IN THE NAME OF GOD, Amen. I ANN McCARTY of the Parish of Cople County of Westmoreland and Colony of Virginia being sick and weak but of sound and perfect sence & memory (thanks be to God for it) doe make ordain and appoint this my Last Will and Testament in manner and form following, this Seventh day of November Anno Domini 1728
First, I give my Soul to God Almighty that gave it mee faithfully trusting that Ulna the merrits & satisfaction of our blessed Saviour, Jesus Christ, it will be remitted to my body & Gloryfyed. I desire yt: my body may be buryed at such place and in such decent manner as my Exrs. hereafter named shall think fit.
Item. I Will and desire that all my just Debts be fairly and speedily paid;
Item. I give each of my own Brothers & their Wives a Gold Ring wth: my hair under a Cristal & to Colo. JOHN TAYLOE one of ye same;
Item. I give & bequeath to my Son, HENRY FITZHUGH, and his heirs for ever all my Lands, my two cases of knives and forks, one feather bed & furniture, my first wedding Ring. my Grandfather. CORBINs, mourning Ring and my waiting boy Negroe Harry;
Item, I give to ELIZABETH FITZHUGH, Daughter of Majr. JNO FITZHUGH, one Gold Ring with my hair under a Cristall; ANN McCARTY Seal
Item. I give to my Daughter, LETTICE, one Negroe boy & girl now in her Husbands possession, my Brother, RICHARDs, picture, my Silver candle Cup, my Chest of Drawers, my Gold Clasps or Studs wch: she chuses;
Item. I give to my Daughter, SARAH FITZHUGH, my Fathers and Brothers Mourning Rings,my case with knife fork & spoon, the Studs or Clasps after her Sister has chose, my Silver ladle, my Mare and her increase, and Lucy & Ned, two Negroes I bo't this year of my Bro: THOMAS.
Item. I give to BILLINGTON McCARTY a Stone Ring;
Item. I give to SARAH BEAL the little Hoop Ring I wear;
Item. I doe hereby discharge my Brothers, HENRY FITZHUGH, THOS: & HENRY LEE from their Bond & Bill of Excha: to my late Husband, MACCARTY which his Exrs. paid mee for part of wt: was due to mee from his Estate & I doe desire & direct that my Exrs. doe cancel & destroy the said Bond & Bills of Excha: soe yt: noe payment thereof be ever made by my sd. Brothers, the same being due out of my Childrens Estate I hereby give up the paymt. thereof to all intents & purposes;
Item. I give to Negroe. Joan, a suit of my Cloaths, a Shift & a Sheet to be buryed in for her faithful service;
Item. I give & bequeath all the rest of my Estate after Debts & Legacys paid to my Son, HENRY, my Daughter, LETTICE, & my Daughter, SARAH, to be equally divided between them by my Bros. THOMAS & HENRY LEE or ye Survivor of them, if both are not living at the time when the Division is to be made Item. I desire that my Estate be not appraised,

Item. It is my Will that when any money is raised for my Daughter, SARAH, by the Crops or produce of her Negroes or Sale of Stock as my Exrs. think proper, I doe empoower my exrs. to lay out her money for her use in Land or Negroes as they shall judge best for her, my Exrs. not to be chargeable with any loss of Stock or other things;
Item. I due hereby appoint my Bros. THOMAS & HENRY LEE, & my Son, HENRY FITZHUGH, Exrs. of this my last Will and Testament, & have hereunto set my hand and seal the day & year first written

Westmorld. ss. At a Court held for the sd. County the 31st day of May 1732 into co Court This Last Will and Testament of Madm: ANN, McCARTY, deced-:, was presened thereto and by Colo. HENRY FITZHUGH, her Son and one of the Executors: who made Oath being proved by the Oath of THOMAS SEARLES (one of the witnesses thereto), at February Court last and by RICHARD HILL, the other witness, is admitted to Record.. And HENRY LEE, Gent., one of the Ezrs. in the sd. Will named in open Court refusing to take upon him the burthen of the Execution thereof; Upon the mocon of the said HENRY FITZHUGH and his performing what is usual in such cases, Certificate is granted him for obtaining a Probate thereof in due form

23-24 May 1737. Dennis McCarty of Prince William County, Gent., to Daniel McCarty of Westmoreland County, Gent. Lease and release; for 350 current money. 1800 acres at the Southwest Mountains ... the same land formerly in possession of James Taylor the Elder and James Taylor the Younger who by deed conveyed the said 1800 acres to the executors of Daniel McCarty, Esqr., deceased, in trust for the use of Sarah McCarty, now also deceased, having first intermarried with Thomas Beale by whom she had issue a son who dyed an infant under the age of twenty-one years, after whose death the said land vested in Dennis McCarty a brother and surviving heir of the said Sarah.
