James Bankhead's Will
In the Name of God Amen, I James Bankhead of the County of Westmoreland being sick and weak of sound memory do make this my last will and testament.
First, I will and desire that all my estate both real and personal may be kept together for the support and maintenance of my loving wife and my dear children during my wifes widowhood, except in that time my son arrives to the age of 21 years or either of my daughters marry.
Item I will and desire that so soon as my widow shall marry or my son arrives to the age of 21 years or either of my daughters marry then my whole estate, the land excepted, shall be equally divided among my wife and children in the manner to wit; to my dear wife asked dower (besides the three Negroes, Aggie, Phillis and George which I give to her and her heirs) one child’s part, and to each of my children then living a child’s part to them and their heirs.
Item I will and desire that the Negroes which my wife holds as dower with the increase of the females may at her death be equally divided among my children then living.
Item I appoint my two brothers William Bankhead and John Bankhead and my brothers-in-law William Miller and Thomas Miller and my worthy friend James Coats executors of this my last will. Signed with my name and seal this eighth day of January 1785.

At a court held for Westmoreland County the 28th day of June 1785 this last will and testament of James Bankhead, deceased being presented into court by William Bankhead one of the executors herein named who made oath thereto and the law directs and the same being absolutely proved by the oaths of William Lindsay in James Tyler two of the witnesses thereof is admitted to record in on the motion of the said William Bankhead and his performing what the law in such cases requires, a certificate is granted him for obtaining a probate thereof in due form.
