Will of CHARLES CARTER.
I CHARLES CARTER of County of King George Esqr. desire my body may be decently interr'd in the Vault which have directed to be Built in the piece of ground adjoining to the East side of my Orchards and if the remains of my Family that are Buried at Stanstead are not remov'd & plac'd in this Vault before my death I do request my Executors to have the same done with proper Monuments set in the Wall of the Building that encloses the Vault with the names of the several persons therein interr'd and the time of their death and such Inscriptions as my children by my Respective wives shall chuse to have put on their Mothers Tombs and forasmuch as I never delighted in Funeral pomp I desire I may be buried in as private a manner as possible ., desire no person but my children may appear at it in Mourning .. the men with black crepe on their left arm and the women with a black knott on their left side and I direct whichever of my sons shall Enjoy my Manor of Cleve to provide a neat plain Marble Monument at the Ex- pence of his Estate with such Inscription in English as he and the rest of my children shall think proper .. I do Positively forbid the putting any of my Servants in Mourning having allways determined with myself as much as in my power lay by setting a proper Example to put a stop to the Rediculous custom of involving Families by Pompous Funeral and Mourning which serve only to enrich men who watch for these occasions to Impoverish their Neighbors and in lieu thereof I derect my Executors to divide among such necessitous Families as are not Immediately on the Parish of Hanover Twenty five pounds per annum current money for Eight years after my death in case of the death of all my Executors before Expiration of that time .. this Charity to be paid out of my Estate into the hands of the Minister and Vestry of said Parish of Hanover to be disposed of in manner aforementioned .. further direct Ten Barrels of Corn be annually deliver'd at some convenient landing to the Minister of said Parish for Preaching a Sermon on the day of my death annually on the latter part of the 10th verse of the 23d chapter of the Book of Numbers, let me die the death of the Righteous and let my last end be like is so long as my Manor of Cleve shall remain in the hands of my Male issue .. and whereas it hath pleased God to bless me with a competent share of the good things of this world, I do give and devise them in manner and form following, that is to say I give and bequeath to my son CHARLES a handsome Gold watch with my coat of arms on the outer case and a chain of the Price of Thirty Guineas, a Gold headed cane and a ring of five Guineas price to bring to his remembrance as oft as he sees them that notwithstanding he will take a little by this my will unless his Brothers should die without issue Male, that I made ample provision in my life and in proof of the same I annex his discharge to this my will to take away all Reflection.
I do hereby discharge my son CHARLES CARTER of all sums of money due from him to me as well as what Ive Engaged to pay to WILLIAM CUNNINGHAM, JOHN NEILSON and JOHN HESSELIUS .. this 3d day of June 1762. Signed. Chs. Carter. Witnesses: JOHN ROBINSON, WALKER TALIAFERRO.

Father CHARLES CARTER Esqr. an ample provision in land, Slaves and other things which I do acknowledge myself to be fully Satisfied and do hereby discharge my Father from any further demand .. I do agree that he shall have an absolute right in fee simple of the tract of land call'd Normans Ford containing 310 acres as a Tract 700 acres or upwards adjoining the Rich Land Tract in Tail Male and Five Hundred acres of land or thereabout adjoining the same in fee simple .. 3d June 1762.

Father the Honble MAN PAGE Esqr. and ROBERT CARTER JUNR. Esqr. my Brother .. Whereas I hold in Fee Tail a tract of land containing 310 acres commonly call'd Normans Ford Tract in county of Culpeper which at my death will descend to my Eldest son .. which will be Manifest Prejudice to my son LANDON to whom I Intend to give my tract of land opposite to Normons Ford Tract call'd Ludwell Park which I bought of the Honble PHILLIP LUDWELL Esqr. .. and being desirous to make a Suitable provision to my son CHARLES in lieu thereof provided my son shall apply to the General Assembly .. to settle the said tract containing 310 acres on me in fee simple then I give to my son CHARLES 765 acres .. Neilson Merchant .. to my son LANDON CARTER lot in Town of Falmouth which I purchased of Colo. WILLIAM THORNTON and Colo. NICHO. SMITH conveyed to me by Majr. HARRY TURNER who intermarried with the said Smiths daughter .. to my daughter BETTY CHURCHILL now wife of WILLIAM CHURCHILL Esqr. the sum of Two thousand pounds current money deducting the Thousand pounds I paid her husband the day after his marriage and the One hundred pounds he receiv'd of Mr. OBEDIAH MERRIOTT my Attorney in County of King and Queen to be paid in accordance with the marriage settlement recorded in county of King George ..
To my Daughter MARY now wife of CHARLES CARTER of Corotoman Esqr., the sum of Two thousand pounds current money .. and whereas at the time of my disposing in marriage my Daughters BETTY and MARY my circumstances were such as to enable me to give the fortunes to themselves and I had great hope I should be able to provide in like manner for my other children which this long and ruienous war and the (blank) seasons has rendered Impossible I give to my daughter JUDITH CARTER the sum of One thousand pounds current money .. to my Daughter ANN CARTER being already settled in the marriage contract .. to my daughter MARIA CARTER the sum of One thousand pounds current money .. to my daughter LUCY CARTER the sum of One thousand pounds current money .. to my daughter JANE BIRD CARTER the sum of One thousand pounds current money .. to my daughter SARAH CARTER the sum of One thousand pounds current money .. to my daughter CAROLIANNA CARTER the sum of One thousand pounds current money .. to my Sister JUDITH BANKS the sum of Five hundred pounds current money. One hundred pounds already paid in purchase of two negro men .. I do request my son CHARLES CARTER, my daughters BETTY CHURCHILL, MARY CARTER and JUDITH CARTER Born of my wife MARY daughter of JOSEPH WALKER Esqr. to relinquish all right .. to any part of Swan Tavern by me sold which I held in right of their Mother .. Earnestly intreat and desire that my Sister Banks will continue her care of my dear daughters as she has done since the death of my dear wives .. (follows more bequests to sons CHARLES, JOHN and LANDON) .. mentions "and the girl LUCY who waits on my granddaughter ELIZABETH CARTER" ..
Whereas my sons JOHN and LANDON are now in England for the benefit of their Education .. they are to continue in school to learn the Language, Mathematics, Philosophy, Dancing and Fencing till they are well accomplished and of proper age to be bound to some Reputable Sober Discreet Practising attorney till they arrive to age of Twenty years and nine months .. then to return to Virginia .. guardian limit their pocket Expences after they arrive to age of Eighteen to sum not exceeding Fifty pounds Sterling money per annum .. and whereas the Extravagance of the Present Age and the flattering hopes of great fortunes may be a temptation to run into unnecessary Expenses in living, it is my Positive will & desire that my daughters be maintained with great Frugality and Taught to Dance and as long as my Sister Banks will be so good as to continue her care of them, It is my desire that my Daughters be kept together at my Mansion of Cleve and supported with proper necessarys for house keeping out of the profits of my Estate so as not to present the raising of their fortun's and supporting their Brothers in England as before directed .. I do further will and request that my Slaves may be treated with humanity and Supply'd with necessary Food, Cloathing and beding and in case of sickness or other misfortune I desire they may be properly attended... And whereas I have Endeavour'd to put my Manor of Cleve into a Situation different from the common method of cultivating lands in this colony, I do therefore desire if the Plan begun is not compleated that my Executors will carry on the same agreeable to my directions in writing Entitled a new System of Virginia Husbandry on the little Farm improv'd wherein the business of making Tobacco, Farming, improving the Lands & making wine are largely Treated of and earnestly recommended and which I have wrote for the Benefit of my Children. It is my will that my Coach or Chariot shall be kept with six horses, Coachman & Postilion at the expence of the Estate for the use of Mrs. Banks and my daughters so long as they shall remain at Cleve. It is my will and desire as I have enter'd largely into the Baking Business and am furnish'd myself with Houses, Mills and every necessary for carrying on that Branch of Business to advantage (and the Business of Husbandry will furnish me with large Quantities of wheat besides the several Quantities I have contracted for) that the said Business be carried on in the same manner as it shall be done at the time of my decease and the profits arising from the same be apply'd together with the several other Profits arising from the Estate given to my sons JOHN and LANDON, to the payment of my Legacies and Just Debts .. If my son should attain the age of twenty one years before the Legacies & Debts aforementioned are discharg'd that my said son JOHN shall be put in possession of my Mansion house of Cleve with four hundred acres of Land and ten choice slaves .. for said JOHN'S benefit and that JOHN be paid annually the sum of Two hundred pounds current money of Virginia .. (same circumstances for LANDON) he shall be put in possession of my Mansion at View Mount with four hundred acres of land ten slaves .. be paid annually two hundred pounds current money of Virginia .. whereas I sold Mr. HANCOCK LEE a small parcel of Land opposite the upper end of the large Island above the Falls of Rappahannock being part of that Island Tract (containing by estimation 32 acres) desire my sons confirm the same. It is my desire my Estate not be appraised. I also desire my negro man Benjamin Boyd may be well used and maintained with good cloaths and sufficient Meat and Bread and be employ'd as an Over- looker in repairing my Mills, Machines and Buildings .. and in consideration of his great Fedility that he be paid annually during his life five pounds current money. And whereas the lands given me by my Father were all intail Male and will of course go to and descend after my decease to my Eldest son and his heirs Male and as at this time my son CHARLES has no son living and in case of his decease before mine without Male issue, his present wife ELIZABETH and Daughter may be destitute of Lands to work the Slaves belonging to his Daughter and widow .. my will they have the Previledge of working a sufficient part of the Lands given my Son .. till my granddaughter shall arrive to age of twenty one years or marriage and my said Sons widow (daughter of Colo. JOHN CHISWELL) during her natural life for the sole working of the Dower slaves .. Whereas I have given my son CHARLES a Lease of the lands I bought of JOSEPH and BENJAMIN BERRY and a small part of my Manor of Cleve during his natural life and by the said Lease to his present wife during her widowhood and by cutting down the Timber wantonly the value of said Estate may be Deminishrd .. my sons Estate shall be liable to Damage for such willful' waste .. give JOHN one hundred and thirty slaves to be chosen out of the negroes before given him and likewise one hundred to my son LANDON .. my sons to be left at liberty to take them at their apprais'd value and pay their Sisters JUDITH, ANN, MARIA, LUCY, JANE BIRD, SARAH and CAROLIANNA each a thousand pounds current money to make them equal in fortune to their Sisters BETTY and MARY to whom I give Two thousand pounds current money .. I do appoint for the several purposes before mentioned my dear Brother LANDON CARTER Esqr. of the County of Richmond and my sons in law CHARLES CARTER Esqr. of the County of Lancaster and Mr. JOHN CHAMPE JUNR. of county of King George to be Executors and Guardians to my children desiring that they not consent to my sons Marriages until they attain the age of twenty one years nor my Daughters Marriages untill they attain the age of Seventeen years and when my son JOHN CARTER shall arrive to the age of Twenty one years I then appoint him additional Executor .. and appoint my son LANDON CARTER an Executor .. when he arrives to age twenty one years... and I do now declare and Publish this writing contain'd in Twenty eight pages wrote on one side only except one by the hands of CHARLES ROBINSON and Signed by me at the bottom of each page as and for my last will and testament .. this 10th day of September 1762.

He had nine daughters and three sons: Judith, Anne, Maria, Lucy, Jane Bird, Sarah, Carolanna, Betty Churchill, wife of William Churchill; Mary, wife of Charles Carter, of Corotoman; Charles, to whom he gave a handsome gold watch, with his coat of arms on the outer case, a gold-headed cane, and a ring of five guineas price; John and Landon.
Mentions his son Charles Carter, daughters Betty Churchill, Mary Carter and Judith Carter as "Born of wife Mary, daughter of Joseph Walker, Esq."; sister Judith Banks; and father, the Hon. Mann Page, Esq.; brother, Landon Carter, Esq., of Richmond county; sons-in-law, Charles Carter, Esq., of Lancaster county, and Mr. John Champe, Jr., of King George county ; son Charles' wife, Elizabeth, daughter of CoL John Chiswell, and his daughter, Elizabeth. WILLIAM TALIAFERRO with a good and convenient dwelling house upon the same to be decently furnish/'d and suitable offices thereto together with six working slaves, six house servants and their Increase including a coachman and postilion, four Beaves, six Muttons, six Lambs & 1500 weight of pork over and above the produce of the said plantation and slaves with a Chariot and six horses all of which .. were to be held by Lucy during the time she should continue the widow of said Charles only and Lucy now the relict and one of the contracting parties of these presents being willing as she has survived the said Charles her husband to accept of a compensation for the Plantation and tract of land the houses to be built on the same, the furniture for such Houses, the working and house slaves .. the said LANDON CARTER and CHARLES CARTER also being willing that such compensation should be made ., the several contracting parties agree the sum of Six hundred pounds current money shall remain as a Debt upon the Estate for use of ANN WALKER CARTER now an infant of about age of two months and daughter of said Charles the Elder deceased and Lucy Carter to be as a Fortune for said Ann Walker Carter to be paid her at age of twenty one or Lawfully married .. that twelve months from date of these presents the sum of Thirty pounds current money as one years Interest for said 600 pounds be paid Lucy Carter for maintenance of Ann Walker Carter and for every year 600 pounds shall remain as a Debt .. if Ann Walker Carter dies before age twenty one Estate to pay Lucy Carter Four hundred pounds of the Six hundred pounds ..
