      Richard Lee of Lee Hall Will
      In the name of God Amen, I Richard Lee of Lee Hall in the Parish of Cople in County of Westmoreland, Esq. being now in perfect health and strength the body and mind do declare this to be my last will and testament.
      Item I give and bequeath to my son Richard Lee and his heirs forever all my estate real and personal in possession or reversion subject to the legacies hereafter mentioned and I desire that he may have the best education that the estate I have given him will afford.
      Item I give and bequeath to my wife Sally Lee 50 pounds a year for four years after my death to be paid her annually besides her dower.
      Item I give and devise my lands in Hampshire County and Berkeley County to my executors in trust to be sold for the payment of my debts.
      Item I give to my daughter [unnamed] who is not christened and was born the 12th day of February 1790, £1000 money of Great Britain to be paid to her when she arrives at the age of 21 years or day of marriage, and £40 a year for her maintenance and education until she arrives to the age of 21 years or day of marriage.
      Item I give to Mrs. Mary Graham of my niece 100 pounds current money.
      Item I give to each of my nephews and nieces a mourning ring of 20 shillings Sterling value.
      Item I desire my estate may be kept together for four years after my decease and that the profits may be applied to the discharge of my debts and legacies, and I desire and and empower my executors to sell any part of my personal state and such of the slaves as they think necessary for the payment of my debts.
      Item I give to William Watts a suit of clothes, shoes, stockings, and shirt to the value of £10.
      I desire and ordered that the minister of the Church of England that is the incumbent of Cople Parish be paid 5 pounds sterling a year out of my estate until my son Richard Lee arrives to the age of 21 years and in case my said son should die before that time that the above legacy to be continued like he would have arrived of lawful age.
      Lastly, I do constitute and appoint my nephew Charles Lee, Esq., Richard Bland Lee, Esq., and my two friends Fleet Cox the elder and Fleet Cox, junior, executors of this my last will and testament and guardians to my children. In witness whereof I have hereunto set my hand and seal the 16th day of February 1790.

      At a court held for Westmoreland County the 23rd day of March 1795 this will was presented to the court in allowed to be the proper hand writing of the testator and the same is therefore ordered to be recorded; Fleet Cox one of the executors therein named having refused taking upon himself the burden of the execution thereof.

      THIS INDENTURE TRIPARTITE made the 29th day of June in the year of our Lord one thousand seven hundred and Sixty three and in the third year of the reign of KING GEORGE the third Between BENJAMIN WILKINSON and ELIZABETH his Wife of the Parish of Dittengen and County of Prince William (Sailer) of the first part, BERTRAND EWELL of the same Parish & County Gentleman of the second part and HENRY LEE of the same Parish & County Esqr, of the third part. Whereas Pursuant to an Act of the General Assembly of this Colony Intitled an Act Concerning Water Mills, the said BENJAMIN WILKINSON having lands on POWELLS RUNN in the Parish and County aforesaid and being minded to build a Mill there, did on or about the year One thousand seven hundred and Forty Eight Petition the County Court of Prince William for an acre of the contiguous lands on the opposite side of the said RUNN which were then in the possession of said HENRY LEE then a Minor, the fee Simple Estate being also in the said HENRY LEE, which said acre of land was by a jury of the Vicinage valued to one pounds one shillings & six pence Current money which said acre on paiment of the money was by the said Act of Assembly vested in BENJAMIN WILKINSON in Fee for the uses aforesaid reference to the records of the County Court of Prince William may appear, And Whereas soon after the obtaining the said Order of Court for building of a Mill on the said Run the said BENJAMIN WILKINSON and BERTRAND EWELL entered into an agreement conerning the Erecting and Building of the same Mill which agreement was that said BENJAMIN WILKINSON should pay unto the said BERTRAND EWELL Thirty five pounds Current money, and also the said BERTRAND EWELL to enjoy jointly with the said WILKINSON full moiety or half part of the yearly rents and profits of the said Mill when Built forever as a full compensation & Satisfaction for building and compleatly finishing the same Mill in a Workmanlike manner at the sole costs & Expence of the said BERTRAND EWELL , which he in fact did pursuant to the Agreement, and Whereas a short time after and before the said Mill was compleated but at the same time the said BERTRAND EWELL had actually workmen employed in and about building the same Mill, the Guardian of the said HENRY LEE (who was then and at that time a Minor) Sued his Majestys Writ Supersedeas out of the General Court of this Colony in order to annul the Orders & Proceedings on the said Petition of the said BENJAMIN WILKINSON had by the Court and also in the name of the said HENRY LEE prosecuted an Action of Trespass against BENJAMIN WILKINSON in said General Court in which Action said HENRY LEE recovered Damages against BENJAMIN WILKINSON and his Costs, and Whereas while the last mentioned Action was Pending and before there was any determination had thereon the Supersedeas being discontinued the said BERTRAND EWELL entered into an Agreement with RICHARD LEE of WESTMORELAND COUNTY Esqr. on behalf of said HENRY LEE (his Brother) being then under the age of Twenty one years by which Agreement said HENRY LEE when he came to full age was to pay the said BERTRAND EWELL for his Moiety of the said Mill Thirty five pounds and if said HENRY LEE then chose the other moiety of the said Mill which belonged to the said BENJAMIN he engaged and obliged himself that said BENJAMIN would convey the fee simple Estate in the whole Mill to said HENRY LEE on his paying said BERTRAND EWELL the further sum of Thirty five pounds of the like money and five barrels of Indian Corn which said last mentioned half or moiety the said EWELL alledged he had agreed with the said WILKINSON for and had a right to dispose of the whole Mill together with the contiguous lands on the Southern side of the said Run belonging to the said WILKINSON the said BERTRAND EWELL obliging himself by the last mentioned Agreement to have the Mill compleately finished in a Workmanlike manner by a certain day in the Articles stipulated and agreed on then to be delivered to the said HENRY LEE his heirs and assigns on the conditions above mentioned which said Articles of Agreement were mislaid or lost which have created or
      given rise to endless disputes and controversies Between the said BENJAMIN WILKINSON. BERTRAND EWELL, RICHARD LEE and HENRY III. and Whereas there is now a Suit in Chancery in the said General Court brought by said BERTRAND EWELL Complainant against RICHARD LEE, HENRY LEE and BENJAMIN WILKINSON Defendants which is still undetermined and whereas the parties being willing to make up and adjust all matters in dispute or hereafter may arise concerning the said Mill said BERTRAND EWELL hereby agreeing to dismiss his said Suit in Chancery for the sum of Seventy pounds paid by HENRY LEE he the said BERTRAND EWELL doth hereby discharge said HENRY LEE being a full compensation for the title the said BERTRAND EWELL has under the Agreement made between RICHARD LEE on behalf of said HENRY LEE, and the said BERTRAND EWELL. who doth hereby release all actions against said RICHARD LEE, HENRY LEE & BENJAMIN WILKINSON and Whereas said BERTRAND EWELL having paid the whole consideration of Thirty five pounds Current money to the said BENJAMIN WILKINSON for his half part of the said Mill and also five barrels of Indian Corn but said BENJAMIN WILKINSON never having conveyed the Fee Simple Estate to said BERTRAND EWELL or made him any legal Title which nevertheless said BENJAMIN WILKINSON was willing to do and doth hereby discharge the said BERTRAND EWELL from And Whereas said BERTRAND EWELL being willing that the Agreement made with RICHARD LEE for said HENRY LEE may be carried into Execution the said HENRY LEE now having passed the age of twenty one years & chusing to purchase the whole Mill together with the contiguous lands on the Southwest side of POWELLS RUN in possession of BENJAMIN WILKINSON
      Now This Indenture Witnesseth that for the sum of Five shillings Current money to the said BENJAMIN WILKINSON paid by said HENRY LEE and for the sum of Twenty pounds of like money and five barrels of Indian Corn paid to the said BERTRAND EWELL with the mutual consents of said BENJAMIN WILKINSON and BERTRAND EWELL the said BENJAMIN WILKINSON have sold unto said HENRY LEE and his heirs so far as each of them Both have a right to do, all that parcel of land containing Three acres in the Parish of Dettengin & County of Prince William on the Southwest side of a Yew tree and Chesnut Oak standing on the South side of POWELLS RUN on the bank of the Main Run and extending from thence South West along a marked line to a Corner red Oak standing on the edge of the Hill from thence South East a strait Course extended to the said Run and from thence up the same Run the several Courses to the beginning Including all the low ground there below the Hills and also the Mill formerly built by BERTRAND EWELL, Together with all the right they the said BENJAMIN WILKINSON and his Wife and the said BERTRAND EWELL and their heirs or assigns claim to the said Mill and all houses and appurtenances whatsoever free and exempt from suffereing any charges or Damages by means thereof by Overflowing or drowning of any of the Adjacent lands or low grounds of the said BENJAMIN WILKINSON and BERTRAND EWELL by raising a Dam or ponding of the Waters for the use of the said Mill with Free Ingress Egress and

      Allerton to Lee Indenture
      This indenture made the seventh day of February 1764, Ann Allerton the parish of Cople in County of Westmoreland of the one part and Richard Lee of the said parish and county, Esq. of the other part. Whereas on the death of James Steptoe, late of the said County of Westmoreland, Gent., Deceased, the tract of land whereon he live known by the name of Nominy Hall descended to the said Ann Allerton and her sister Elizabeth Steptoe (who has since intermarried with the Hon. Philip Ludwell Lee, Esq.) the daughters of James Steptoe by Mary Steptoe his wife in fee simple as coheirs of the said Mary who died before the said James Steptoe and whereas the said and Allerton after the death of her father intermarried with Willoughby Allerton, late of the said County, Gent., deceased will in his lifetime with the said Ann Allerton brought a suit in Chancery in the County Court of Westmoreland against Elizabeth Steptoe in order to have a division of the said tract of land and it was ordered by the said court on the 27th day of June 1758 with the consent of parties that Richard Jackson, Daniel Tebbs and John Crabb should divide the said land between the parties having regard to quantity and quality; in obedience to which order they on the 22nd day of July 1758 did divide the same agreeable to a plot thereof to their report the next by which it appears they allotted to the said Ann Allerton 77 acres 2 rods and 32 perches of land next to the river including the dwelling house and bounded by a line run parallel with the river that divides the tract from Critcher’s land to Marsh Gutt which course is North 45° West and runs 184 poles, and to the said Elizabeth Steptoe they allotted the remainder of the said tract or parcel of land containing 204 acres and 13 perches which said report together with the plot aforesaid was afterwards returned to the County Court of Westmoreland and at a Court held for the said County the 25th day of July in the year last mentioned. Now this indenture witness that and Allerton in consideration of 155 pounds current money of Virginia as sole to Richard Lee all that said dividend of land containing 77 acres, 2 rods and 32 perches. In witness the parties to these presents have hereunto set their hands and seals the day and year first above written.

      Lee to Garner Indenture
      This indenture made the 7th day of January 1764 between Richard Lee of the parish of Cople in the County of Westmoreland, Esq. of the one part and Bradley Garner of the said parish and county, planter of the other part. Witnessed that the said Richard Lee in consideration of 259 pounds 5 shillings sterling money of Great Britain has sold a tract of land which the said Richard Lee purchased of Abraham Garner, deceased by indenture of bargain and sale bearing date the 21st day of February in the first year of the reign of our Sovereign Lord King George III containing by estimation 234 acres in witness whereof the parties to these presents have hereunto set their hands and seals the day and year first above written.

      Mary Lee's Will
      In the name of God Amen, I Mary Lee of Lee Hall in the parish of Cople in County of Westmoreland, widow being of perfect sense and memory do make and ordain this to be my last will and testament in manner and form following.
      Item I give and bequeath my beloved daughter Lettice Ball all my wearing apparel, books can whatever things of mine that may be in the house at the time of my death excepting the legacies hereafter mentioned.
      Item I give and bequeath unto my dear son Richard Lee my chariot and horses and all my stocks upon his paying to my granddaughter Mary Ball 100 pounds current money of Virginia to be put out at Interest on good security until my said granddaughter arrives at the age of 21 years or is married when she is to have the whole principal and interest.
      Item I give and bequeath unto my daughter Lettice Ball all the money that my son Richard Lee may owe me at the time of my decease after deducting the price of the mourning rings hereafter mentioned and paying all my just debts which said money I order to be paid to my said daughter as soon as possible after my decease.
      Item I give to each of my children John Lee, Richard Lee, Lettice Ball and Henry Lee and my daughters in law Mary Lee and Lucy Lee and my granddaughter Mary Ball a mourning ring of a guinea value.
      Item I given to my son John Lee my wedding ring.
      Item I give unto my granddaughter Mary Ball my old mourning ring, my Bible and common prayer book.
      Item I lend unto my said daughter Lettice Ball during her natural life to use them on whatever manner she thinks proper without paying any compensation for such use to any person whatsoever the following slaves; Phillis and her children, James, Abraham, John and girl Anne, Barshaba, Betty and her child Judy and their issue and increase together with all the rest and residue of my estate both real and personal not before given and after the death of my said daughter I give and bequeath unto my granddaughter Mary Ball and her heirs forever the following slaves; Phillis and her children, James, Abraham, John and girl Anne, and Barshaba with all their issues and increase provided the said Mary Ball shall marry with the consent of her mother Lettice Ball but if she should not marry with such consent then I give all the Negroes and their increase in all the rest of my estate to my grandsons William Ball and Henry Lee Ball in such parts and proportions as my daughter Lettice Ball shall direct by her last will and testament in writing or deed executed in her lifetime before two credible witnesses and if my said daughter should fail to make such will or deed then to be equally divided between the said William Ball and Henry Lee Ball after the decease of my said daughter.
      Item after the decease of my said daughter Lettice Ball I give and bequeath to my two grandsons William Ball and Henry Lee Ball and their heirs forever the following slaves; Betty and her daughter Judy and all their issue and increase to be divided between or wholly given to either of my said grandsons William Ball and Henry Lee Ball as my said daughter Lettice Ball shall direct by her last will and testament in writing or deed executed and her lifetime before two credible witnesses and if my said daughter should failed to make such will or deed then to be equally divided between the said William Ball and Henry Lee Ball.

      At a court held for Westmoreland County the 29th day of May 1764 this last will and testament of Mary Lee, deceased was proved according to law by the oath of Joseph Lane a witness thereto and ordered to be recorded; and on the motion of Richard Lee, Esq. the executors named in the said will who made oath according to law and together with Gerard Hutt, Sr., his security entered into and acknowledged bond with conditioned as the law directs, certificate is granted him for obtaining a probate thereof in due form.

      Pendleton & Wife to Lee
      This indenture made the 19th day of April 1770 between Philip Pendleton and Martha Pendleton his wife of the Parish of St. Mark in the County of Culpeper of the one part and Richard Lee, Esq. of Cople Parish in the County of Westmoreland of the other part. Witnesseth that Philip Pendleton and Martha Pendleton his wife in consideration of 300 pounds current money of Virginia has sold to Richard Lee all that tract of land lying in Machodoc Neck in the parish of Cople in County of Westmoreland containing by estimation 200 acres adjoining to the lines of the land of William Carr Tidwell, the said Richard Lee, the heirs of William Callis, deceased, and Mary Kenner and Elizabeth Kenner, infants which said land was given by Chandler Awbrey, deceased to his son James Sorrell Awbrey who died in infant under the age of 21 years without lawful issue and then the same became vested in the said Martha Awbrey who intermarried with the said Philip Pendleton party to these presents as will appear by the last will and testament of Chandler Awbrey bearing date the ninth day of December 1755, in the following words to with, “Item I give and bequeath all my lands to my son James Sorrell Awbrey and his heirs forever but if my said son should die before he arrives at the age of 21 years without issue of his body lawfully begotten, then I give my land and plantation whereon I now live to my daughter Elizabeth Awbrey and her heirs forever; and I give my other tract of land on Machodoc River to my daughter Martha Awbrey and her heirs forever”. In witness whereof the parties first above mentioned to these presents have interchangeably set their hands and seals the day and year first above written.

Whereas Philip Pendleton and Martha Pendleton his wife by their indenture of feoffment bearing date the 19th day of April 1770 have sold unto Richard Lee, Esq. the fee simple estate of 200 acres of land lying in the parish of Cople and County of Westmoreland and whereas the said Martha Pendleton cannot conveniently travel to our court to make acknowledgment. Therefore, we do give unto you or any two of you power to receive the acknowledgment which the said Martha Pendleton shall be willing to make before you. Witness, James Davenport, clerk of our said court at the courthouse the 20th day of April.
      Culpeper County Sct. By virtue of the within written to us directed we did personally go to the said Martha Pendleton wife of the within named Philip Pendleton and before us she did acknowledge the indenture hereunto annexed to be her act and deed and that she did the same freely and voluntarily and was willing that the same should be recorded in the County Court of Westmoreland. All which we certified to our Lord the King in his said court under order of our hands and seals this 24th day of April 1770.

      Lee to Atwell Indenture
      this indenture made this 18th day of November 1771 between Richard Lee, Esq. of the one part and Thomas Atwell, planter of the other part. Witnesseth that the said Richard Lee in consideration of the rents and covenants herein after reserved has demised and to farm let unto the said Thomas Atwell the tenement of land in the tenure and occupation of the said Richard Lee lying in the County of Westmoreland and Parish of Cople commonly called and known by the name of Murphy’s which said land Richard Lee purchased of John Murphy. To have and to hold the said tenement of 200 acres of land unto Thomas Atwell from the day of the date hereof for and during the natural lives of him the said Thomas Atwell and his son Thomas Atwell and the longest liver of them yielding and paying unto the said Richard Lee yearly and every year the rent of 2000 pounds of crop tobacco and cask, also the quit rents and any taxes that may be upon the land. And the said Thomas Atwell agrees with the said Richard Lee that he will leave standing in some convenient part of the above premises one body at least 50 acres of woods untouched which which shall remain and be held as a future support of the plantation and further agrees within the space of one year built on some convenient part of the land a dwelling house 20’ x 16’, a 40 foot tobacco house or corn house or other houses and buildings equal thereto and also within the space of one year plant 100 winter apple trees at 30 feet distance every way from each other and 200 peach trees at 70 feet distance each way. In witness whereof the said parties have hereunto interchangeably set their hands and fixed their seals the day month and year first above written.

      Know all men by these presents that I Richard Lee of the County of Westmoreland, Gent., In consideration of £100 money of the Kingdom of Great Britain has sold to Moore Fauntleroy of the said county, two girl slaves; Fanny about four years of age and Florinda about two years of age, both the children of a slave belonging to the said Richard Lee named Barbary. In witness whereof I have hereunto set my seal and subscribe my name this 28th day of July 1785.

      Lee & Wife to Crabb Indenture
      This indenture made the 8th day of July 1791 between Richard Lee of the Parish of Cople and County of Westmorland, Gent and Sally Lee his wife of the one part and John Crabb, Jr., of the said Parish of Cople and County of Westmoreland of the other part. Witnesseth that Richard Lee and Sally Lee his wife in consideration of 2 pounds current money of Virginia in hand hath sold to John Crabb, Sr., a lot of land in the Parish of Cople and County of Westmoreland in the fork of the road cuming from Nominy Ferry to Yeocomico and to Coles Point and bounded as followeth; Beginning at a white oak standing on the east side of the Road leading to Coles Point, standing in the line of the land which the said John Crabb purchased of James Crump, merchant, which he purchased of George Fairfax Lee, Gent from from thence running up the said road South 66 ½° East 12 8/10 poles to a stake in the fork of the road, from thence South 71° East 14 poles to a stake on the side of the road going to Yeocomico Church near to a forked white oak, from thence North 19° East 9 poles to a stake in the line of the said John Crabb, from thence along the said Crabb’s line North 71 ½° West 4 4/10 poles to the beginning white oak containing ½ acre of land and all appurtenances belonging. In witness whereof the parties to these presents have hereunto set their hands and seals the day and year frirs above written.
