      THIS INDENTURE made the twenty fifth day of July in the Seventh year of the Reign of our Sovereign Lord George the Second of Great Brittain France and Ireland, King, Defender of the faith &c., And in the year of our Lord God one thousand seven hundred and thirty three; Between WILLIAM RUSH of Washington Parish Westmorland Coty: & Colony of Virginia, Planter, of one part and DAVID STUART of St. Pauls Pish: STAFFORD Coty: Colony aforesd. Clerk, of other part; Witnesseth that WILLIAM RUSH in consideration of the sum of five shillings of good and lawful! money of Great Brittain to him in hand paid by DAVID STURAT, the receipt whereof he doth hereby acknowledge, hath and by these presents doth bargain and sell lease and to farm lett unto DAVID STUART his assignes one certain plantation or parcell of land containing One hundred acres more or less now in the tenure & occupation of said WILLIAM RUSH and scituate in Washington Parish & Coty: of Westmorland, bounded with the Horse Roade that comes out of the Forrest to BERRYMANS MILL South East included with the lines of ELIONAS SHARP, the Widow ( ) (HOWSON ( ) and JOHN SHARP, it being part of a great tract of land consisting of five thousand and two hundred acres formerly granted to GERVAS DODSON by Patent bearing date September the sixteenth day in the year of our Lord God one thousand six hundred and fifty seven, and afterwards escheated for want of heirs or any other legal disposition thereof from him and granted to ANDREW PEDIGREW and by him sold to ROBERT HOWSON and by sd. HOWSON most of sd. tract was sold in parcells to sundry persons of which the hundred acres more or less as above bounded was sold by sd. HOWSON to WILLIAM RUSH the Grandfather of the above mentioned Grantor and Lessor & granted by Deed of Gift to WILLIAM RUSH, his Son, the Father of the above Grantor as by Deed bearing date the twenty second day of July in the year of our Lord God one thousand six hundred and eighty nine; And now descends by inheritance to WILLIAM RUSH the Grantor hereof and Grandson to the above mentioned WILLIAM RUSH the first purchaser thereof; the which tract was repatented and granted to WM: RUSH the first purchaser the tenth day of January in the year of our Lord God one thousand seven hundred and four, with all houses orchards together with the royalties of hunting hawking fishing and fowling and the due share of all mines and quarries and all other priviledges profits and appurtenances belonging; To have and to hold the demises premises with appurtenances unto DAVID STUART his assigns during the term of one year paying therefore yearly on the Sixth day of December to WILLIAM RUSH or assigns one grain of Indian Corn if lawfully demanded to the intent that by vertue of these presents and of the Statute for transferring uses into possession DAVID STUART may be in actual possession of the premises and thereby the better enabled to accept a Release of the inheritance thereof; In Witness whereof the said WILLIAM RUSH hath hereunto sett his hand and seal the day and year above written

      Reference: Everett Spitzner providing that the following applies to William Rush III: "He was born before 1687. He was a minor in 1708 when his father, William Rush II's, estate was settled. 100 acres of land was granted to William Rush III in Spotsylvania County, Virginia on May 11, 1726. In 1734, that county became Orange County. William Rush III died in Orange County in 1735. His estate, administered by widow, Mary Rush, did not list any in the estate record; however, his sons were William, Crawford, Absolem and Benjamin (the name James was apparently handwritten in front of the name Benjamin on certain records, as well)."

Lease of 100 acres, part of 400 acres granted to William Rush by pattent; William Rush dying without will and his son William dying without heirs of his body the land descended to Benjamin Rush as the next heir to William Rush the Elder ... bounded by the lines of Mr. Anthony Strother and Majr. Philip Rootes on one side ... down a branch ... on another branch at the ford ... For the lives of John Thomas- and. Betty his wife.- Yearly rent on 1 January 475 pounds of tobacco. John Thomas shall not keep in constant working on the land any more than three tithables besides himself.
