FRANCIS(5) THORNTON (Francis(4), Francis(3), Francis(2), Wm.(1) of "Fall Hill," Spotsylvania county, married in 1759 Ann, daughter of Rev. John Thompson, by his wife Butler Brayne, widow of Governor Spotswood.
The will of Francis Thornton was dated Feb. 13, 1794, and proved in Spotsylvania April 8, 1795; gives his wife Anne all of his negroes, horses, cattle, sheep, household furniture, &c., and 200 acres of land for her life; to son Francis the remainder of his land where he lived, and the reversion of estate left his wife to daughters Elizabeth Gregory Thornton, Mary Thornton and Dorothea Thornton L500 each in specie; to daugher Francs Buckner a mourning ring; daughter Mildred Washington Maury L100 in specie.

13 April 1767. Bernard Moore of King William County, Esqr., only acting executor of the will of John Spotswood, Esqr., and guardian of his son Alexander Spotswood, with the consent and approbation of Edmund Pendleton and Roger Dixon, Gent., to Francis Thornton Gent. of Spotsylvania County. For £166.15.3 current money. By Act of Assembly passed by George III instituted an Act to direct the sale of certain intailed lands whereof John Spotswood, Esqr., died seized for payment of the debts due from him and the estate of Majr. General Alexander Spotswood, it is enacted that Bernard Moore or the acting executors of the will of John Spotswood or the guardian for the time being of Alexander Spotswood the son should be impowered with the consent and approbation of John Robinson Esqr., Edmund Pendleton, Roger Dixon and John Campbell, Gent., to sell so much of the intailed lands whereof John Spotswood died seized (the mine tract excepted) so as that the whole of the money to be raised did not amount to more than £6000, and convey the land to the purchasers. 349 acres ... on Germana Road ... on the Rappanne River near Germana Ferry ... at the mouth of Tarr Branch ...

Thornton to Banks Indenture
This indenture made the fifth day of June 1769 between Francis Thornton of the County of Spotsylvania of the one part and Gerard Banks of the County of King George the other part. Witnesseth that Francis Thornton in consideration of 375 pounds current money of Virginia in hand has sold unto Gerard Banks all that tract of land now in the possession of the said Gerard Banks containing 349 acres lying in the County of Culpeper and known by the name of Fox Neck and bounded as followeth; beginning at a red oak standing on Germanna Road running thence South 55° East 88 pole to a forked birch on the Rapidan River near Germanna Ferry, thence up the said river the several meanders thereof to a poplar and two white oaks at the mouth of Tarr Branch, thence North 34° East 229 poles to the beginning; the same being a tract of land conveyed to the said Francis Thornton by Bernard Moore, Edmund Pendleton and Roger Dixon, gentlemen. In witness whereof the said Francis Thornton have hereunto set his hand and seal the day month and year above written.

At a court held for the County of Culpeper on Thursday the 15th day June 1769 this indenture bargain and sale from Francis Thornton and Ann Morton his wife to Gerard Banks was proved by the oath of Andrew Buchanan, William Underwood and John Walker, witnesses thereto which together with the commission of privy examination of the said Ann Orton and the certificate thereto is ordered to be recorded.

THIS INDENTURE made this Eighth day of April 1779 Betwen FRANCIS THORNTON and ANN his Wife of the County of SPOTSYLVANIA of the one part and SAMUEL PORTER of the County of FAUQUIER of the other part Witnesseth that said Francis Thornton and Ann his Wife for the sum six hundred pounds current money of Virginia have granted unto the said Samuel Porter his heirs land in the County of Culpeper on the Little Fork of Rappahannock River which was granted by the Honourable THOMAS LORD FAIR FAX unto the Reverend JOHN THOMPSON by Deed from the Proprietary Office dated the 28th of October 1749 and bounded by lines & courses in the said Deed and containing Eight hundred acres .

Greeting Whereas Francis Thornton and Ann Thornton his Wife have sold unto Samuel Porter land in Culpeper County and Whereas the said Ann cannot travil to our County Court to make acknowledgement of the same we do give you power to go to the said Ann and examine her apart from her husband whether she doth the same freely and when you have examined her that you Certifie us thereof in our Court. Witness JOHN JAMESON Clerk at the Courthouse this 16th day of November 1778.
In Obedience to the within We the Subscribers did go to Mrs. Ann Thornton & examined her privately & apart from her husband concerning the conveyance when she informed us that she acknowledged the same freely and was willing the same be recorded in the County Court of Culpeper. Given this 8th day of April 1779.

Augt. 8, 1787. Mary Champe of Culpeper County, of first part; Francis Thornton of Spots. County, of second part; Churchill Jones of Orange County, of third part. Whereas, the sd. Mary is possessed of a large fee simple estate, as devisee of her late husband, Wm. Champe, as by his will recd. in Culpeper Co. will appear, and whereas, there is a marriage intended to be solemnized between the sd. Mary and the sd. Churchill Jones, and whereas, it is agreed between the sd. Churchill and Mary, that if the sd. marriage shall take effect then they are to hold and enjoy the sd. estate during their joint lives, and that it shall be lawful for the sd. Mary to dispose of any part of the sd. property, should she so desire by either deed or will, this Ind. therefore witnesseth, that the sd. Mary, with the consent of the sd. Churchill Jones, doth convey to the afsd. Francis Thornton, all the sd. property devised her by the will of her late husband, in trust for the sd. Mary, before the afsd. intended marriage and after the sd. marriage for the sd. Churchill Jones and the sd. Mary, as under the contract alluded to above, etc., etc., etc. Witnesses, G. Gray, Wm. Thompson, Sam Stephens. Augt. 8, 1787.
