hands and seales the day and yeare first above written (the words in Richmond County interlined before signed, that part that lyeth in WESTMORELAND County interlined before signed)
