1744-1794 Frederick Co MD Wills-Russell
JOSEPH CHAPLINE of Frederick Co. Will dtd. 27 Jan. 1768, sick. To
wife Ruhamah: exclusive of her thirds, the plantation where I live and
use of my negroes for life, provided she remains my widow, for the
support and education of my children and my daughters as long as they
live together. But if my wife remarries, the use of the negroes shall
cease and be for the use of my children, except negro Hester and her
increase, who is to be my wife's forever. The negroes are to be part
of my estate and under the guidance of my executors. Also to wife:
all the money from the sale of lands in England and Wales, except the
money I advanced in getting it. To son William Williams Chapline: all
of the Resurvey on Vineyard and Hills and Dales, that lies on the west
side of the Big Antietam; also my gristmill and 50a to be laid off on
the east side of the Big Antietam, agreeable to the articles now
subsisting between me and Col. Samuel Beal & Co. to him and his heirs
forever (entailed). To son Joseph: tract called Joe's Lott on the west
side of the Big Antietam and the town of Sharpsburgh, except such lots
as I give my other children; also the tract Norris Seat and the resurvey
thereon; also the Resurvey on Addition to Piles Delight, conveyed to me
by James Sprigg, on north side of the spring where William Norris lives
(description), provided Joseph conveys to his brother Jeremiah 120a out
of Joe's Lott; these gifts are entailed. To son James: tract formerly
called the Resurvey on Hopewell but now Loss and Gain (entailed); also
Lot 76 in Sharpsburgh, free of rent unless he sells it, then rent to be
paid to the Proprietor (all the Sharpsburgh lots given to his children
have this restriction). To son Jeremiah: my dwelling plantation and the
tract Little I Thought It, that lies between the Potomac River and the
Resurvey on Addition to Piles Delight, adi. Anteatum Bottom (desc.).
Also part of Addition to Piles Delight; also the 120a from Joseph and
Lot 94(?) in Sharpsburgh. To dau. Deborah: the rest of the Resurvey on
Spriggs Delight, for which I have John Moor's bond to convey to me,
except the 150a which I have agreed to sell to William Rennix and his
wife Keziah; also Lot 43 in Sharpsburgh. To dau Ruhamah: tract near
Opekon adj. Jeremiah Williams and John Kingswood(?), except 30a
which is to be conveyed to Col. Benjamin Chambers; also Lot 41 in
Sharpsburgh. To dau. Sarah: part of Little I Thought It (desc. mentions
Teaggls Old Wagon Road); also Lot 135 in Sharpsburgh. To dau. Jean:
part of the Resurvey on Tom's Gift and the plantation where Robert
Evens and Sarah Hopkings live; also Lot 16 in Sharpsburgh. To dau.
Theodosha: tract on Back Creek Mountain, adj. George Ross and Moses
Harlan; also Lot 15 in Sharpsburgh and the first surviving child by negro
Hester.
Whereas some years ago I patented a tract called Little Good with
a vein of a copper mine and now have 400a of warrant leased joining
Isaac Relves(? Relf?) place: now my executors to execute this warrant
and if they find either tract worthwhile to be mined, to do so at the
expense of my children, and the profits distributed to them; but if they
find it is not worth working, then to sell both tracts and distribtrt~:
profit to my children. But I direct that the remaining part of the tract
called Resurvey on Horse Neck that is unsold, for which I have John
Tucker's bond to convey, and also the tract adj. Thomas Cheny, to be
sold.
Whereas I am engaged with Coll. Beatty & Co. in building iron
works, for which I have subjected considerable lands, one-fourth of the
land remains mine: I direct that the land and works be sold and also
the land on the west side of the Antietam, between Teaggls Old Wagon
Road and Little I Thought It, and the money to be used to pay the
quitrents and Dr. David Ross, then equally to children. If any sons dies
without lawful issue, his real estate to be divided among the other
sons; if a daughter dies without lawful issue, her part to her sisters. If
any disputes arise among my children, two or three honest men are to
settle it "so that no law be had about it," but if any is obstinate and
go to the law, then hislher part to go to the next heir-at-law. Personal
estate equally to children, except Joseph. Sons William and Joseph
exec. Is/ Joseph Chapline. Wit: William Good, Danl. Culp, Mary Good.
Proved 22 March 1769 by the 3 wit. A codicil dtd. 27 Jan. 1768 gives
to daughters Deborah, Ruhamah, Sarah, Jean, and Theodosha: a negro
girl aged 8 or 9 and her increase forever each. Alsc,son James to be
a joint executor with his brothers. /s/ same wit. Proved 29 March

Note:
Now, I mentioned earlier that Jeremiah York sold his land in old Frederick County, Virginia to a William Chapline. It turns out that William's brother, Joseph Chapline, was named as executor of Samuel Finley's estate during the administration proceedings. Chapline began settling Finley's estate with an appraisal dated 15 Mar 1738 and proved in court on 29 Jun 1738. The appraisers were Johannes Noll and John More. Thomas Wale and William Norris were named as creditors. There were two inventories taken of the estate. The first was dated 24 Jun 1738 and proved in court 31 May 1739. A second was proved on 24 June 1739 and it shows payments to a number of individuals including Joseph Medcalfe, Henry Enoch, and William Norris. It is stated in the inventory that there were no known heirs. In this court proceeding, there was testimony that Samuel Finley had been charged by a Joseph Evans, in Oppeckon, County of Orange, with stealing a horse in Chester County, Pennsylvania in 1735. The reference to Oppeckon, County of Orange, is to that part of Orange County, Virginia that later became old Frederick County, Virginia, and Oppeckon refers to a creek near present-day Winchester, Virginia.
The administration of Samuel Finley's estate in Maryland took some time because we find a court proceeding of 23 Jun 1741 which ordered payments from the estate to a number of creditors including Thomas Wale and Robert Finley, who was probably Samuel's brother. Joseph Chapline was again the administrator.
