The following depositions and proofs were lodged with the CC Clerk, to be recorded pursuant to the directions of an Act of Assembly passed in 1779 and entitled, an Act to establish a mode to perpetuate testimony.
      William Smallwood of CC, wanting to perpetuate the testimony of sundry witnesses respecting the title of the following tracts of land called Allansons Folly and Saint Davids, for which actions of ejectment have been brought and are now depending in the General Court of Maryland between Thomas Rookwoods, lessee, plaintiff, and John Brawner and William Jones, tenants of sd William Smallwood, gave the following notice to William Cooke of Annapolis, the Atty at Law for sd Thomas Rookwood, he, sd Rookwood, being absent and residing out of the State of Maryland - to wit

      No. 6. The deposition of Adam Clinkscales, aged about 61 years, deposes that he always heard and understood that his mother and other old people of the neighborhood, that Edward Rookwood never had any other child by his 1st wife besides Thomas Rookwood, who, after the death of his father, Edward Rookwood, heired and possessed all the lands and personal estate which his sd father, Edward, died possessed of, and that Thomas Rookwood lived on the land called Allansons Folly and died possessed and seised of that land and all the other lands which he heired from, and entered into possession ot, after his father's death as afd, that sd lands, after the death of Thomas Rookwood, was heired and possessed by Ann Rookwood, only surviving heiress of the sd Thomas, and that the sd Ann married Henry Moore, and had an only child, a daughter named Charity, who died young, upon which he always heard that those lands afd became escheat, and that he always understood that the sd Henry Moore escheated them for want of the heirs of Thomas Rookwood, and that he never heard of or understood that there ever was, after the death of Edward Rookwood, any other heir to sd lands besides Thomas Rookwood, and that he frequently heard his mother say that those lands afd were held by a very slender right apron string hold, and that if Charity Moore should die without heirs, the lands afd would become escheat. This Deponent further says that he always understood that his father, Adam Clinkscales, leased of Thomas Rookwood, part of the tract of land which sd Thomas dwelled on called Allansons Folly, lying upon the mouth of Chickamuxon Cr where the Warehouses now stand, down to the Gut below, whereon his sd father lived and died, and where he, this Deponent, was born, and his mother told him that he was born in Nov and in the Sep following, his father died, and that his father was a middle aged man and had served in Queen Anns Wars, as he had told her. And this Deponent further says that he always heard from his mother and the old people of the neighborhood, that Edward Rookwood (after the death of his 1st wife, the mother of Thomas Rookwood afd) married a 2nd wife, and that the sd 2nd wife eloped from him and either ran away with, or went to one, Goslin, in Virginia and lived with him, and had several children by him, and that William Rookwood was the son of this woman and was generally reported and understood to be sd Goslin's son.       The deposition of Richard Barnes, of lawful age, says that when he attended with General Smallwood on Jun 3, 1789, at the dwelling house of Adam Clinkscales, and took sd Clinkscale's deposition as above, this deponent found him confined to his bed by a dangerous spell of sickness, and so very weak and low, that it was not possible for sd Clinkscales to have attended the preceding day as a witness at Chickamuxon Warehouse.       On Jun 3, 1789, William Smallwood attended at the dwelling house of Thomas Shuttleworth Posey, when and where the following deposition was taken before Daniel Jenifer, one of the CC JPs, who then and there attended for the purpose, in consequence of the indisposition of Richard Barnes, who had attended on the preceding day, and on this present day, until he was so much indisposed at Adam clinkscale's that he could proceed no further. signed - Dan Jenifer*.
