      Will of Peter Evans of the Parish of Cople in the County of Westmoreland, planter, sick and weak in body, dated 23 Nov. 1696.
      Unto my son Richard Evans twelve pence or one shillings sterling money of England.
      Unto my said son Richard Evans two breeding mares.
      Unto Mathew Wensbear my cow, brindled calf or yearling.
      The lands whereon I now live shall be and remain to the use of my loving wife Elizabeth Evans, and daughters Hester Evans, Mary Evans, Sarah Evans and Rebecca Evans, not be sold or aliened by any of them, but every of them to receive one fifth part untill every of their respective marriage. After their intermarriage with one husband they shall every of them enjoy their portions during the lives of their and every of their husbands and after his decease then the said portion to revert into the custody of my said son Richard Evans.
      Unto my loving wife Elizabeth Evans and my daughters Hester Evans, Mary Evans, Sarah Evans and Rebecca Evans, all my goods in the house, cattle, horses, hoggs and all other. If my wife or either of my daughters depart the world, then her part to the survivors.
      My estate shall not be sold or brought to any valuation and appraisment.
      My two loving friends Thomas Marsson and Joseph Hudson be executors.

      by JAMES BYARD, Pltf. against CHARLES LUCAS, Defendant, for lands of the demise ofMOSES RAMSEY at a Court held for the County the 23d day of February 1708, SAMUELL MORRIS appeared and confessed Lease Entry and Ouster and prayed to be admitted Defendant in the stead ofCHARLES LUCAS which was granted, whereupon he pleded the generall issue Not Guilty &c. and the suit was continued till this Court for tryall &c., And now at this Court JAMES BYARD by his Attorney, DANIELL McCARTY, bing present as also SAMUELL MORRIS by his attorney, NATHANIELL POPE, it was orderd the Sheriffshould sumon a Jury to try the issue &c., who haveing returned a Jury &c.       honest and lawfull men ofhis Baylywick sworn and charged to say the truth in the premises, upon their Oaths doe say, ''Wee of the Jury doe find that one WILLIAM HARDIDGE of Cople Parish in the County ofWestmorland did bargaine and sell by Deed bearing date 19th December 1685 one hundred acres more or less unto PETER EVANS his heires for ever; Wee also doe find that said EVANS by his Last Will in Writeing under his had and seale beareing date the 23d day ofNovember 1696, did desire and bequeath the said land in these words following; 'Item I give and bequeath and it is my will and meaning that the land whereon I now live shall be and remaine to and for the proper use ofmy loveing Wife, ELIZABETH EVANS, HESTER EVANS, MARY EVANS, SARAH EVANS and REBECCA EVANS not to be sold or aliened by any ofthem by every ofthem to receive and enjoy one fifth part of the said land untill every oftheir respective marriages and after their or either oftheir marriages with one Husband they shall every ofthem enjoy their and every oftheir part and portion in the said Land dureing the naturallifeof their and every of their said Husbands, and after his decease then that the said part or portion ofthe said Land of my loving Wife, ELIZABETH EVANS, HESTER EVANS" MARY EVANS, SARAH EVANS and REBECCA EVANS soe marrying and her Husband dying to revert & come into the custody and possession of my Son, RICHARD EVANS, and his heires for ever;' Wee find that SAMUELL MORRIS did intermarry with ELIZABETH, the Widdow ofPETER EVANS. We doe likewise find that there is but two Daughters liveing of the said PETER, vizt MARY and SARAH which MARY is intermarryed with MOSES RAMSEY, who is Lessor ofJAMES BYARD, the Pltf., If the right ofthe land is in the Pltf. wee find twelve pence damage, ifnot then wee find for the Defendt." Whereupon it was ordered the Verdict should b entered on the Record of this County and the suit be continued till the next Court for tryall of the title &c.

      THIS INDENTURE made the twenty sixth day of January in the ninth year of the Reign of our Sovereign Lord George the Second by the grace of God of Great Britain France and Ireland, King, Defender of the faith &c,, And in the year of our Lord one thousand seven hundred and thirty five; Between DANIEL VAUGHAN of ST. MARY's County in the Province of MARYLAND, Planter, of one part and WILLIAM AYLETT of the County of Westmorland in the Colony of Virignia, Gent., of other part; Witnesseth that DANIEL VAUGHAN in consideration of the sum of five shillings of lawfull money to him in hand paid by WILLIAM AYLETT, the receipt whereof is hereby acknowledged, hath and by these presents doth bargain and sell unto WILLIAM AYLETT all that parcel of Land containing One hundred acres more or less wch: PETER EVANS, Father to the said DANIEL's Mother, bought of WILLIAM HARDIDGE, Gent., on the North side of NOMINY RIVER adjoining to the Land of Collo. THOMAS SPEAK by a Deed bearing date the ninteenth day of December 1684, and left by said EVANS in his Last Will & Testament bearing date the 23d day of November 1696 to several of his Children relation being thereunto had may more fully appear; all wch: Children are dead neither of them leaving any heir but SARAH, who intermarryed with JOHN VAUGHAN, And the said DANIEL is Eldest Son and heir at Law to the said SARAH who marryed as aforesaid; Together with all houses orchards comodities & appurtenances belonging; To have and to hold the premises unto WILLM: AYLETT his heirs during the term of one whole year paying thereof the Rent of one ear of Indian Corn on the last day of the term if lawfully demanded; to the intent that by virtue of these presents and of the Statute for transferring uses into possession, WILLM. AYLETT may be in the actual possession of the premises and thereby be the better enabled to take a release of the inheritance thereof to him and his heirs; In Witness whereof the said DANIEL VAUGHAN hath hereunto set his hand and seal the day and year first above written
