      Nov 11, 1748 from Henry Key, late of CC but now of Augusta County, Virginia, planter, to Benjamin Reader of CC, planter, for 30 £paper currency & 20 £current gold, and for divers other good causes, a tract of land in CC called Drury Lane, formerly laid out for Gerrard Brown, bounded by Pointen Mannar, the land formerly laid out for James Lynsey, containing and laid out for about 100 acres, excepting 6 acres already conveyed by sd Henry Key unto John Stone. The following depositions and proofs were lodged with the CC Clerk, to be recorded pursuant to the directions of an Act of Assembly passed in 1779 and entitled, an Act to establish a mode to perpetuate testimony.
      William Smallwood of CC, wanting to perpetuate the testimony of sundry witnesses respecting the title of the following tracts of land called Allansons Folly and Saint Davids, for which actions of ejectment have been brought and are now depending in the General Court of Maryland between Thomas Rookwoods, lessee, plaintiff, and John Brawner and William Jones, tenants of sd William Smallwood, gave the following notice to William Cooke of Annapolis, the Atty at Law for sd Thomas Rookwood, he, sd Rookwood, being absent and residing out of the State of Maryland - to wit

      On Jun 3, 1789, William Smallwood attended at the dwelling house of Thomas Shuttleworth Posey, when and where the following deposition was taken before Daniel Jenifer, one of the CC JPs, who then and there attended for the purpose, in consequence of the indisposition of Richard Barnes, who had attended on the preceding day, and on this present day, until he was so much indisposed at Adam clinkscale's that he could proceed no further. signed - Dan Jenifer*.
      No. 7. The deposition of Thomas Shuttleworth Posey, aged about 74 or 75, says that he has often heard his father and mother talk of Edward Rookwood and his 1st wife, who, they informed him, was sister to this Deponent's mother, that Edward Rookwood never had but 1 child by his sd 1st wife, and that his name was Thomas Rookwood, whom this Deponent well knew, and was generally informed by his father and mother and others that after the death of Edward Rookwood, his sd son, Thomas, heired and entered into possession of all his father's estate, both real and personal, and that he resided on the tract of land called Allansons Folly, and that he rented another tract, called saint Davids, to Edward Maddox, and this Deponent well remembers Thomas Rookwood, and that he died seised of these 2 tracts of land and several others he thinks called Preston Found Hills and Hard Frost, leaving 2 daughters, 1 of whom died young, and the other married Mr, Henry Moore, by whom she had a daughter who died young, that he always heard and believes, the land afd became escheatable upon her death and that the sd Henry Moore did escheat them, and some years afterwards, sold the tract called Allansons Folly to Mr. Bayne Smallwood, from whom it descended to his heir at law, William Smallwood, the present Defendant, and this Deponent further says that he has often understood and heard his father and mother and others say that some years after the death of Edward Rookwood's 1st wife, that Edward Rookwood married another woman, who ran away to Virginia with a man, by name Goslin, with whom she lived some years and had several children, and this Deponent well remembers that he has often heard his father and mother say that William Rookwood was the son of the abovesd 2nd wife of Edward Rookwood, and that the sd child was generally reputed and thought to be the son of sd Goslin and was then more commonly called William Goslin than William Rookwood- This Deponent says that his father and mother always lived in the neighborhood within 3 miles or 3 miles of the afd tract of land called Allansons Folly, that both his father and mother lived to be very old, that his mother's maiden name was Lydia Shuttleworthr that she first married Richard Robins, by whom she had 2 daughters; the elder married Benjamin Reeder, and the younger, Francis Dunnington, who died this year, about 90 years old.       The deposition of Daniel Jenifer, of lawful age, says that when he took Thomas Shuttleworth Posey's deposition, he found him confined to his bed by an inflammation in his foot and leg from a hurt he had received, and was so swollen, that the only way he could have attended at Chickamuxon warehouse, would have been to have been carried in a litter.
