      1757 September 27 - Brother James died at Albany [N.Y.].
      [James Mercer (19 February 1716-27 September 1757, Bible, loc. cit.) on 20 June 1742 made a deed to his

      THIS INDENTURE the twentith day of June in the year of our Lord God one thousand seven hundred and forty two Between JAMES MERCER of STAFFORD County in the Colony and Dominion of Virginia, Gent., one of the Sons of JOHN MERCER, late of the City of DUBLIN in the Kingdom of Ireland, Mercht., deced., by GRACE his Wife of one part and JOHN MERCER of MARLBOROUGH in County of STAFFORD in Colony and Dominion of Virginia, Eldest Son & heir of said JOHN MERCER, deced., by the said GRACE his Wife of the other part; Whereas in a Decree made in a Cause lately depending in the High Court of Chancery in the Kingdom of Ireland, wherein GRACE MERCER. Widow, and JOHN MERCER & JAMES MERCER, party to these presents, JOSEPH MERCER, MARY MERCER, ELIZABETH MERCER and JEMIMA MERCER, the other Children of the said JOHN MERCER and GRACE his Wife were Plaintiffs, and WILLIAM ALCOCK & RICHARD LEIGH, Surviving Executors of WILLIAM ALCOCK, deced., and others were Defendants. it was upon hearing the said Cause on Tuesday, the twenty seventh day of June one thousand seven hundred and thirty eight ordered adjuged & decreed by the Right Honourble the Lord Chancellor of Ireland, that upon the Plaintiffs paying to the Defendants. WILLIAM ALCOCK and RICHARD LEIGH as Surviving Executors of WILLIAM ALCOCK, deced., the sum of One thousand four hundred and ninty three pounds, two shillings and four pence with the Interest thereof, the Plaintiffs were intitled to a redemtion of the mortgaged premises in the Plantiffs Bill mentioned and that accordingly the Defendants should thereupon by proper Deeds of Conveyance reconvey to the Plaintiffs or to such person or persons as they should think proper the mortgaged lands and premises, (yin.) one holding in Killmainham held by Lease to JOHN MERCER, deced., from PATRICK BELLEW. Esqr. for forty one years from the twenty fifth day of March one thousand seven hundred and four, the clear profits rents being Ten pounds, seven shillings and eight pence, one Lease of several Houses St. James Street from PETER MALONE for ninety nine years from the twenty fifth day of March one thousand seven hundred & six. the clear profits rents thereof being twenty pounds per annum, one Fee for lease of St. James Street from BARTHOLOMEW MYBRANT the clear profits rents thereof being Forty pounds per annum, one Lease of Lives renewable for ever from the Poor House, the clear profits rents thereof being forty five pounds per annum one other interest in St. James Street from JAMES TOPHAM for sixty one years the clear profits rents thereof being twelve pounds per annum; one Estate of Inheritance in Church Street the clear profits rents thereof being fifty three pounds, fourteen shillings and four pence per annum, And all that parcel of the Strand at the back of Lazy Hill bounded: To the Northward by the Line (A), and River to the Southward by the Ditcher or Street forty foot wide belonging to the City along the holdings of Lazy Hill to the Eastward by a Wall to run from the East side of NICHOLAS KEY to meet the line (A), at the channel at right angles & to the Westward by the holdings of said JOHN MERCER, deced_ the dementions whereof are more particularly discribed & set forth in a Map or Survey thereof annexed to the original Lease from the Right Honourable Lord Mayor Sherifs Commons & Citizens of City of DUBLIN to JOHN MERCER, deced., Together with all profits advantages & appurtenances to the same belonging;
      NOW THIS INDENTURE WITNESSETH that JAMES MERCER in consideration of the sum of Two hundred pounds Sterling to him in hand paid by JOHN MERCER, the receipt whereof JAMES MERCER doth hereby acknowledge, hath and by these presents doth bargain sell and make over unto JOHN MERCER his heirs all the claim and demand which JAMES MERCER now hath or may at any time have in the lands and premises with the appur-tenances in the recited Decree expressed; To have and to hold the benefits & advantages in the Decree to JOHN MERCER his heirs; In Witness whereof JAMES MERCER hath here-unto set his hand and seal the day and year first above written

      Westmoreland sct. At a Court held for the said County the 31st day of August 1742 This Deed of Bargain and Sale from JAMES MERCER, Gent., to JOHN MERCER, Gent. concerning the said JAMES share proportion or rights of in and unto certain lands, tenements and heriditaments in the said Deed mentioned scituate lying and being in the Kingdom of Ireland was proved in open Court by the Oaths of Capt, RICHARD BUSHROD and FRANCIS KELLY two of the witnesses thereto and on the motion of the said JOHN MERCER is admitted to Record
