In the Name of God Amen I Samuel Dishman of ye County of Westmoreland in Washington Parish in Virginia being very sick and weak of body but in perfect sense and of sound memory - thanks be to God for it, do make and ordain this to be my last Will and Testament in manner and form following, Revoking and renouncing all other Will or Wills heretofore by me made.
Impr. I Recommend my Soul into ye hands of Almighty God, my Creator, trusting in him to have a joyful Resurrection, etc. and my body to ye Earth to be decently Buried in ye Christian burial at ye discretion of my Executors hereinafter mentioned.
1st I give and bequeath unto my Eldest Son John Dishman all my Lands in Stafford County with ye free Simple thereof to him and his heirs forever, and also, I give him all my Smiths tools of what kind so ever, also I give to my aforesaid Son John Dishman, three Negroes named Tony, Judith, and Giny.
2dly I give unto my Daughter Elizabeth Brown three Negroes called Sambo, Sarah and Pegg, one feather bed and furniture thereunto belonging, two cows and calves and two sheep.
3dy I give unto my Daughter Anne Dishman, three negroes, named Kitt, Harry and young Shew, one feather bed and furniture thereunto belonging, two cows and calves and 2 sheep.
4thy I give unto my Son James Dishman all my Lands in King Georges County with ye free Simple thereof to him and his heirs forever and also two Negroes called Dick and Shew.
5thy I give unto my Son David Dishman two Negroes named Tom and Will.
6thy I give unto my Son Peter Dishman two Negroes called Will Winnes child and Anthony Shews child and my desire is that all my Lands in Essex County should be equally Divided between my said two sons David and Peter Dishman, with ye free Simple thereof, to them and their heirs, forever.
7th I give unto my Daughter Mary Disman (sic) two Negroes named Charles and Young Giney to be delivered at ye age of 18 or ye Day of Marriage, but in case she die before she come of age, then to be divided between David and Peter Dishman.
8thy I give and bequeath unto my Son John Dishman half ye Lands belonging to me in this County of Westmoreland with ye free Simple thereof to him and his heirs forever, and the other half to my beloved Wife Cornelia Dishman enduring her natural life and after her decease to my Son James Dishman with ye free Simple thereof, to him and his heirs forever.
9thy I give unto my Daughter Mary one feather bed and furniture, two cows and calves and two sheep.
10thy I give unto my well beloved Wife Cornelia Dishman three Negroes named Ned, Winney, Frank with her mare, saddle and bridle.
11thy All ye rest of my personal Estate of what kind, nature or quality soever I give to be equally divided among my four Sons and my beloved Wife.
Lastly I do herby constitute and appoint my Son John Dishman and my beloved Wife Cornelia Dishman to be my Executors of this my last Will and Testament, but if my Wife should marry again, then I do herby leave my Son John Dishman my sole Executor of this my last Will and Testament.
In Witness whereof I have hereunto set my hand and seal this 15th Day of November Anno Domini 1726.

This Last Will and Testament of Samuel Dishman deceased was presented into Court by his relict Cornelia Dishman and John Dishman the Executors therein named who made oath thereto and being proved by the oaths of Richard Rollins and Richard Arrowsmith two of the Witnesses thereto, is admitted to record.

31 May 1727: [Saml. Dishman’s Will prov’d] The Last Will and Testament of Samuel Dishman decd. was presented into Court by Cornelia Dishman his Relict and John Dishman his Executor who made oath thereto and being proved by the oaths of Richard Rollins and Richard Arrowsmith two of the witnesses thereto is admitted to record and upon the motion of the said Executors and performing what is usual in such cases Certificate is granted them for obtaining a probate thereof in due form. It’s ordered that Robert Richards, Gerrard Ford, Francis Lacon, & Jno. Weedon or any three of them being first sworn before a magistrate of the said County do some time before the next Court to be held for the County aforesaid value and appraise the estate of the said Samuel Dishman decd. in money and make report thereof to the said next Court.

Now know yee that I ROBERT PECKE of the County of Richmond in the Coll, of Virginia Planter, for divers good causes me thereunto moveing and more especially for the full and just sume of Three thousand five hundred pounds of good sound tobo: in caske and Twenty shillings money Sterling in hand paid to me the said ROBERT PECKE by SAMLL. DUCHEMINE of the County of WESTMORLD: in the Coil. aforesaid have bargained sold and do by these pr:sents for me and my heirs sell unto SAMLL. DUCHEMINE his heirs & assignes Two hundred acres of Land being part of a tract of Land to me belonging lying and being in the County of Richmond, Beginning att a marked white Oake neare the mouth of a Branch yt: runns in the DOEG SWAMP (the branch and white Oake being on the East side of DOEG SWAMP), runing Northerly along the DOEG SWAMP to the next Branch - Easterly along that branch and likewise Easterly along the branch from the white Oake corner tree being a Ridge of Land lying betwixt the DOEG SWAMP and the Plantation of JOHN THOMAS, To have and to hold the said Two hundred acres of Land to him the said SAMLL. DUCHEMINE his heirs or assignes forever with all profitts and appurtenances in any wise belonging in as large and ample manner as is usually granted by Patents in this his Majties: Collony of Virginia; To be held & enjoyed by him the sd SAMUELL DUCHEMINE his heirs &assignes forever more paying the Quitt-rents yearely and every yeare to whome due or lawfully impowered to gather ye same, And furthermore I the said ROBERT PECKE do hereby warrant the sale of the said Land and that he shall att all times hereafter possess and enjoy the said Land and that he shall att all times hereafter possess and enjoy the said Land and every part thereof with the appurtenances thereunto belonging without the trouble or expulsion of me the said ROBERT PECKE my heirs or any other persons whatsoever legally clayming the same or any part thereof, And furthermore I the said ROBERT PECK do grant that I will att the special! request of him the said SAMLL. DUCHEMINE his heirs &c. make and deliver any other acts Deeds or Conveyances for the better settling and secureing of the said Land or any way or meanes whatsoever that shall be by them or any of them of their learned Councell in the Law shall be required And also that the sd ROBT. PECK shall at the request of the said SAMUELL DUCHEMINE acknowledge this his act and deed in the County Court of Richmond aforesaid; In Wittness whereof I have hereunto sett my hand and fixed my seale this first day of October One thousand seven hundred & one 1701

18 Dec 1710: Mrs. Mary Merring of Plymouth, County of Devon in Great Britain died seized of 440 Acres in Northumberland County. Land Escheats. Thomas Sorrell, Deputy Clerk of said County. Grant to Samuel Duchiminia of Westmoreland County adjacent his land on upper Machotique, Thomas Butler, Edward Mercy, near Ashton Swamp, Richard Rawlins.
Marguritte Lady Culpeper and Catherine Lady Fairfax Proprietors of the Northern Neck of Virginia.
To all whom this present writing shall come send greeting in our lord God everlasting.
Whereas Samuell Duchiminia of ye County of Westmoreland hath set forth to our office ye Mrs. Mary Merring of Plymouth in ye County of Devon in the Kingdome of Great Brittain dyed seized of four hundred and forty acres of land in ye said County of Westmoreland and left no heirs behind her nor did dispose thereof by will whereupon ye same escheats to us ye said property and thereupon a certificate according to ye rules of the office issued to make ye same publick so being returned with endorsements under ye hand of Thomas Sorrell dept clerk of ye said County certifying that the same was duly published and no person appearing to dispute ye title to ye said escheat and ye said Samuel Duchiminia moving to be preferred to escheat ye same.
Know Yee therefore that we for and in consideration of ye composition to us paid and ye annual rent hereafter reserved have granted, made over, and confirmed and by these presents do grant, make over, and confirm unto ye said Samuel Duchiminia all our right, title, interest, claim, and demand of, in, and to ye said four hundred and forty acres of land to us belonging or appertaining by virtue of ye said escheat ye said land situated, lying, and being in Upper Machotique in ye County of Westmoreland aforesaid and bounded according to ye said survey as followeth.
Viz: Beginning at a hiccory corner tree to this Land and ye land ye said Samuell Duchiminia now lives on standing in ye line of Thomas Butler by a Road and extending to a hiccory saplin standing in ye line of another parcel of land of ye said Duchiminia along ye line of Thomas Butler South fifty degrees West one hundred and sixty seven pole thence North twenty two degrees and a half West twenty four pole to a corner tree to ye said Duchiminia land being a red oak standing by a path thence south seventy seven degrees west two hundred and ninety four pole to a corner hiccory saplin standing in ye line of Edward Mercy thence North five degrees East two hundred and twenty pole to a corner white oak by a branch near Ashton swamp in ye line of Richard Rawlins thence south eighty degrees east one hundred and forty seven pole to a red oak corner tree to said Rawlins by a branch side thence north east thirty four pole to a white oak tree of said Rawlins at ye mouth of a branch entering Ashtons Swamp thence ye meanders of Ashtons Swamp to ye mouth of a branch leading up to Duchiminia Spring a point at ye mouth of spring branch parting this land and ye land Duchiminia now lives on thence up ye branch to a marked white oak at ye head of ye said branch standing by his spring thence South fifty two degrees east forty pole to ye place begun.
Together with all rights, members, & appurtenances thereunto belonging Royal Mines excepted and ye full there part of all lead, copper, tin, coals, and iron mines as shall be found thereon.
To have and to hold ye said 440 acres of land together with all rights, profits, and benefits to ye same belonging or in any wise appertaining except before excepted to him ye said Samuel Duchiminia his heirs and assigns therefore.
Yielding and Paying to us our heirs and assigns or to ye certain attorney or attorneys of us ye said proprietors or to ye certain attorney or attorneys of our heirs and assigns proprietors of ye said Northern Neck yearly and every year on ye feast of St. Michaels ye Arch Angel ye fee rent of one shilling sterling money for every fifty acres of land hereby granted.
Provided that if ye said Samuel Duchiminia his heirs and assigns shall not pay ye before reserved annuall rent so if ye same or any part thereof shall be behind or unpaid by ye space of two whole years after ye same shall become due if lawfully demanded ye then it shall and may be lawful for us our heirs and assigns certain attorney or agents into ye above granted promises to reenter and hold ye same as if this grant had never passed.
Given at our office in Lancaster County within our said proprietory under our seale. Witness our agent and attorney fully authorized thereto. Dated the 18th day of December in the ninth year of the reign of our sovereign Lady Anne of Great Brittain, France, and Ireland Queen defender of the faith. Anno Dom 1710
