Augustine Moxley's Will
In the name of God Amen, I Augustine Moxley of the County of Westmoreland do hereby make will and testament.
Firstly, I lend to my wife Caty Moxley during her natural life and no longer the plantation whereon I now live. Also one equal third part of all my Negroes and personal estate in lieu of her dower.
Secondly, I give and bequeath unto my nephew Robert Sanford the tract of land whereon I now live after the death of my wife. My will and desire is that the said Robert Sanford should remain on the land with my wife and to manage her affairs on said plantation in the capacity of an overseer and that my nephew Robert Sanford shall have one equal third part of all the remaining part of my Negroes and personal estate.
Thirdly, I give and bequeath to my nephew John Moxley, son of my brother William Moxley after the death of my wife, my tract of land lying beyond the mill, together with the mill and all its appurtenances.
Fourthly, I give and bequeath unto Edward Stone, son of Thomas Stone, after the death of my wife, my tract of land on the side of the mill called parities, excepting 10 acres adjoining the mill
Fifthly, I give and bequeath unto my niece Fanny Scrimger, Negro girl Phebe.
Sixthly, I give and bequeath unto my niece Betsey Dodd, Negro girl Rachael.
Seventhly, I give and bequeath unto my God daughter Caty Moxley Pope Sanford.
Eighthly, I give and bequeath to my nephew Willoughby Sanford, the sum of 20 pounds to be paid by my executors for his support in education as it may be collected from my estate from year-to-year.
Ninthly, I give to my nephew Elijah Sanford, the sum of 20 pounds to be paid by my executors for his support in education as it may be collected from my estate from year-to-year.
Tenthly, I give and bequeath to Samuel Moxley, son of Jane Moxley the sum of 20 pounds to be paid by my executors.
Eleventhly, I give and bequeath to my niece Penny Weaver for the use of her child Alfred, the sum of 20 pounds to be collected out of the profits of my estate in paid year-to-year by my executors for the support in educating said child.
Twelvethly, I give and bequeath unto my nephew John Moxley, son of William Moxley the 10 acres of land adjoining the mill which was part of the tract given to Edward Stone.
Thirteenthly, I give and bequeath to my brother William Moxley’s children and my sister Elinor Sanford’s children, after the death of my wife, the residue of my estate to be equally divided between them.
Lastly, I appoint my wife executrix and Thomas Spence, Robert Sanford, Thomas Scutt and Samuel Templeman, executors to this my last will and testament. In witness whereof I have hereunto affixed my hand and seal this ninth day of June 1797.

At a court held for Westmoreland County the 28th day of August 1797 this will was proved according to law by the oaths of Augustine Sanford, Presley Sanford and John Sanford three of the witnesses thereto and ordered to be recorded; and on the motion of Thomas Spence one of the executors therein named who made oath thereto according to law with William Hutt and Samuel Templeman his securities entered into and acknowledged bond with condition as the law directs, certificate is granted him for obtaining a probate thereof in due form.
