Pursuant to the order of last Jun Court, Commission issued to examine witnesses touching the bounds of 2 tracts of land in CC, the one called Moors Follow, and the other, Hawkins' Barrons, in the possession of Francis Ware. Commissioners appointed: Gustavus Brown; Samuel Hanson, John Hanson, and Benjamin Douglas, Gent (not being any way related to the Petitioner, contiguous Proprietor, nor interested in the sd land).. And now here, Gustavus Brown and Samuel Hanson return to the Court here the Commission afd with the following certificate and the subsequent depositions -
We certify that we met on the lands within mentioned on Sep 5, 1738, and then and there took the depositions of Mr. John Courts, Ralph Shaw, Edwd Gilpin, Colo. Robert Hanson, and Leadstone Smallwood, which depositions are hereto annexed. Signed -- Gustavus Brown, Saml Hanson.
CC, Sep 5, 1738. John Courts of CC, Gent, age about 46, says that about 31-32 years ago, he was with Col. John Contee, Joseph Manning, and some others, the sd Joseph Manning being then Surveyor, was running a dividing line between the sd John Contee and Mr. William Chandler, that they began at a marsh side near Portobacco Cr, and to the best of his remembrance, at a white oak standing near the place afd, and ran a course up into the woods 'til their number of perches (as he understood) was out, and not finding any boundary there, they went some small distance forward in the same course, but how far he can't exactly tell and there by the directions of sd Contee, bounded a hickory standing at the head of a Stony Valley near a branch and is the same tree which for some time past has been reputed to be the dividing tree of the land afd. And this deponent further says that at the time when the sd hickory was marked as afd, it was then a small young tree and did not appear to have been marked before then. Signed - John Courts.
CC, Sep 5, 1738. Ralph Shaw Sr of CC, age about 53, says that about 15-16 years ago, he saw the tree mentioned in the above deposition, which seemed then to be a small, thriving tree, which sd tree seemed not to have been long bounded. Signed - Ralph Shaw Sr.
CC, Sep 5, 1738. Edward Gilpin of CC, age about 35, says that about 13 years ago, he saw the tree mentioned in John Courts' deposition, which was then a growing young tree, which sd tree appeared to him then not to have been long bounded, and that Geo. Goodrich informed him it was the dividing tree between Colo. John Contee and Mr. William Chandler. Signed - Edward Gilpin.
Robt. Hanson, age about 58, says that about 1722, he was surveying Mr. William Chandler's land at Portobacco, and he ran an east course from a white oak of sd land, commonly called Earlys Oak, to find a bounded beech, another boundary of sd land, which course fell short of the place. But when the number of perches was out, Leadstone Smallwood showed sd Chandler and this deponent the place where he said his father had told him the sd beech stood, and that there was then some part of a fallen beech lay by the place, which place is in a branch near'a cliff and is the place where the deponent now stands, and further, the deponent says that he made use of the sd place as a corner of the sd land, and ran a south course from thence, and then a west course to Portobacco Cr for the sd Chandler, and has since made use of it in other surveys. CC, Sep 5, 1738. Leadstone Smallwood of CC, age about 51, declares that upwards of 20 years ago, his, sd Leadstone's father brought him to the place mentioned in Colo. Hanson's deposition, and that there was some part of a fallen beech lay by the place afd and told this deponent that it was a bound tree of Mr. William Chandler's land, and ordered him to mark a sapling that stood by the place afd that he might remember it again, and he accordingly marked a dogwood sapling, which is now standing at the sd place. Mar 14, 1744[/5] from Ledstone Smallwood of CC, Gent, to Francis Goodrick of CC, Gent. By patent dated Jul 19, 1726, Leadstone Smallwood was granted a tract of land called Addition to May Day, lying in CC on the east side of Portobacco Cr in the woods, containing about 131 acres. Now this deed witnesses that the said Leadstone Smallwood, for 30 £sterl money of GB, sells a parcel of land that is part of Addition to May day, bounded by a tract of land called Mayday, containing and now laid out for about 120 acres..

Charles County Maryland Land Record Liber Z#2, 1744-1753; Page 181. At the request of William Smallwood (son of Ledstone Smallwood) for his daughter, Anne Smallwood, the following deed of gift was recorded on Sep 18, 1747.
I, Mary Smallwood of CC, widow, for the natural love have for my granddaughter, Anne Smallwood, daughter of Wm Smallwood, the son of Ledstone Smallwood of CC, and also for divers other good causes, I have given Anne 3 Negroes, namely Anne, a Negro woman, Anne, and Matthew and Leonard, together with Anne's increase, except a child she now goes with, when born, is to become the right of Matthew Smallwood. Signed Sep 9, 1747 - Mary (M her mark) Smallwood. Wit - Sam Hanson, Alextius (A his mark) Semmes.
Memorandum: the within Negro woman Anne is to remain and be in possession of sd Mary Smallwood during her natural life

Oct 26, 1763 from Samuel Hanson Jr of CC, Gentleman, to James Craik of CC, physician, for 550 £sterling, two tracts of land in CC, the one being part of a tract of land called Saint Edmunds, containing about 150 acres, and is bounded as by a particular deed thereof from W Foster and wife to James Smallwood dated Dec 2_, 1695.
The other tract is called .. contiguous to and adjoining the above .. 11th day of Nov .. by Ledstone Smallwood .. sd patent being had the causes .. Signed - Sam: Hanson Jr. Wit Saml Hanson, [Josias Haw]kins*. Margt, the wife of sd Samuel Hanson Jr, released her right of dower to the within mentioned Lands. Recorded Oct 27, 1763.

Charles County Land Records 1796-1799; Liber IB-2 {Abstract by Mike Marshall}; Page 194. Deed: at the request of Doctor Daniel Jenifer, the following deed was recorded July 19th 1797.
Indenture made June 19, 1797; Joseph Luckett in consideration of 200 pounds current money paid by William Craik planter of Montgomery County hath sold two tracts of land. One called "May Day" which was formerly in the possession of Ledstone Smallwood, father to the late Ledstone Smallwood deceased and conveyed by the father in his will dated February 22, 1755 to his son. And was thereafter in possession of Ledstone the son, and thereafter bargained sold and confirmed unto the said Ledstone the son by a certain Esther Adams widow {Hester Smallwood widow of Benjamin Adams}, by deed bearing date of March 5, 1763 which was thereafter conveyed by said Ledstone the son unto a certain William Rhody Luckett father to the said Joseph Lucket by deed bearing date January 23, 1771, October 25, 1773 and October 26, 1773 and thereafter devised to the said Jospeh Lucket by William Rhody Luckett; and is all that part of "May Day" which remained undisposed of by the said Ledstone Smallwood the father and which is clear of the tract of land called "Moore's Ditch" and Saint Edmonds", and the other tract of land called "The Addition to May Day" clear of elder surveys.
