THIS INDENTURE made the Tenth day of September in year of our Lord One thousand seven hundred & Eighty four made and entered Between JOHN FISHBACK & ALICE his Wife, JACOB FISHBACK & PHEBE his Wife, MARTIN FISHBACK & LUCY his Wife, CHARLES SPILMAN & ELIZABETH his Wife, JAMES ATWOOD & KATHERINE his Wife &MARY FISHBACK of the one part and HARMON BUTTON of County of Culpeper of other part Witnesseth that (the grantors named abwe) for sum of Two hundred & fifty seven pounds current money to them paid do by these presents bargain and sell unto HARMAN BUTTON his heirs a certain tract of land laying in County of Culpeper which was bequeathed by FREDERICK FISHBACK SENIOR deceased unto his Son, FREDERICK FISHBACK, by his Last Will dr Testament bearing date the twentieth day of September
One thousand seven hundred and Eighty two & recorded in County Court of Culpeper with a proviscr in said Will of the Deceased in case any of his Children should die without lawful Child it was his desire that his her or their part be equally divided amongst the Survivors or their representatives and it hath so happened that the said FREDERICK FISHBACK, Son of the aforesaid FREDERICK FISHBACK deced, did depart this life without a lawful Child and the right of Inheritance devolved to us as Survivors Vit. JOHN FISHBACK, JACOB FISHBACK, MARTIN FISHBACK, CHARLES SPILMAN in right of his Wife, ELIZABETH, JAMES ATWOOD in right of his Wife KATHERINE, HARMAN BUTTON in right of his Wife, SARAH & MARY FISHBACK containing Two hundred & six acres of land
being bounded by a Platt thereof laid down by JOHN WIGGINTON in the Plan of said decedants land and refered ta by his Will Fig: No. 1, begining at a large white Oak on a branch running thence North fifty five and a half degrees West three hundred & sixteen poles ta a large white Oak & Hickory saplin in a bottom, thence South thirteen degrees East seventy five poles to a Pine on top of a Ridge, thence South twelve degrees West seventy four pole to two Pine Stumps, thence South sixty degrees East One hundred & nineteen pole to three white Oaks in fork of a branch, thence down the several courses of said branch to the Fork thereof, thence up the other prong of said Branch to
the begining, (one acre of the aforementioned Two hundred &six acres at the South end adjoining the land of VINCENT TAPP in the Fork of the Branch is excepted in the above sale which was bargained and sold by aforesaid FREDERICK FISHBACK SENIOR unto VINCENT TAPP for a consideration paid him in his life and we do by these presents jointly & severally confirm the bargain & sale together with all right title & Interest unto VINCENTTAPP his heirs as far as it may concern us our heirs kc.) Together with all houses Orchards &appurtenances to the same belonging To have and to hold sd Tract of land (except as before excepted) with the appurtenances unto HARMAN BUTTON his heirs In Witness whereof we have hereunto set our hands & Seds the say &
