      Peter McClanahan’s Will [no date probate]
      In the Name of God Amen, I Peter McClanahan of the County of Westmoreland and parish of Cople being sick and weak, though in perfect sense and memory doth make and ordain this my last will and testament.
      Item I give and bequeath to my son William McClanahan all my land, and Negro Daniel and his heirs, and for want of such heirs to return to the next heir.
      As for the rest of my six children I do give and bequeath all my estate not mentioned both real and personal to be equally divided between Peter McClanahan, Thomas McClanahan, James McClanahan, Mary McClanahan, Betty McClanahan, and John McClanahan.
      I do appoint my son William McClanahan, my son Thomas McClanahan and my son Peter McClanahan, whole and sole executors of this my last will and testament. In witness whereof I have hereunto set my hand and seal this ninth day of January 1775.

      THIS INDENTURE made the twenty fifth day of August in the year of our Lord one thousand seven hundred and fifty five and in the twenty eight year of the Reign of our Sovereign, Lord George the Second, by the grace of God of Great Britain France and Ireland, King, Defender of the faith, &c., Between DANIEL WALKER and NANCY his Wife of the County of Westmorland and Parish of Cople of one part and PETER [Mc] CLANAHAM of County of LANCASTER and Parish of White Chappel of other part; Witnesseth that DANIEL WALKER and NANCY his Wife in consideration of sum of fifty pounds current money in hand paid by PETER CLANAHAM, the receipt whereof DANIEL WALKER and NANCY his Wife doth own themselves fully satisfied contented and paid, hath and by these presents doth bargain and sell unto PETER CLANAHAM and his heirs all that parcel of land lying in County of Westmorland and binding on the head Branches of NOMONY RIVER that runs down to CARTER's Double Mill on the East side of the Branch about fifteen pole from two white Oaks marked formally as a corner, thence South forty three degrees East forty nine pole to a Stump where formally stood a line tree, thence South sixty seven degrees East forty three pole to a marked Cedar, thence South sixty two degrees East sixty four poles to a Oake Nut near the head of a Branch in a Valey, South forty two degrees East twelve poles to a small white Oak, thence South fifty six degrees East twenty two pole to a red Oak corner to WILLIAM BAYLEY and in ROBERT CARTER, Esqr. line, thence South forty three degrees West twenty two poles to a red Oak in the said line, South sixteen degrees West fourteen poles another red Oak, South seventeen degrees West thirty four and one quarter of a pole to where formally stood a Locus Post, thence South forty two degrees West two hundred and two poles to a white Oak corner near the Swamp, thence South seventy four degrees West to another white Oak markt just over the Main Run standing on dry land, thence down the several meanders of the said water course to the beginning, including including seventy five acres be the same more or less and the rents issues and profits thereof; To have and to hold the premises and all priviledges and appurtenances to the same belonging unto PETER CLANAHAM and his heirs to be holden of the Cheif Lord or Lords of the Fee or Fees by the rents and services due and accustomed to be paid and DANIEL WALKER and NANCY his Wife for themselves their heirs do covenant with PETER CLANAHAM his heirs that the land and tenements is free and clear from all incumbrances and doth further warrant and forever defend the ssame against the claim of all manner of persons; In Witness whereof the parties to these presents hath interchangeably set their hands and fixed their seals the day and year above written

      Stephen Smith Will
      In the name of God Amen, I Stephen Smith, Sr., of Westmoreland County in the parish of Cople being sick and weak of body but of sound and perfect memory do make this my last will and testament.
      Item I give to my well beloved son Robert Smith, one cow big with calf.
      Item I will that my well beloved son Samuel Smith have two years schooling out of my estate and when according to the opinion of my executors he be big enough to go to a trade my will is that he should be bound to his uncle George Banister.
      Item my will is that my wife and children keep together on my plantation as long as they can contrive to subsist well on the same and if any of the elder children should go away and leave the rest they shall not carry away any part of my estate, and my will is when they can live on the said place no longer that then my executors set up my land to public auction for ready money and them that is of age to take their parts of the same and they that are underage their money to be laid up by my executors and made to be bound out to whom my executors think proper.
      Lastly, I appoint my beloved brother Samuel Smith and my loving friend James Baley and my loving wife Ann Smith whole and sole executors of this my last will and testament. In witness whereof I have hereunto set my hand and seal this 22nd day of November 1761

      At a court held for Westmoreland County the 30th day of March 1762 this will was proved according to law by the oath of Peter McClanahan and John Bailey witnesses thereto and ordered to be recorded; and on the motion of Ann Smith, James Baley and Samuel Smith the executors named in the said will who made or oath according to law and together with William Creswick, John Baley and James Baley, Sr., their securities entered into and acknowledged bond with condition as the law directs, certificate is granted them for obtaining a probate thereof in due form.

      Bailey to McClanahan Indenture
      This indenture made the 21st day of October 1765 between John Bailey, son of William Bailey and William Bailey, Sr., father of the said John Bailey and Elizabeth Bailey, wife of the said John Bailey, of the County of Westmoreland and Parish of Cople of the one part and Peter McClanahan the same parish and county aforesaid of the other part. Witnesseth that John Bailey and Elizabeth Bailey his wife and William Bailey in consideration of 75 pounds current money has sold to Peter McClanahan all that parcel of land (except a burying place 30 ft.²) situated and line in the aforesaid County of Westmoreland and binding on the land of the Hon. Robert Carter, Esq. and on the land of the aforesaid Peter McClanahan, containing by estimation 75 acres, which said land was the property of Elizabeth Bailey, mother of the said John Bailey and descended to the said John Bailey has been heir at law. In witness whereof the parties to these presents hath interchangeably set their hands and fixed their seals the day and year above written.

      To Willoughby Newton, Richard Lee, and John Newton, Gent. Whereas John Bailey, William Bailey and Elizabeth Bailey the wife of John Bailey by their indenture of bargain and sale bearing even day with these presents have sold and conveyed unto Peter McClanahan the fee simple estate of a tract of land (except a burying place) lying in the County of Westmoreland containing 75 acres and whereas the said Elizabeth Bailey cannot conveniently travel to record to make acknowledgment. Witness, James Davenport, clerk of our said court the 22nd day of October.
      Westmoreland Sct. We do hereby certify that in obedience to the writ hereto annexed we have examined Mrs. Elizabeth Bailey privily and apart from her husband and she doth acknowledge to us that the said conveyance is made on her part freely and voluntarily and she is willing the same be recorded. Given under our hands and seals the 27th day of October 1765.
