  1. 1.  Eleanor Hamersley was born about 1765 in Charles County, Maryland (daughter of William Hamersley and Mary Brooke); died on 19 Jun 1838 in St. Mary's County, Maryland - admin.

    Notes:

    === Rob
    According to Newman, Eleanor Hamersley married Henry Neale as his 2nd wife and she was the daughter of Francis Hamersley and Eleanor Pile. She is proved as their daughter through the will of her uncle Rev. Henry Pile, sister to Eleanor Pile.

    I now believe Newman made even more Hamersley mistakes. I have now placed this Eleanor who was a daughter of Francis as the one who became a nun and died in Baltimore 01 Feb 1834 at the age of 51. Her death notice indicated she was from Charles County

    She died in SMC in 1838. I placed her birth around 1765 and marriage to the Colonel around 1788. She had 5 kids with Col. Neale, or at least the oldest of which lived for us to learn about appears to be Francis born around 1792

    Charles County Land Records 1782-1786; Liber Z#3; Page 157. Release and deposition, recorded at the request of William Chandler Brent.
    I hereby relinquish all claim to my child, Mary Sly's estate, and from hence forward exonerate the representatives of the late Mr. George Slye of St. Mary's County, from my individual claim to the same so far as concerns myself. Signed Aug 4, 1785 - Clear Slye. Wit - W.H. Jenifer, John Sanders. The foregoing instrument of writing was executed previous to Mrs. Clare Slye's deposition in the presence of W.H. Jenifer and John Sanders.

    Page 158. CC. Clare Slye, age about 46, deposes, concerning the codicil to the will of George Slye, Esq, late of St. Mary's County, decd, that some days after the abovesd will was executed, Mr. William Hamerley came into the room where Mr. Slye was in bed, and desired the company to leave the room, that he wanted to speak with Mr. Slye, which the whole company did, except this deponent, who remained with Mr. Hamerly. Then Mr. Hamerly said to Mr, Slye that he had made no provision for his children's personal estate in case they should die before coming to age, or without heirs. Mr. Hamersly repeated the same observation over the 2nd and 3rd time before he could move Mr. Slye. At last, Mr. Hamerly said, Mr. Slye, you do not consider your poor slaves, upon which Mr. Slye asked Mr. Hamerly, what of my poor slaves.
    Mr. Hamersley replied that if Mr. Slye died with his will as it then stood, his Negroes would be torn up and down the Country every way. Mr. Slye asked how. Mr. Hamersly replied that all your half-sisters children, the Neales, the Craycrofts, and the Boarmans, will come in for an equal share with your own sisters children. Mr. Hamersley asked Mr. Slye, after this, if he had not rather his own sisters children should come in for the estate than his half sisters children. Mr. Slye answered, I don't know, Mr. Hamersley, just as you please. Mr. Hamersley then said he would go and write a codicil, which he did, which codicil was neither sealed nor dated - This Deponent being asked by the representatives of the late Mr. Slye whether Mr. Hamersley mentioned to Mr. Lewis in the presence of her that there was an omission in Mr. Slye's will respecting the personal estate of his child or children in case of death under age or without issue, previous to his mentioning the matter to Mr, Slyer answers that she walked to the back room door with Mr. Hamersly where Mr. Lewis was, that then Mr. Hamersley spoke to Mr. Lewis, and told him that the will was not somehow, left right, but says she could not understand what Mr. Hamersley meant. Mr. Lewis' answer to Mr. Hamersley was, why did not you come sooner? If there was any worldly business to be done, it ought before that to have been settled, that as the man was dying he might die in peace. Being asked if she understood the nature of the omission in the will previous to Mr. Slye's being spoken to concerning it, she answers she really did not know the nature thereof. Being asked if she was in the room just after the codicil was executed, when Mr. Slye gave his watch to Mr. Edmund Plowden, replies she believes she was but does not positively recollect, though she remembers the watch was given to Mr. Plowden. Did this Deponent ever hear Mr_ Slye or Mr. William Matthews say that Mr. Slye had left the plantation on which he lived, to Mr. Edmund Plowden, provided he would make over to his two brothers all the lands which belonged to the sd Edmund's father, answers that to the best of her recollection, never heard either of them mention anything of the matter. Whether she heard mr. Slye say that if his child or children should die before coming of age or without lawful issue, that it was his intention that personal estate should devolve on his sister Plowden's children, she replies she never heard him say so. Did you conceive Mr. Slye to be in his senses until a few minutes before his death, replies he would answer short things well enough, and that as a dying man, his senses were as good as could be, but would ramble, and that she did not think him capable of doing business. Asked if she thought that Mr_ Slye was perfectly in his senses when he executed the codicil as he was when he executed the will, answers she does not think he was_ Have you not said that the codicil was not Mr. Slye's but Mr Hamersleys? She replies that she has said so many times. Signed - Clare Slye.
    The foregoing deposition was taken in the presence of Edmund Plowden, Francis Plowden, and Henry Neale, who intermarried with Margaret Brent Plowden, representatives of George Slye, Esq, late of St. Mary's County, decd, who acknowledged that they attended in consequence of notice being given them by Mrs. Slyer and consented that the sd deposition might be taken on Aug 4, 1785 before W_H, Jenifer, Recorded Aug 8, 1785

    CH-703
    Rock Point
    Private
    Pine Grove consists of a 2 ½ story, three bay, Flemish bond brick dwelling initially constructed in the early 19th century. The house stands on the north side of Hill Road and includes some original acreage bordering on Brick House Cove to the southwest. Remaining vacant for many years, at the turn of the 20th century, it was radically altered in the Colonial Revival style. At this time a one-story porch and balustrade was added, the roof was replaced, and four large hipped roof dormers were added. The interior was also entirely gutted and reworked to reflect an American Foursquare plan.
    Pine Grove, although extensively altered from its original form, is one of the oldest and most impressive dwellings in the Rock Point and Cobb Island vicinity. The dwelling is believed have been constructed in the early 19th century by members of the Hammersley family who once owned the entire Cobb Point peninsula. In 1832, Henry Hammersley willed the Cobb Island peninsula to his only son John Hammersley who likely constructed a dwelling on the property soon after. John and his wife Glovinia retained ownership until the 1870's after which time it descended to their children Samuel, Helen and Alice. In 1913, the Hammersley's sold Pine Grove Farm, including 200 acres to J. Mortimer Hill for $2000.

    Edward Butler, born say 1702, was identified as being the son of Kate Butler by William Simson in his deposition at the Provincial Court on 27 May 1767. The 69 year old Simson said that he and Ned Butler, one of William Neale's slaves, had played together as children and were about the same age [Provincial Court Judgments 1770-1, 241-2]. Edward was a slave who belonged to Francis Hamersley on 13 June 1738 when he was convicted by the Charles County court of stealing a large quantity of cloth valued at 2,080 pounds of tobacco from the storehouse of Richard Gildart. The court ordered that he sit in the pillory for one hour and receive 39 lashes. (Since this was a capital offense, he could have received the death penalty). In August 1749 he petitioned the Charles County court for his freedom from William Neale. The court ordered that Richard Edelen, Mary Ruthorn, Mary Jameson, and Thomas Osborn be deposed for the next session of the court in November 1749, but the outcome of the case was not recorded [Court Record 1734-9, 474; 1748-50, 414]. (Perhaps the case was held in adjoining St. Mary's County whose colonial court records have not survived.) Edward was sentenced to death for robbing Trinity Parish Church but was pardoned by the Governor on 13 May 1754 [Archives of Maryland 31:32]. He may have been the husband of Susannah (Proctor?) Butler, a free woman, who was sued by William Neale (Edward Butler's master) for a debt of 1,631 pounds of tobacco in November 1753. She was also sued for a debt of 1,662 pounds of tobacco by William Parker in Charles County court on 9 March 1756. Most of the debt was for 1,500 pounds of tobacco which Parker paid for her to Thomas Clark, Esquire. She was identified as a "Molatto" in Parker's accounts, called a spinster in the court document, and called a widow on 14 March 1758 when she had a counter suit against Parker. He sold her security which consisted of 3 cows and 2 calves, 2 steers, 7 shoats, a bed, dishes, and other household items for 3,113 pounds of tobacco [Court Record 1753-4, 186; 1755-6, 423-4; 1756-7, 161, 404; 1757-8, 149].

    Eleanor Butler, born say 1660, was a white woman imported to Maryland by Lord Baltimore. She was the servant of Major William Boarman of St. Mary's County in August 1681 when she married "Negro Charles," one of Boarman's slaves. William Boarman left a St. Mary's County will on 16 May 1708, proved 17 June 1709. He gave his wife "Slaves Robert, Charles & Elliner," his son John Baptiste slave Catherine, his son Francis Ignatius slaves Anne and Margaret, his daughter Mary slaves Sarah and Henry, and his daughter Clare slaves Jane and Susannah [Hodes, White Women, Black Men, 33; Baldwin, Calendar of Maryland Wills, III:140]. The inventory of his estate on 11 July 1709 included an "Elderly Negroe man named Charles," an "old Irish woman," a "Mallattoe" slave named Kate, a "Mallattoe" slave Jane, two "Mallattoe girl" slaves, and two "Mullattoe children" slaves. In 1730 members of the family were listed in the inventory of the estate of John Sanders: Charles "very old & lame," Kate, Jenny, Nan and Betty "Negro women," and seven children [Prerogative Court Inventories 1729-30, 634].
    ===
    Catherine "Kate" Butler, born say 1683, was probably the unnamed "Mallatto Servant" of William Boarman who was mentioned in the Charles County court records on 10 August 1703. Boarman accused John Brayfield of dealing and bartering with his servant [Charles County court Record 1701-4, 249, 264]. She was bequeathed by William Boarman to his son John Baptiste Boarman in 1709 and was a "mallatoe woman slave" listed in William's Charles County estate in 1709. She was called a "Negro woman named Kate" in the inventory of John Sanders in 1730. Several deponents in the William and Mary Butler vs. Richard Boarman suit testified that she was Charles and Nell's daughter [Provincial Court Judgments 1770-1, 235, 236, 239, 241, 243].
    ===
    Elizabeth Butler, born say 1693, was not named among the slaves in Major Boarman's 1709 will but was listed as a "Negro woman" in the inventory of the estate of John Sanders in 1730. She was identified as Eleanor's daughter by seventy-six-year-old Anne Whitehorn in her 27 May 1767 deposition in the Provincial Court. Anne also deposed that Elizabeth was somewhat younger than her, that Elizabeth had been dead about 30 years, and that Elizabeth's son William was about 44 years old at the time of the deposition [Provincial Court Judgments 1770-1, 236-7].
