No. 1. The deposition of Francis Boucher Franklin, aged about 45 years, deposes that about 4 years ago, he was called upon by General Smallwood to ride with him to James Simms', the General said as Simms was old and Rookwood had set up a claim to his land, that Simms would know of the Rookwood family, that he rode with him to James Simms, who said he was 84 years old. The General asked him if he knew old Edward Rookwood (decd) he said he did not think he did, but that he had often heard the old people speak of him. He asked him then if he knew his son Thomas, or whether he had more children by his first wife than Thomas, he said that by general information, he never heard that he had any more, that he knew Thomas Rookwood very well, and that he was possessed of all his father's lands after his father's death, and died possessed with sd lands. He then asked him if he knew whether Edward Rookwood was married a second time, he said that he had been often told that he married or cohabited with a hireling or servant woman several years after the death of his first wife, he asked him then if he knew what became of that woman, he said that she went off with a man by the name of Goslin, to Virginia, as he had been informed, and that it was the general report that she had several children by this Goslin. He then asked him, respecting Thomas Rookwood, whether he married and who he married, he told him yes, that Thomas Rookwood married a Henrietta Barnes, and told him how long he lived after his marriage, and that he left a wife and 2 daughters, one of which daughters died young, the other, Anne Rookwood, married Henry Moore, he said he had a great right to know the girls, for he was guardian to them several years and had lived on their land, Allansons Folly. He asked him if he knew how the land became escheatable. He told him it was from the death of an only child which Henry Moore had by Anne Rookwood (whose age and name he also told) and for want of heirs in Thomas Rookwood. He asked him if William Rookwood did not descend from this woman who went off with Goslin to Virginia, he said that he had often heard from many people that he was descended from the woman who went off with Goslin, and said that old Edward Rookwood always disowned him as his son, and was generally reputed to be got by this Goslin, and said that he had often heard that she never returned to Rookwood again during his life. He also said that he had married a sister to Henrietta Barnes, wife of sd Thomas Rookwood. The same evening, at Mr. James Murdock's, he asked James Murdock and wife if they knew old Edward Rookwood, that he had died before she could remember, he then asked her if she knew whether he had any children, she said she had heard people say that Thomas Rookwood was his only son, that she had never heard of any other child. He then asked her if she knew Thomas Rookwood. She said she did, but that she was very young, though remembered his living on the land at Chickamuxon. He then asked her if she remembered whether he was ever married, or whom he did marry, she said she did not know whom he married. He likewise asked her if she knew how many children Thomas Rookwood had. She told him, yes, he had 2 daughters, Anne and Mary, and he died leaving a wife and those 2 daughters, one of which, Mary, died young, and the other, Ann, married Henry Moore. He then asked her if she knew how many children Henry Moore had by his wife Ann, she said she never knew or understood that he had but one daughter who died young, and that the land, at her death, became escheatable for want of heirs in Thomas Rookwood, and that Henry Moore escheated the land.
