      Will of Joseph Smith of St. Ann's Parish in Essex County, merch[an]t, dated 15 March 1726.
      Unto the children of my brother John Smith, late of Bideford, merchant, £20 sterling.
      Unto my brother Benjamin Smith of the Kingdom of Ireland, 5 sterling.
      Unto my brother James Smith of Rosse in the Kingdom:of Ireland,' one mourning ring.
      Unto my loving wife Sarah one third of the remainder of my personal estate. Likewise one third part of my real estate, in which I include my Negroes, during her natural life.
      Unto my son John Smith, all that tract I now live on with that I bought of Francis Gouldman together with the houses, orchard; my sloop Hope with all her rigging, anchors, sails and flat and £100 when he arrives to the age of twenty one years.
      Unto my daughter Betty Smith 500 sterling at the day of marriage or the age of twenty one years. My said daughter be educated and maintained out of the proffits of estate till then: also two Negro girls Diana and Betty.
      Unto my son Edward Smith all that tract I bought of John [B]ates together with that I bought of Merrit in the Parish of St. Anns.
      Unto my son Benjamin Smith all that tract I bought of Fisher and Lovering lying upon Piscataway Creek in South farnham Parish; also the land I bought of Samuel Loyd and George Pettis in St. Ann's Parish.
      After my wife's third of my Negroes and the two Negro girls bequeathed to my daughter Betty are laid aside, all the rest of my Negroes be equally divided between my sons John, Edward and Benjamin.
      If either my sons Edward or Benjamin die before they come of age, my son John inherit their estates.
      My children continue under the care of their mother. As soon as she shall happen to change her condition by marriage my sons and daughter with their estates be removed at the discretion of my executors.
      If my brother Benjamin Smith live and my son Benjamin should also live to a proper age to cross the sea and his uncle be desireous to educate him, he be sent to him. personal estate should exceed the legacies herein bequeathed, the overplus to my three sons equally.
      To my daughter Betty the case of silver hafted knives and forks which Capt. Graves bought for me.
      My wife Sarah and my brother Benjamin Smith and my good friend Colo. John Tayloe of Richmond and my son John when he arrives to eighteen years of age, to be executors.

      Codicil, dated 8 Jan. 1727. All my sloops and flatts be kept in •repair and hired out for the benefit of my estate notwithstanding what I have willed to my son John.
      If it should please God to call me out of this world before the year 1730, my daughter Betty Smith have no more than £300 sterl., the two Negroes and the case of knives and forks and my son John have £25 sterling paid him at age in lieu of £100.

      Whereas several laws have confirmed to this county of Essex 50 acres for a town and John Catlett, Richard Covington, William Tomlin and Thomas Meriwether, Gent., are appointed feoffees in trust, John Catlett and Richard Covington to Joseph Smith of Tappahannock Town, merchant. For 170 pounds of tobacco.
      One half acre or lott in the Burgh of Tappahannock, numbered 11 on the plat made by Mr. Harry Beverley 13 July 1706, and taken up formerly by Augustine Smith and by him lapsed.
      Rent, one ounce of flax seed and two ounces of hemp seed on 10 October annually.
