      IN THE NAME OF GOD, Amen. I JOHN BARNET of Cople Parish in County of Westmorland not being well and seriously considering the uncertainty of this transitory life do make here my Last Will and Testament in the following manner and form hereby making all former and other Wills and Testaments heretofore by me made and this onely to be taken for my Last Will and Testament;
      Imprs. I resign my Soul to the almighty and most merciful God with a Christian hope * and my body to have a Christian burial by my Executors hereafter named and for such temporal Estate wherein it hath pleased my good God to bless me with I give and dispose of the same after my just debts are paid as followeth;
      Item. I give and bequeath unto my Son, RICHARD BARNET, my Still and Worm, my Clock that stands in the Hall and Negro Nan and Negro Frank and my two white Servants, vizt, THOMAS NEWBURN and ROBERT (? ARVIN);
      Item. I give and bequeath to my Grandson, HENRY BARNET, my Negro girl named Lucia;
      Item. I give unto my Daughter, ELIZABETH FINCH, the use of my Negro girl Cate during her natural life and after her decease to my Grandson, JOHN FINCH, upon condition he pays to his Sister, MARY FINCH, twenty pounds or one of the young Negroes if she breeds;
      Item. I give unto my Daughter, MARY BARNET, one feather bed and furniture and my black Walnut Desk and my Negro girl called Vinny and twenty pounds sterling to be made out of my Estate;
      Item. I give unto my Wife, ELIZABETH BARNET, the use of my Negro Tom and my Malotto girl named SARAH MAIDEN during her natural life and afterwards to my Son, RICHARD BARNET, also the use of one feather bed her life and afterwards to my Daughter MARY BARNET, and one half of all my personal Estate besides during her life and the other half to my Son, RICHARD BARNET, and after her decease to be equally divided between my three Children, RICHARD BARNET, ELIZABETH FINCH and MARY BARNET,
      Lastly, I nominate and appoint my Wife, ELIZABETH BARNET, and my Son, RICHARD BARNET whole and sole Executors of this my Last Will and Testament;
      In Witness whereof I have put my hand and affixed my seal this 24th day of February 1752

At a Court held for the said County the 30th day of April Anno Domini 1754 This Last Will and Testament of JOHN BARNET, deceased, was presented into Court by ELIZABETH, his Relict, and RICHARD BARNET, Executors therein named, who made Oath thereto and being proved by the Oaths of all the witnesses thereto subscribed is admitted to Record; And upon the motion of the said Executors and their performing what the Law in such cases requires, Certificate is granted them for obtaining a Probate thereof in due form

      THIS INDENTURE made the Eighth day of August in the Eleventh year of the Reign of our Sovereign Lord George the Second by the grace of God of Great Brittain France and Ireland, King, Defender of the faith &c., And in the year of our Lord one thousand seven hundred and thirty seven; Between DANIEL McCARTY of County of Westmorland, Gent., of one part and JOHN BARNETT of the same County, Planter. and ELIZABETH his Wife and RICHARD BARNETT, Son of the said JOHN and ELIZABETH of other part; Witnesseth that DANIEL McCARTY in consideration of the sum of Five shillings of lawful' money to him in hand paid by JOHN BARNETT, ELIZABETH his Wife and RICHARD BARNETT or by some or one of them, the receipt whereof DANIEL McCARTY doth hereby acknowledge, and also in consideration of the yearly Rents and Covenants herein after contained, path and by these presents doth demise sett and to farm lett unto JOHN BARNET and ELIZABETH his Wife and RICHARD BARNETT. all that parcel of woodland ground containing about one hundred acres be the same more or less scituate in Parish of Cople in County of Westmorland and part of a larger tract formerly the land of WILLIAM PEARSE and purchased of WILLIAM PEARSE by DANIEL McCARTY, Gent, Father of said DANIEL McCARTY, party to these presents; and bounded; Begining at the School House Spring and runing from thence cross the Road to a red Oak, corner tree of WILLIAM MINORs land, and now in the possession of JOHN BARNETT, thence along the dividing line between MINOR and McCARTYs land to a Branch falling into the Main Swamp that is WILLIAM MINORs boundary, thence down the Branch into the Main Swamp, thence up the Main Swamp to the mouth of the Spring Branch first mentioned, and up the Branch to the begining; Together with all timber trees and water courses,
      To have and to hold the One hundred acres of woodland ground and other the premises during the term of the natural lives of JOHN BARNETT and ELIZABETH his Wife and said RICHARD BARNETT and the longest liver of them, paying therefore every year during the term of natural lives the annual rent or sum of Nine hundred pounds of Neat Tobacco included in one hogshead and the cask on the Twenty fifty day of December in every year unto DANIEL McCARTY his heirs; In Witness whereof the parties to these presents have hereunto interchangeably set their hands and seals the day and year first above written

      Westmorland ss. At a Court held for the said County the 27th day of September 1737 DANIEL McCARTY, Gent., personally acknowledged this Deed of Lease of Land to JOHN BARNETT for lives to be his proper act and deed which at the instance of the said BARNETT is admitted to Record Test G. TURBERVILE, C. C. W.
