      James Gregory's Will
      In the name of God Amen, I James Gregory, Sr., of the Parish of Cople and County of Westmoreland in the Commonwealth of Virginia, being very sick and weak in body but of perfect mind and memory do make and ordain this my last will and testament.
      Item first, I give and bequeath unto my loving wife Catherine Carr Gregory 40 acres of land with the liberty of choosing the said land in two places, the option to sell, lease, give or dispose of the same during her natural life or at her death whether a division shall take place or not.
      Item I give and bequeath unto my son Daniel Thomas Gregory 12 acres of land situate where Mr. John Gordon now lives lying on the head of Carter’s Mill Pond.
      Item I give and bequeath unto my sons George Carnaby Gregory, James Gregory, Joseph Carr Gregory, John Gregory and Daniel Thomas Gregory and daughters, Lettice Anthony and Anne Carr Gregory as follows; The remainder to my land to be divided as follows; to my son Daniel Thomas Gregory, two equal parts of the remainder of my land one of which I allot for my daughter Sarah Carr Howell at the death of her husband, but if she should become a widow, my will is that the said two parts shall belong to my son Daniel Thomas Gregory; and the remainder of my land then to be equally divided between my other six children; George Carneby Gregory, James Gregory, Joseph Carr Gregory, John Gregory and daughters, Lettice Anthony and Anne Carr Gregory; and my will is that my son James Gregory shall have 4 acres of land, part of a tract of land which I bought of Joseph Remy where the cluster of plum bushes now grow or a little above them, the said 4 acres to be considered as part of his equal proportion with the rest of my said children heretofore mentioned, and my said son Jame Gregory shall have the new dwelling house he now occupies.
      Item I give and bequeath unto my daughter Sarah Carr Howell, 2 shillings sterling to be in full of her proportion of my estate during the natural life of her husband John Howell.
      It is my will and desire that if William Edwards should ever commence suit for any part of my land, then my desire is the whole of my land shall be rented out to pay the cost of such suit.
      I do hereby ordain this my last will and testament and appoint my loving wife executrix and my worthy friends Capt. John Rochester and William Hutt, executors to this my last will and testament. Given under my hand and seal this 3rd day of March 1791.

      N.B. it is my will and desire that the whole of the woodland exclusive of my wifes proportion shall be equally divided between my several children, also the cleared land exclusive of my wifes part. As wifness my hand the day and written before.

      At a court held for Westmoreland County the 27th day of March 1792 this will was presented to the court and there appearing to be a piece of paper on the face of the said will and being proved to have been put on by the orders of the said testator to destroy a claim of the said will under the same ordered the same be recorded instead of the said clause which it appears to cover and the same is admitted to record, and on the motion of Catharine Gregory the executrix therein named who made oath thereto according to law and together with Thomas Gregory and Presley McKenney her securities entered into and acknowledged bond with condition as the law directs, certificate is granted her for obtaining a probate thereof in due form.
