    John Mercer, Gentleman, (February 6, 1704/5 - October 14, 1768), prominent attorney-at-law, lived at Marlborough which had been the county seat of Stafford County 1691-1718. The planned port of entry at the Town of Marlborough was not a success and Mercer, after gaining title to all the town lots and a considerable acreage adjoining in Potomac Neck, established himself there. He married first on June 10, 1725 Catherine Mason (June 21, 1707-June 15, 1750) only child of Colonel George Mason (16??-1716) and his second wife Elizabeth Waugh, daughter of the Reverend Mr. John Waugh. About 1744 Mercer began construction of a handsome brick residence at Marlborough and here, his journal and account books indicate, he lived in the height of style. Mercer married secondly on November 10, 1750 Anne Roy (17??-1770), daughter of Doctor Mungo Roy of Essex County. John Mercer had a large family concerning whom considerable has been written. There is a detailed account of his family in The Virginia Genealogist, Volume 3, page 99 et seq.

    After Charles Dick opened his store, John Mercer made the 15-mile trip to town more often. He combined business with pleasure, attending the fairs, placing orders, and staying with his new friend. They soon developed a closer bond.

    In 1740 (or possibly earlier), as he returned from a southern trip, John Mercer paid a call on Dr. Mungo Roy, who had lived in Essex County since the 1720s.

    Roy is accounted in the Mormon records to have been born in Scotland in 1698. He is listed as one of 14 headrights (each right allowing 50 acres) on a patent granted to Robert Beverley in 1731 for more than 4,000 acres in King and Queen and Caroline counties. But the date of the patent merely indicates the date on which the right was used. Beverley had evidently been collecting some unclaimed rights from his friends.

    In any case, Roy had been in Essex for some time, often in court--no doubt suing patients who did not pay their bills--and was well-established, named as an executor in the wills of some prominent Essex men.

    (But we are challenged to determine whether he remained in Essex or is the Mungo Roy who was a church warden in Drysdale Parish in Caroline County about 1745. There were namesakes in each generation.)

    Charles Dick's interest turned into courtship. In April 1750, he married Roy's daughter Mary. Mercer was still married to his first wife, but there had been no children after 1743, and she was perhaps in poor health from childbearing.

    All three of Mercer's older sons were now pursuing a path that their father no doubt approved, proceeding from the College of William & Mary to military service on the frontier under George Washington. In 1758, John Fenton was brutally killed by Indians.

    Dr. Mungo Roy also died in that year, and this would lead to the involvement of both John Mercer and Charles Dick in the wellbeing of his survivors in the years ahead.

Whereas Mr. JOHN & GEORGE MOTT', own Brothers, did take up & Patent Twelve hundred acres of land in the Freshes & upon the North side of Rappahannock River as by Patent dated the 23d of Septembr; 1663 will appeare, and the 10th: of Septembr: Ano: Dom: 1668, did obteyne unto them the sd JOHN & GEORGE MOTT a Patent from sd WM: BERKELEY, Lieut: Gover: & Capt.     Recorded in liber L, folio 132, a book found among the records of Charles County Court; also the deed or assignment of William Moss to George Mason, recorded in liber Z, folio 291; and the enrolment of a deed from Humphrey Aspinall to Elizabeth Swinburne, found in said last mentioned liber Z, at page 196, (the said liber Z being one of the land records of Charles tbounty,) and which last mentioned deed, from said Aspinall to Swinburne, immediately precedes the enrolment in said record of said deed from Moss to Mason.
    Capt. Robert Collson, in the behalf of Col. Geo. Mason, desires the two deeds following to be recorded, the said Col. Mason living in the Colony of Virginia."
    The first was the deed aforesaid of 1st March, 1684, to which no certificate of acknowledgment was appended, though certified to be a copy by the clerk of Charles County Court, &c.
    The deed from William Moss to George Mason, dated 18th Jane, 1705, was in confirmation of a conveyance to Elizabeth Swinburne, from Humphrey Aspinall, to which no acknowledgment was appended, nor did it appear when recorded.
    And the plaintiff further offered to accompany said deeds, •*•" by reading in evidence a duly certified copy or extract of the rent-rolls of Maryland, shewing Wicksall and Aspinall's Hope to have been in possession of Col.     the will of George Mason, of Virginia, dated 29th January,
    1715, which contained the following devise: "
    Item. I give and bequeath unto my son, Thomas Mason, all the land which I bought of William Moss, in Maryland, and all the land that I bought of Michael Vanlandegham, in Stafford County, to him and his heirs forever."
    This will was admitted to probat in Virginia, 14th Nov. 1716, and certified from the records of Court there, to be a true copy ; and also certified, by the presiding Jndge, under the Act of Congress, as in due form, and by the proper officer.
    And farther offered in evidence, that the said Geo. Mason, the testator, left at his death, as issue of his third wife, two infant sons, named Thomas and Francis, and their sole sister of the whole blood named Sarah - that said Thomas and Francis died while infants without issue, leaving their said sister Sarah as their sole heir-at-law, which said Sarah Mason intermarried with Thomas Brooke, and was with her said husband in the possession of the lands in dispute, whom she survived, and died previous to the year 1786, leaving surviving her, Walter Brooke, her eldest son, and Richard Brooke, her grandson, by Richard Brooke her second son, which said Richard, sou of said Sarah, died previously to said Sarah ; and the plaintiff further offered in evidence, that the lands in dispute were possessed by said Sarah during her life, and by said Walter Brooke, after her death, and that after his death, in 17U8, the same were possessed by Walter D. Brooke, the eldest son of said Walter, until his death, in 1811, and from that time by the widow of said Walter D. Brooke, in behalf of his children, until 1824, when the deed to Lot Mason was executed; and farther gave evidence to shew, that some of the lessors of the plaintiff are the heirs-at-law of said Walter Brooke, and that others of them are the heirs-at-law of said Walter D. Brooke.
    To the whole of which evidence, as above offered, the defendant objects; but the Court overruled said objection, and permitted the deeds, aforesaid, and will to be read in evidence, so far as they purport to convey or devise the tracts of land called " Wicksall " and " Aspinall's Hope," as located, by the patents thereof, on the plots in this cause; and the Court, [STEPHEN. C. J., KEY and DORSET, A. J..] allowed all the other evidence so offered to be given in evidence, and upon the said evidence so admitted, the Court .instructed the jury as follows: that if the jury find, from the evidence aforesaid, that the said Geo. JOHN NORGRAVE Petitioned this Court that Docter EDWARD MADDOCKS who married the relict and Exectx of the said John Norgrave deced might give security for the performance of the said Will according to the Tenor thereof and further alledged that Coll. Mason in his lifetime and all the time of his life gave Security and that Since his decease one of his Securitys are dead alsoe Therefore he prays the said Coll. Mason being dead as afsd and his Security dead Likewise that the said Docter Maddocks who Since intermarried as afsd and hath by the said Intermarriage the possession and Enjoyment of the said Norgraves Estate may be compelled to Enter into bond with good and Sufficient Securitys to be accountable for the same according to the request of the deced and as the Law enjoynes which said motion of Darrells is approved of by this Court and doe accordingly order that the said Doct Edward Maddocks doe immediately give good Security and Enter into bond for the same as the Law directs And he comes by GERRARD LOWTHER his Attorney and put in these reasons And Gerrard Lowther the attorney of Doct Edward Maddocks comes and puts in his plea in writing against Sampson Darrell and gives these reasons whereby he humbly presumes that he ought not nor is Liable to give Security Vizt. as to the Cattle they are paid Secondly the Ring is given to the Legatees according to, as to the negroes they are a personal Chattle and a remainder Limitted in the will of a Chatle personal is void because if given for an hour they are given forever but they are given to Mrs. Maddock for her life so that the remainder after her decease is void Therefore for them no Security ought to be given 4thly no Execr named by the Testator in his will are by Law compellable to find Security for the performance of the Testators will but we are Execrs therefore unless the Law will dispose and Intrust his Estate of the Testator otherwise than he designed we are not obliged to find Security for performance of the Testators will and this appears by the provision made by the Laws of this Country that admrs shall finde Security but no Law doth oblige Execrs 65 Act of assembly 21 Hen 8:15 Vide Title probate of Testaments in Wingates abridgment Lastly there has been Security already found in this matter and if the Court have discharged them without others we are not daily bound to finde new Securitys. "Johh Waugh of Stafford County in Virginia Clerke" to William Fitzhugh of same County, for 20000 lb tobo, 1090 acres "being in the forest between the North side of Rappahannock River and the South side of Potomack Creek comonly called of known by the name of Whiteheads Plantation and being part of a Devident of Two Thousand acres sold by one Tho: Comer(?) of New Kent Count to me the said John Waugh by lease bearing Date the third of Febuary 1689/90 and by Release 4th of April 1690 and both recorded in the County Court Records of Rappahannock the 4th of June 1690". The 2000 acres being part of a greater tract, by patent 1670, granted to Johna and George Mott and conveyed in fee to Tho Comer. "Part thereof being part of a Plantacon lived upon and seated by one Geo Shepard". Surveyed by George Morris surveyor of Rappa. Co.

BELL of this county deced which said Saml. THOS. PETTIS bearing date the 10th of February 1652 after renewed by Order of Governour & Council bearing date 15th day March 1658 and after that renewed to Mr. HENRY MEESE by pattent bearing date 20th day October 1665 and since by divers conveyances conveyed down first to my Father JOHN WAUGH deced then to me Joseph Waugh & John Waugh my Brother the 20 acres hereby sold being part of said 2000 (sic) acres .. 8th July 1707.
