      ARTICLES of AGREEMENT upon dividing of a tract of land lying in the County of Westmorland and formerly belonging to JOSEPH HARDWITCH, deceased, and by Will left the land to be equally divided among his Children, And now this 29th day of September 1743, division being agreed upon and lines run before evidence between ANN KIRK his said Wife and us the said Children for the same and as we shall interchangeably set our hands to the said Agreement that us nor neither of us shall oppose or impose each other in each others parts; As Witness our hands the day and year above written

      THIS INDENTURE made the 25th day of October in the Seventeenth year of the Reign of our Sovereign Lord George the Second by the grace of God of Great Brittain Prance and Ireland, King, Defender of the faith; And in the year of our Lord one thousand seven hundred and forty three, Between JAMES HARDWICH parish of Cople in County of Westmorland, Planter, of one part and GEORGE ASBURY of the aforesaid Parish and County of other part; Witnesseth that JAMES HARDWICH in consideration of the quantity or sum of Five pounds current money of Virginia and Nine hundred pounds of tobacco in one Hogshead to him in hand paid by GEORGE ASBURY, the receipt whereof JAMES HARDWICH doth hereby acknowledge, hath and by these presents doth bargain and sell unto GEORGE ASBURY his heirs all that plantation parcel of land containing Thirty five acres of land more or less scitaute in Parish of Cople in County of Westmorland being aprt of a tract of land whereon JOSEPH HARDWICH, Father of said JAMES HARDWICH, party to these presents, which land JOSEPH HARDWICH willed part to said JAMES HARDWICH as may appear by the Records of the County Court of Westmorland, which land is part of a Division now vested lawfully in JAMES HARDWICH his Son; Together with all houses orchards and appurtenances to the parcel of land belonging; To have and to hold the Thirty five acres of land with appurtenances unto GEORGE ASBURY his heirs; And JAMES HARDWICH his heirs against every person shall warrant and forever defend by these presents; And that ISABEL, the Wife of JAMES HARDWICH, shall personally appear at the next Court held for the said County and then and there in open Court relinquish her right and title of Dower and Thirds at the Common Law in the premises hereby conveyed by her Husband to GEORGE ASBURY his heirs; In Witness whereof the parties first above named to these presents Indentures have interchangeably set their hands and affixed their seals the day and year first above written

JAMES HARDWICH delivered peaceable and quiet possession and seizin of the within granted land and premises by delivery of Turff and Twigg on the land unto GEORGE ASBURY in the name and token of the possession of the whole land and premises within granted; In presence of JOS: READ

      I do hereby acknowledge to have had and received of GEORGE ASBURY the full quantity of five pounds current money of Virginia and Nine hundred pounds of tobacco in one hogshead being the consideration within mentioned to be paid me by him; As Witness my hand the day and year first within written

At a Court held for the said County the 25th day of October 1743 JAMES HARDWICH personally acknowledged this Deed of Feofment for Lands by him passed to GEORGE ASBURY together with livery of seizin and receipt for the consideration endorsed to be his proper act and deed, and ISABELLA, Wife of the said JAMES (being first privily examined according to Law), relinquished her right of Dower of in and to the lands by the said Deed conveyed, all which on motion of the said ASBURY are
