      I, John Franklin of CC, planter, for the natural fatherly love I have for my son, William, and for 1000 lbs tobacco and for divers other good causes, I give William and his male heirs, and in case William should die without male heirs, then I give to my son, Joseph Franklin and his heirs, a tract of land in CC called Franklins Addition, lying between Nanjemy Glebe called Hoocknorton, the land of Thomas Milstead, and the land of Joseph Thomas. Also, 33 acres, being part of a tract of land called Moless Venture, lying on the north side of the Maine`';" containing in all and laid out for about 103 acres. The following depositions and proofs were lodged with the CC Clerk, to be recorded pursuant to the directions of an Act of Assembly passed in 1779 and entitled, an Act to establish a mode to perpetuate testimony.
      William Smallwood of CC, wanting to perpetuate the testimony of sundry witnesses respecting the title of the following tracts of land called Allansons Folly and Saint Davids, for which actions of ejectment have been brought and are now depending in the General Court of Maryland between Thomas Rookwoods, lessee, plaintiff, and John Brawner and William Jones, tenants of sd William Smallwood, gave the following notice to William Cooke of Annapolis, the Atty at Law for sd Thomas Rookwood, he, sd Rookwood, being absent and residing out of the State of Maryland - to wit

      No. 10. The deposition of William Franklin, aged about 72, says that he has heard his father, John Franklin, frequently mention old Edward Rookwood, and say that he served part of his time with the sd Edward Rookwood and the rest of his time with Mr. Colson at Mastins Ferry, the adjoining plantation to the land whereon Chickamuxon Warehouse now stands, that he has frequently heard his father, John Franklin, say that the land at Chickamuxon Warehouse became escheat, and that Henry Moore later sold the land to Mr. Bayne Smallwood, from whom it descended to William Smallwood, the present Defendant, as heir at law, who has ever since remained in peaceable possession of sd land.
