"being in perfect and disposing mind & memory . ."
Bequeaths to:
1. Harriet Clagett --wife
to have for her natural life all of testator's lands purchased from James Hawkins on the condition that 3 months after testator's decease she make over and secure to all of testator's children a legal and joint estate to all the lands she owns in Prince George's County which she inherited in virtue of her grandfather the late Zachariah Bond's last will and testament and also on condition that she cut no timber from the land purchased from Hawkins but has the liberty of doing so from the land purchased from the Websters and fence rails with timber from the land purchased from James Marshall
-should she refuse to comply, then to have one third of the personal estate -to have Negro woman "Peggy"
2. Richard Thompson
-to have all of testator's right, title and interest in a lot of ground in the addition to George Town which testator purchased from the late George Fraser Hawkins, Esq.
3. Nathaniel Clagett --brother
-to have all of testator's right, title and interest in the fishery at the point on Piscataway Creek which testator purchase and hold in Company arid jointly w/ testator's friend Samuel Bond, Esq,
-named executor and to distribute as he sees fit the sum of 50 pounds among the poor
4. Martha Clagett --cousin
-to have the sum of 50 pounds current money
5. Thomas Clagett --brother
-testator desires that the rest of the estate including the lands inherited from Maj. Bond to testator's widow be divided among her and testator' s children and that Thomas and Nathaniel nominate men of good judgement to make the division among testator's children and they are to receive their share when they arrive at the age or 21 (Children unnamed)

I Enoch Magruder in consideration of the love good will and affection which I have and do bare towards my loving daughter Mary Meek Clagett has given parts of three tracts; "Stoney Harbour" containing 157 acres; "Magruders Advantageous Conjecture" containing 129 acres; and "Lanhams Folly" containing 23 acres and bounded by Tinkers Branch, the main road that leads from Piscattaway to Broad Creek by the plantation of the late Mr. Thomas Dyar, the road the leads towards the Wood Yard, the second line of the "Two Johns" containing in the whole 308 acres. In witness whereof I have here unto set my hand and seal this March 30, 1769, Enoch Magruder in the presence of and acknowledged before George Hardey, Jr., Richard Duckett, Jr. and at the same time Meek Magruder w/o Enoch Magruder relinquished her right of dower

Indenture made May 20, 1769; Daniel Frazier and Elizabeth Frazier his wife in consideration of 50 pounds currency paid by Thomas Clagett has sold part of a tract called "Lanham Folley" containing 21 acres and beginning at the part of the said tract that was conveyed by John Lanham, Jr., on August 11, 1750 unto Elizabeth Frazier and bounded by a branch that falls into Tinkers Branch. Signed Daniel Frazier, Elizabeth Frazier in the presence of and acknowledged before George Hardey, Jr., John Baynes and at the same time Elizabeth Frazier w/o Daniel Frazier relinquished her right of dower

Mar 25, 1773 from Henry Hardey Jr & Thomas Dent of Prince Georges County, to William Foard Sr of the sd County. The late Mr. George Hardey Jr, decd, was possessed jointly with the afd Henry Hardey with part of a tract of land lying in CC, called Boarmans Manor on Dividing Run, which, by his will dated last Mar 15, he requests to be sold for the purposes therein mentioned, which appoints sd Henry Hardey and Thomas Dent to sell sd land. In compliance with the afd will this deed witnesses that sd Henry Hardey & Thomas Dent, for 200 £7 shillings, have sold to sd William Foard Sr, all that part of a tract of land in CC on Dividing Run, called Boarmans Manor, bounded by the east side of Zakiah Swamp, and on the north side of a Fresh Run called the Dividing Run, containing about 100 acres. This deed was acknowledged in Prince Georges County; Elizabeth, wife of the sd William Foard, relinquished her right of dower. Certified by Thos Sim Lee, Clerk of Prince Georges County. Indenture made August 14, 1790; Thomas Clagett, merchant in consideration of the love goodwill and affection which he hath towards his beloved daughter Mary Meek McEldery and 3 pounds current money has sold a lot in the Town of Piscattaway being part of "Hazard" containing 1 acre and 64 perches of land and beginning at a stone standing by the road and by the south corner of Thomas Clagetts accounting room. Indenture made September 28, 1790; James Edelen, Doctor of Phisic in consideration of 160 pounds current money paid by Thomas Clagett, merchant has sold part of a tract called "Apple Door" ["Appledore"] containing 110 acres and beginning at a bounded white oak of "Hawkins Lott" and bounded by the first line "Rome" being also the dividing line between Thomas Edelen and Christopher Edelen; also part of "Rome" containing 27 acres and beginning at a white oak stump standing in the line of "Something" formerly belonging to John Hawkins. Indenture made February 7, 1791; Charles Lansdale, Gentleman of Montgomery County, Maryland in consideration of 268 pounds 2 shilllings and 6 pence current money paid by Thomas Clagett, merchant of PGCo has sold two tracts in PGCo; "Middletons Lott Enlarged" containing 106 ½ acres and beginning at a stone, also the southwesternmost corner or fourth boundary called "Hawkins Lott" and fixed on the east side of a point opposite the northeast corner of a mill on Pisacattaway Main Branch belonging to George Hardey and bounded by "Majors Choice", "Rich Hill", "Pittsburgh (resurveyed for George Hardey in 1761), Piscattaway Creek and Tinkers Creek; and "Gods Gift" containing 59 acres and beginning in the main road leading from Piscattaway to Upper Marlbro. In Chancery, May Term 1793, Patrick McElderly and Mary Meek McEldery his wife against Judson Clagett, Thomas Clagett, Elizabeth Clagett, Sarah Clagett, Hannibal Clagett, Hector Clagett, heirs of Thomas Clagett, deceased; the said cause standing ready for hearing and the defendants who are of full age, and the infant defendants having answered by their guardian and it appearing to the Chancellor that the not recording of the Deed in the bill mentioned was not owing to any fraudulent intention and that the complainant, Mary Meek McEldery hath an equitable claim to the land threin mentioned. It is thereupon by Alexander Contee Hanson, Chancellor and the authority of the court has decreed this June 20, 1793, that the deed annexed being executed on August 14, 1790 by Thomas Clagett, deceased for a lot in Piscattaway being part of a tract called "Hazard" shall be considered the defendants as heirs or devisees of Thomas Clagett, deceased and to have the same effect as if it had been recorded within the time prescribed by law.
