      THIS INDENTURE made the 12 day of March 1777 Between JOHN SPOTSWOOD Esqr. on one part and MELCHIAH [Malachi] BERRY of other part Witnesseth that said John Spotswood for rents and Covenants herein after mentioned hath granted to farm letien unto said Malchah Berry two hundred acres of land as by a plot and Survey of the same directed on the back of this Indenture, Except all mines, minerals and Quarries lying in the Parish of St. Marks in County of Culpeper To Hold during the natural lives of Malchiah Berry, ELIZABETH BERRY and JOSEPH BERRY and for lives of the longest liver of them paying yearly One thousand pounds of Tobacca & Cask on the Twenty Fifth day of Decr. and within four years after date of these presents plant upon the demised premises three hundred good fruit trees whereof one third at least to be good apple trees and Inclose with a good and Lawfull fence
