      IN THE NAME OF GOD, Amen, I HENRY LEE of the Parish of Cople in County of Westmorland, Gent., being sick and weak of body but of perfect sense and memory, do make this my Last Will and Testament. First and principally I recommend my Soul to Almighty God and my body to the earth to be decently bury'd, there to rest in hopes of a joyful ressurection and union with my Soul at the last day through the merits and mediation of our blessed Mediator and Redeemer, Jesus Christ, And for what worldly Estate which it hath pleased God to bestow on me, I give and dispose of the same in manner and form following -
      Imprimis. I do order that all my just Debts which I do owe be first paid out of my Estate. And Whereas I have a suit at Law with Mr. JOHN CRAWLEY of NORTHUMBERLAND County for my Lands in the said County, which I purchased from the heir of THOMAS MATTHEWS, deced., as by Deeds from WESTARD and LESSINGHAM, assignees of the said MATTHEWS may fully and at large appear. It is my will intention and desire that the said suit be continued and if occasion that other suits be brought agst. the said CRAWLEY for to obtain the sd. Lands which he unjustly detains from me, that the charges be born and defrayed out of my whole Estate.
      It is my will and desire that my Estate be only Inventory'd and not to be appraised, And it is also my will and desire that my Estate be kept whole and intire for three years after my decease before any Division or any part be taken by any to whom it is bequeathed.
      I give and bequeath to my Son, JOHN, and to his heirs for ever, the several Plantations and Tracts of Land in MACHOTIQUE NECK that I now mention, vizt., the lands called KING COPSES on POTOMACK RIVER which I bought of JOHN WRIGHT and of WILLIAM CHANDLOR and DELIVERANCE his Wife, and of SUSANNA APPLEYARDand the Land and Plantation I bought of Coll. HENRY FITZHUGH and all the several Tracts and parcels of land I bought of SAMUEL ATTWELL, as by the several Deeds will more plainly and at large appear.
      I give and bequeath to my Son, JOHN, and to his heirs, one hundred acres or more of Land in MACHOTIQUE NECK as contained in a Lease from the late DANIEL McCARTY, Gent., deced., to FRANCIS ATTWELL, which I purchased of the said FRANCIS ATTWELL
      I give and bequeath to my Son, JOHN, and to his heirs forever, Eighteen slaves, vizt., Old Will, Absalom, Solomon, Ceaser, Peter, Howels, Jack, Toney, Sue, Sue's Sarah, Sue's Letty, Sue's Winney, Lucy, Davey, Joe, Siss and Cyruss
      (note: only 17 are named); now are on the aforesaid lands, And from my Dwelling Plantation, Ben and Winney's Nan; And after my Wife's death, I give to my Son, JOHN, and to his heirs forever two more slaves, vizt., Old Betty & Cupid. I give to my Son, JOHN, a Servant man called Smith.
      I give and bequeath to my Son, RICHARD, and to his heirs forever, all the lands plantations and houses where I now live being all the lands given and bequeathed to me by my honoured Father, Coll. RICHARD LEE, deced., as by his Last Will and Testament will more plainly appear, and all the several Plantations and tracts of land which I hae at sundry times bought of JOSEPH CHANDLOR, JOHN CHANDLOR, FRANCIS CHANDLOR, JOHN BYARD, JAMES BYARD, WILLIAM OXFORD and FRANCIS his Wife by the several Deeds will more plainly appear; And also One hundred and one acres of land more or less in MACHOTIQUE NECK, which I bought of RICHARD KENNER,
      I give and bequeath to my Son, RICHARD, and to his heirs forever, all my Lands and Plantations in NORTHUMBERLAND County which I bought of the Heir of THOMAS MATTHEWS, deced., as by Deeds from WESTARD and LESSINGHAM, Assignees of the said MATTHEWS may more fully appear. I give and bequeath to my Son, RICHARD, and to his heirs forever, One acre and a half of land at the TURKS SWAMP which I bought of Capt. RICHARD BUSHROD with design there to build a Mill My Will and desire is that a Mill be there built at the charge of my Estate which Mill I give to my Son, RICHARD, and to his heirs forever.
      I give and bequeath to my Son, RICHARD, and to his heirs forever, fifteen slaves now at my dwelling Plantation, vizt., London, Boatswain, Little Will, Old Phil, Prue's Tom, Prue's Sam, Frank, Nugent, Dick, Natt, Little Betty, Eave, Patty, Belinda, her Child Marear, and Old George. (sixteen named) And after my Wife's death, I give and bequeath to my Son, RICHARD, and to his heirs forever, thirteen more slaves at my Dwelling Plantation, vizt, Jack, Harry, Black Sarah, Phillis, Tom, Daniel, Little Phill, Little Sarah, Prue, Prue's George, Beck, young Prue and Nell.
      I give and bequeath to my Son, RICHARD, three men Servants, vizt., the Shoemaker, the Piper and a Servant named Cook.
      I give and bequeath all my stock of Cattle, Hoggs. Sheep and Horses which are at my River Side Quarters, unto my two Sons, JOHN and RICHARD, to be equally divided between them.
      I give and bequeath to my Son, HENRY, and to his heirs forever, all my Plantations and Lands in PRINCE WILLIAM County which I have FREE STONE POINT and at NEAPSCO and POWELS CREEK, which was granted by Patent to GERVAS DODSON for Two thousand acres, and by my Grand Father, HENRY CORBIN, Gent., given to his Daughter, LETTICE, who was my Mother, and afterwards descended to my Brother, Mr. RICHARD LEE as Heir at Law to her, and by my said Brother given to me as by Deeds recorded in STAFFORD County may more fully appear; And whereas I sold to JOHN WRIGHT one thousand acres, a part of the said Land, and since have purchased the same again, vizt. 666 1/2 acres of FRANCIS WRIGHT, Son of the aforesaid JOHN and 333 112 acres of Mr. BENJAMIN GRAYSON to whom the said FRANCIS had sold, whereby I am now invested with the whole Two thousand acres of land in fee simple as aforesaid given and bequeathed to my Son, HENRY, and to his heirs forever.
      I give and bequeath to my Son, HENRY, and to his heirs forever, three thousand one hundred and eleven acres of land and Plantations thereon in FAIRFAX County at or near SALSBURY PLAIN and FLAT LICK as by a Proprietors Deed for the Land may more plainly appear. Also the land I bought of JAMES WALKER for Three hundred acres more or less adjoining to the last mentioned Land in the County of FAIRFAX I give and bequeath to my Son, HENRY, and to his heirs forever, twenty slaves vizt. Tom, Dinah, Hannah, Moll, Daniel, Frank, Little Dinah, Dick and Cato, now at NEAPSCO QUARTER and Titus, Cain, Westminster, Eave, Harry, Joe, Sabina, her Children Joe & Henny now at SALSBERRY PLAIN QUARTER, and at my Dwelling Plantation Prue's Frank & Winney's Moll. I give and bequeath to my Son, HENRY, and to his heirs, all my Stocks of Cattle and Hoggs and all my personal Estate which I have in the said County of PRINCE WILLIAM and in the said County of FAIRFAX, excepting Debts due to me, which are to come into my Estate. My will and desires is that my Son, HENRY, be continued at the College two years from the date hereof and afterwards to be a Writer in the Secretarys Office till he be twenty one years of age.
      I give and bequeath to my Daughter, LETTICE, and to her heirs, Seven hundred pounds Sterling to be paid her as soon and as conveniently as my Estate can do it after she attain to the age of twenty one years or day of her marriage which shall first happen. I give and bequeath to my said Daughter two slaves named Letty and Peg and their increase to my said Daughter and to her heirs forever. I give to my said Daughter a Chest of Drawers made of Oak as is now called her Chest of Drawers and a new Chest of Drawers made of Mahogony.
      I lend to my beloved Wife, MARY, in full consideration of her Dower, thirds or Childs part of my Estate both real and personal and for no other intent whatsoever as I hereafter mention in every particular vizt.,
      I lend to my said Wife the use of my Dwelling Plantation and the use of my Dwelling House, out houses, garden, orchards and all other appurtenances to the same belonging; And land adjoining making in the whole Six hundred acres during her life. Also
      I lend to my said Wife the use of my Land at KINGCOPSCO in MACHOTIQUE NECK during her life I bought of WILLIAM CHANDLOR & DELIVERANCE his Wife and of SUSANNAH APPLEYARD as by the Deeds will more plain appear, And my will and desire is that for the use of the said land and plantation at KING COPSCO, my Wife shall at all times, when occasion, have free liberty on any of my Land next adjacent to have Timber for fraiming, rafters, posts, studs, ceels, boards, tobo: sticks, fenceing and fire wood or for any other necessary use for the service of the said Plantation. I also lend to my said Wife the use of fifteen slaves during her life, vizt., Jack, Harry, Black Sarah, Phillis, Tom, Daniel, Little Phill, Sarah, Prue, George, Beck, Young Prue and Nell who are now at my Dwelling Plantation, and Old Betty and Cupid, who are now at my River Side Quarter, And I lend to my Wife the use of all my Household furniture and utensils in the Kitchen, Dairy, Meat House and in all other houses and places belonging to my Dwelling Plantation, also the Chaise, the Chair, the Horses and Harness during her life, And I give to my Wife all my Stocks of Cattle, Hoggs and Sheep belonging to my Plantation where I live, and I give to my Wife three casks of the best Cyder from my Quarters at the River Side every year during her life;
      It is my will and desire tht at all times when my Wife has occasion for tobo. cask and Cyder cask that Frank, Nugent and Dick get the Timber and make the cask, and that they mend & repair all the Houses on my Dwelling Plantation, and they to do my other Coopers or Carpenters work for my Wife as she may have occasion and when she requires it, and that without any charge to her for the same
      After my Estate has paid all my Debts, and the Charges of my Suit or Suits with Mr. CRAWLEY, and paid my Daughter's fortune of Seven hundred pounds Sterling as aforementioned, and paid the charges of building a Mill for my Son, RICHARD, what tobo. and money shall then happen to remain belonging to my Estate,
      I give and bequeath the same to my Wife and three Sons to be equally divided between them, and after my Wife's death, I give and bequeath all my Household furniture and all other moveables and personal Estate whatsoever not already given or bequeathed, I give to my three Sons, JOHN, RICHARD and HENRY, to be equally divided between them.
      It is my desire that my Wife and three Sons do in the management of their Estate take advice of my two Brothers, the Honble: THOMAS LEE, Esqr., and Colo. WILLIAM BEVERLEY.
      My Will and desire is that my body have a private and decent Interment without any funeral sermon and the buryal service for me to be performed by the Parish Clark or some other fitt person.
      Lastly, I do hereby appoint my two Brothers, the Honble. THOMAS LEE, Esqr., and Colo. WILLIAM BEVERLEY, also my two Sons, JOHN LEE and RICHARD LEE, Executors of this my Last Will and Testament and hereby revoke and make void all former Wills heretofore made by me either by word or deed, and declare this to be my Last Will and Testament, and hereunto I set my hand and seal this Thirtyeth day of July in the year of our Lord one thousand seven hundred and forty six

      A Codicil. Westmorland July thirtieth day seventeen hundred and forty six. It is my Will that my Executors above named Lease to ADAM MITCHEL for his own and his Wife's life one hundred & fifty acres of land adjoining to the House in which he now lives, and likewise that one of his Children he pleases to put in, may hold the same for life, he or they or any of them paying yearly during the terms mentioned the sum of Six hundred & thirty pounds lawful too.

      LEE, Gent., three of the Executors therein named, who made Oath thereto, and being proved by the Oaths of JOHN WHEELER, JOHN BROADDUS and DANIEL JENINGS, three of the witnesses thereto, is admitted to Record, as also two endorsed Coddicils (vizt.) the first proved by the Oath of JOHN WHEELER a witness thereto as also that he saw the Reverd. DAVID CURRIE, the other witness thereto, subscribe as such, the second proved by the Oaths of RICHARD JACKSON and DANIEL JENINGS, two of the witnesses thereto, the said Codicils are likewise admitted to Record; And upon the motion of the said Executors and their performing what is usual in such cases, Certificate is granted them for obtaining a Probate thereof in due form; And Whereas there was Codicils made by the said Testator to this said Will at the MEDICINAL SPRINGS in FREDERICK County which was also presented by the Executors above said, But for that the witnesses thereto did not appear the said Codicils is ordered to be lodged in the Clks. Office in order the same may be proved at next Court.

      IN THE NAME OF GOD, Amen. I HENRY LEE of Westmorland County in Virginia and now at the WARMS SPRINGS in FREDERICK County, being sick and weak but in perfect sense and memory, thanks be to God for the same, do add this as a Codicil to a former Will by me made, which Will is still to stand absolute the two following clauses only excepted, to wit,
      Imprimis. It is my Will that the Carpenters which I have heretofore employed in building certain Houses for the use of my Son, JOHN LEE, that is to say, a Dwelling House, a Kitchen and an Office, shall be continued in such employment untill such time as the said Houses shall be compleated, the aforesaid Houses to be of the following dimensions: the Dwelling House thirty six feet by twenty four; the Kitchen eighteen feet by sixteen; and the office eighteen feet by sixteen.
      Item. That the Gift made in my former Will of a Negro woman named Pegg to my Daughter, LETTICE, Wife of WILLIAM BALL of LANCASTER County, Gentleman, be hereby revoked and made null, And I bequeath the said Negro Pegg with her increase unto my Son, JOHN LEE, and his heirs forever, he or they paying unto the aforesaid LETTICE BALL, or to her heirs, the sum of Fourty pounds current money. In Witness whereof I hereunto set my hand and affix my seale as a Codicil to my former Will, this Thirteenth day of June in the year of our Lord one thousand seven hundred and fourty seven,

      Richard Lee of London, merchant, son of Richard Lee, Senr., late of Cople Parish, Westmoreland County, Gent., deceased, to Reuben Welch, Thomas Lee and Henry Lee of Essex County, merchant. Lease and release; in performance and satisfaction of an agreement enter'd into by Richd. Lee before his intermarriage with Martha his now wife and for 10 shillings lawful money of Great Britain, to the use and behoof of Reuben Welch for the term of ninety nine yeares if Martha Lee and Richard Lee both of them so long live upon such tracts, then to the use of said Martha during the term of her natural life and after her decease to the use and behoof of Thomas Lee and Henry Lee and after the end of their estate to the use and behoof of George Lee, son of Richard Lee, party hereto, and of the heirs male of the body of George Lee and for default of such issue to the use and behoof of every other the son and sons of Richard Lee on the body of Martha begotten as they shall be in seniority of age, the heirs male of the elder of such son and sons to be preferred and to take before the younger of such son and sons, and for want of such issue then to the use of Martha, Lettice and Anne Lee, daughters of Richard Lee and every other daughter of Richard Lee on the body of Martha his wife to be begotten, share and share alike as tennants in common and not as joynt tennants, and in case one or more of the daughters shall die without issue, then the share or shares of her or them to the use of the survivors [and many further contingencies and restrictions).

For an exchange of 1,000 acres of land in Stafford County on Sorrell's Run "wherein the said Henry Lee hath now a plantation or quarter" and also for £200 sterling money of Great Britain, 10,000 lbs. of tobacco, and "five negro or mulatto slaves." 800 acres of land in Cople Parish at the mouth of lower "Machotique" [Machodoc] River and being part of a patent to John Mottrom dated 13 August 1650, and "since by several mean conveyances or decents became the proper right and inheritance of the said John Wright, and is the plantation and tract of land whereon he now lives (excepting one half acre of the said land being the grave yard on the manour plantation where Majr Francis Wright father of the said John [Wright] is buried" and also excluding another tract of land called Lime Neck already given to his brother Richard Wright by deed dated 22 September 1714.       THIS INDENTURE made this Sixteen day of September in the ninth year of the Reign of our Sovereign Lord George the Second by the grace of God of Great Britain France and Ireland, King, Defender of the faith &c., And in the year of our Lord one thousand seven hundred and thirty five; Between SAMUEL ATTWELL of Cople Parish in County of Westmorland, Planter, of one part and HENRY LEE of the Parish and County aforesaid, Gent., of other part; Witnesseth that SAMUEL ATTWELL in consideration of the sum of Three thousand five hundred pounds of good and lawfull tobacco & one good Negro slave to him in hand paid by HENRY LEE, the receipt whereof he doth hereby acknowledge, hath and by these presents do bargain and sell unto HENRY LEE and his heirs all that messuage of land containing by estimation One hundred acres be the same more or less being part of Nine hundred and fifty acres granted to HENRY VINCENT by two several Pattents, the one for Four hundred and fifty-acres dated the 22th day of December 1662; the other dated the 3rd day of October 1664 and by said VINCENT devised to JOHN LORD in fee, who by Deed dated the 3d day of November 1670 conveyed the one moity thereof to OLIVER GRIFFIN, after whose decease the same descended to FRANCIS GRIFFIN, his Son, who died without heir and made no disposition of the Land the same falling to Escheat JOHN ATTWELL, Father to the said SAMUEL, party to these presents, being then in possession of the Land, upon his application to the Agent of the Proprietor of the Northern Neck of Virginia obtained an Escheat Deed for the said Land being 475 acres as may appear by the Deed bearing date the 3d day of December in the year of our Lord 1712; said JOHN ATTWELL being since dead, the said SAMUEL ATTWELL, party to these presents, is the only surviving Son and sole heir to whom the inheritance of the Land descended and is part of the Land whereon JOHN ATTWELL lived and died, scituate in Parish of Cople and County of Westmorland and bounded, Begining at a marked Gum tree standing on ye side of a Branch falling into the head of a Creek and at a place where formerly was a Bridge across the said Branch, and extending thence along a line of marked trees S. 18s. W. 66 po: to the main Road, thence up the Road and binding therewith the several courses thereof reduced to a right line S. 3d. E: 124 po. to KENNERs Line, thence along KENNERs line S. 76 1/2d, W. 146 po. to a large white Oak in a Swamp, thence North 20d. E. 104 po. to a white Oak corner to a parcel of land formerly belonging to JOHN RICE, now OWEN BRINNONs, thence continued the same course further along said BRINNONs Line 214 po. to a Hiccory Stump nigh a Holly Bush on the Creek side, corner to the said BRINNONs Land, thence up the Creek the several courses and meanders thereof reduced to a right line S. 35d, E. 36 po. to the begining; containing One hundred acres, be the same more or less, together with all houses orchards profits and appurtenances belonging; To have and to hold the tract of land and premises with appurtenances unto HENRY LEE and his heirs, and SAMUEL ATTWELL and his heirs the land and premises unto HENRY LEE his heirs against all persons shall warrant and forever defend by these presents; In Witness whereof the parties have hereunto interchangeably set their hands and seals the day and year above written

Annoq: Domini 1736; Between SUSANNAH APPLEYARD at present of the Parish of Cople in County of Westmorland, Spinster, of one part and HENRY LEE of Parish and County aforesaid, Gent., of other part. Whereas SUSANNAH APPLEYARD claims a right to Sixty six acres and three quarters of an acre of Land within the bounds of two hundred acres of land commonly called and known by the name of KING COPSCO POINT which land was sold and conveyed to HENRY LEE by WILLIAM CHANDLER and DELIVERANCE his Wife by Deed bearing date the twenty sixth day of August one thousand seven hundred and twenty three which said DELIVERANCE hath since intermarryed with OWEN BRINNON, in whose possession and occupation the land now is and the same is part of a tract of land formerly sold by RICHARD WRIGHT and ANN his Wife to NICHOLAS SPENCER Esqr., who by his Last Will and Testament bearing date the twenty fifth day of April one thousand six hundred and Eighty eight gave the same to his Son, NICHOLAS SPENCER in fee, which said NICHOLAS dieing without heirs of his body or otherwise disposing of the land, the same descended to JOHN SPENCER, heir at Law to said NICHOLAS, which JOHN by Deed in his life time sold the two hundred acres of land unto JOSEPH TAYLOR, Planter, in fee and afterwards confirmed the same in fee to said TAYLOR by his Last Will and Testament bearing date the twenty first day of June one thousand seven hundred and eight, which JOSEPH TAYLOR by his Last Will and TEstament bearing date the Sixteenth day of October one thousand seven hundred and twenty one gave and bequeathed to the said SUSANNAH APPLEYARD, party to these presents, one third part of the two hundred acres of Land (being Sixty six acres and three quarters of an acre) to her and her heirs upon the proviso that her Father and Mother did not take her away til she came of age of Sixteen (and the other two thirds to DELIVERANCE TAYLOR now the Wife of OWEN BRINNON) as by the several recited Wills Deeds and writings on the Records of County Court of Westmorland will more plainly appear; NOW THIS INDENTURE WITNESSETH that SUANNAH APPLEYARD for the more effectual securing the land unto HENRY LEE and for divers other good.causes and valuable considerations her thereunto moving but more especially in consideration of one good Negro man slave to her in hand, the receipt whereof said SUSANNAH APPLEYARD doth hereby acknowledge, bath and by these presents doth release and for ever quit claim unto HENRY LEE his heirs all the right claim and demand of SUSANNAH APPLEYARD in the tract of land; To have and to hold the land with all houses rights members and appurtenances belonging to HENRY LEE his heirs; In Witness whereof SUSANNAH APPLEYARD hath hereunto set her hand and seal the day and year first above written
