Westmoreland County Court 26th of January 1723/4
James Wheeler greatest creditor to the estate John Winter came into court & made oath that the sd Winter departed this life without makeing any Will so farr as he knowes or believes and upon his motion certificate is granted him for obtaining Letters of Administration upon the sd decdts: estate in due form Wm: Sturman assumeing be security for his faithfull administration according to law. Ordered James Creed, David Wise, Jno: Steel & Wm: Smith or any three of them being first sworn before one of his Majesties Justices for the sd county do sometime before the next court to be held for the county aforesd value & appraise the said estate in money & make report thereof to the sd court.

It was commanded JOHN STURMAN, Gent. Sheriff ofthis County, that he should attach EDWARD SHERWEN to answer JOHN WINTER of a Plea on the Case to his damage five pounds sterling and the Sheriff returned cepi corpus but for that the Defendt. failed to appeare and noe baile being returned, on motion of Pltf. Conditionall Order passed against the Sherifffor the Debt according to Law;

JOHN WINTER was attached at May Court last to answer THOMAS DENT of the Province of MARYLAND Gent., of a Plea on the Case for twenty one hundred fifty and six pounds of tobacco due by Account proved by the Oath of the Pltf., as appeared by a Certificate thereof from under the hands oftwo of the Magistrates of the Province aforesaid at which Court the Defendant appeared and for Plea said he ought the Plaintiff nothing and of that &c., And now at this Court the suite being called and both Pltf. and Defendt. being present, it was ordered the Sheriffshould summon twelve &c. who haveing returned twelve [who are to witt]

honest and lawfull men ofhis Baylywick sworn and charged to say the truth in the premises on their Oaths doe say, "Wee find due to the Pltf. seventeen hundred forty and eight pounds of tobacco ofthis Account," which Verdict on motion ofthe Pltf is admitt to Record and thereupon he prayed Judgment, which being considered by the Court is is their opinion that the Pltf doe recover Judgment against the Defendt. for the sum ofseventeen hundred forty and eight pounds oftobacco by the Jury in form found, and it is ordered that JOHN WINTER doe pay the same with costs als Execution

JOHN WINTER came into Court and made Oath that JOHN DEACON, deced., departed this life without makeing any Will soe farr as he knows or believes and upon his motion Certificate is granted him for obtaining Letters ofAdministration on the Decedent's Estate in due form, TERRANCE CONNER assumeing in Court to be Security for his faithfull administration according to Law; And it is ordered JOHN PRICE, ROBERT LOVELL, TERRANCE CONNER and NATHANIEL GRAY or any three ofthem being first sworn before one ofhis Majesties Justices for this County, doe some time before the next Court to be held for this County value and appraise the Estate ofthe Decedent in mony and make report thereof to the next Court
