Charles County, Maryland Land Records 1814-1817; Liber IB-11 {Abstract by Mike Marshall}; Page 31. At the request of Thomas Harris the following Trust Deed was recorded March 20, 1815
Indenture made November 17, 1814; between William Courts of CC and Thomas Harris of the City of Annapolis. Whereas Daniel of St. Thomas Jenifer and Henry H. Chapman have endorsed a note for William Courts for the purpose of obtaining a loan of $3000 from the Farmers Bank of Maryland in the City of Annapolis which was accordingly loaned to William Courts and whereas he wishes to indemnify Daniel of St. Thomas Jenifer and Henry H. Chapman. Now this indenture witnesseth that William Courts in consideration of the premises and the sum of $1 have sold unto Thomas Harris a tract called "Robins and Hendly" containing 550 acres in trust, nevertheless to indemnify Daniel of St. Thomas Jenifer and Henry H. Chapman of them becoming endorsers and that in case William Courts shall fail to pay and discharge said note, Thomas Harris shall proceed to seal the land at pubic sale after giving 6 months' notice and the proceeds to apply in the first place for the costs and charges of this trust and secondly to pay unto Daniel of St. Thomas Jenifer and Henry H. Indenture made July 14, 1815; between Daniel of St. Thomas Jenifer of one part and John B. Wills Jr. of the other part. Witnesseth that Daniel of St. Thomas Jenifer in consideration of $1 current money of United States paid by John B. Wills Jr. and also in consideration of the sum of $317.34 current money of United States due and owing from the said Daniel of St. Thomas Jenifer to Alexander Sangster by Bill obligatory bearing date March 26, 1814 have sold Negroes Nace (30 yrs.) and Harry (32 yrs.) In trust, that is to say in the first place to satisfy and pay John B. Wills all costs and expenses which he may incur in the execution of this trust, secondly to satisfy and pay the aforesaid Alexander Sangster the aforesaid sum of money with legal interest from the 26th day of March 1814 until paid, thirdly to return pay and satisfy the said Daniel of St. Thomas Jenifer all such part of the property that may remain and appoints John B. I Daniel Carrington in consideration of 5 dollars current money and other good causes and considerations me thereunto moving have sold unto Daniel of St. Thomas Jenifer the following goods and chattels, to wit, 5 cows, 1 yearling heifer, 4 oxen, 1 small black horse, 1 mare and colt, 3 feather beds and furniture thereof, 2 tables, 6 flag chairs, 2 spinning wheels, 1 cupboard with glasses and China Ware, one looking glass and 2 hogs altogether of the value of $200 current money. whereas Clement Dorsey and Daniel Jenifer have endorsed a note in the Farmers Bank of Maryland for the sum of $1800 drawn by me in discounted for my use and whereas in my ill state of health it is prudent that a fund should be created for the payment of the same or any future renewal thereof. Now in consideration of the above and the sum of $10 paid by George Forbes I have sold the following Negroes, to wit, Thomas, Peter, George, Harry, Ben, Tom, Jude. To have and to hold the same in trust to indemnify and save harmless the said Clement Dorsey and Daniel Jenifer from any loss which they may suffer by the payment of the said note or any future renewal of the witness my hand and seal this February 12, 1816, Daniel of St. Thomas Jenifer in the presence of and acknowledged before John J. Indenture made December 11, 1816; between Daniel of St. Thomas Jenifer of one part and John Barnes of the other part. Whereas John Barnes heretofore entered into a bond to the state of Maryland as security to the said Daniel of St. Thomas Jenifer, administrator of all and singular the goods and chattels rights and credits which were of Dr. Daniel Jenifer late of CC deceased condition for the due administration of the deceased estate which said bond now remains among the records of the orphans court of Charles County. And whereas Daniel of St. Thomas Jenifer in order to indemnify the said John Barnes as his security and to save harmless him as agreed to execute these presents. Now this indenture witness that Daniel of St. Thomas Jenifer in consideration of the premises and the sum of $10 current money of the United States paid by John Barnes has sold parts of tracts lying in CC which Dr. Daniel Jenifer died seized, vizt; "Coates Retirement", Skipton, "Musselberry Resurveyed" {sic Musselborough Resurveyed}, "His Excellency's Gift", "Lindsay's Rest", "Planters Delight", "Harwood", "Barnes Purchase", "Barbadoes", "Beech Neck", "The Two Partners", "The Chance Enlarged", "Freehold", alias "Tompkin's" or "Watson's Grant", "Meeks Delay", alias "Maryland Point", "St. Barbara's Manor", "Chearman's Purchase", "The Desart Enlarged", "Galleys Venture", "Galleys Discovery", "Rose Hill", "St. Nicholas", "Round Hills", "Chandlers Hills", "Free School", "St. Thomas" or "Thorns Gut", "Watsons Addition", "Hudson's Disappointment," "Molly's Chance", "McPherson's Discovery", "Archibald's Desart", "Tower Hill", "Bowen's Dispute", "Thomas Port", "Wadestone, Wadestone Addition" and "Lands of Ease"; and all and singular the Negro slaves herein after named; Tom, Charles, Peter, Nace, George, Henry, Ben, John, George, Lance, Letty, Sarah, Betty, Judy, Daphine, Betsy, Nancy and Jenny, in trust notwithstanding and upon no other condition that John Barnes shall well and dispose of the right title and interest of the said Daniel of St. Thomas Jenifer's aforesaid lands in Negro slaves at public or private sale and the proceeds thereof pay and satisfy John Barnes all and every sum of money which he may become liable for and all damages and costs that he may sustain in consequence of executing the said bond as security for him. Charles County, Maryland Land Records 1814-1817; Liber IB-11 {Abstract by Mike Marshall}; Page 494. At the request of Daniel of St. Thomas Jenifer the following Memorandum of Division of Lands was recorded December 30, 1816
Whereas Alexander Greer, Thomas Price Sr., Samuel Chapman, Samuel Hawkins and Horatio Clagett have by the mutual consent of all the parties concerned acted as commissioners in the division of real estate of Dr. Daniel Jenifer, deceased and have a portion to each representative the lands hereafter designated as their respective portion of the said real estate that is to say, "Rose Hill" with all the appurtenances to be the property of John B. Morris, the lands known by the name of "The Retreat" and plantation to be the property of Daniel of St. Thomas Jenifer. The lands in Nanjemoy known by the names of "Maryland Point", "Chearman's Purchase", "Freehold" and "Meeks Park" to be the property of Daniel Jenifer. The rest or remainder of the lands in Nanjemoy which Dr. Daniel Jenifer died possessed to be the property of Mariamne C. Jenifer and the lands known by the name of "Panquiah" {sic Panguya] estate to be the property of Walter H. Jenifer to which division as aforesaid and each of us agree and bind ourselves our heirs and assigns to be governed by the same and do mutually acquit each other and their heirs or assigns from any claims or claims to any part of portion of said estate real estate as divided by the commissioners. At the foot of the aforegoing instrument of writing is thus written, to wit;
Whereas Mariamne C. Jenifer now Mariamne C. Forbes my wife cannot from her not being of age in or into a legal or binding agreement herself. This is intended to bind myself as heir executors administrators and assigns in the sum of $20,000 current money of the United States to be paid to the aforesaid representatives in case of her refusing to make over her right title and interest to each representative or the heirs or assigns whenever she may arrive to the age of 21 for the performance of which I have hereunto subscribed my name and affixed my seal the day and year before written, George Forbes in the presence of Samuel Ogden, Horatio Clagett
