      Note:
      In the name of God Amen I James Ball being in perfect health and memory thanks be to god do make this my last Will in Manner following viz I do first and most principly give and bequeath my Soul to God who gave it me in certain hopes notwithstanding my unworthyness to receive pardon of all my sins through the blessed merits and mediation of my deer redeemer Jesus Christ.

      Item I give to my Grand Son Burgess Ball all my lands in King George, Spotsilvania and Stafford Counties during his Natural life & at his decease I give it to his child or children as he shall think fit and to their heirs.

      Item I give to my Said grand son Twenty one Slaves viz. Dick, Bristor, Adam Rawleigh, & Alice yt I Bought of my son James, Lucy & her four children and her three grand children, Letty and her Seven children and all their future increase when he shall arrive to the age of twenty one or have lawful issue and that my exe'r keep a true account of the profits of the slaves out of which profits it is my desire my aforesaid grandson be well educated & when he shall arrive to the aforesaid age or have lawful issue, that he be possessed and entitled to ye the said slaves and their increase as also what shall arrive from the profits of the said slaves, but in case my said Grand Son die before he come to the age of twenty one and without lawful issue then I give the Said Slaves and profits to be equally divided among my Son and five Daughters and their heirs.

      Item I give to my Said Grand Son my clock and my two mares Blase and Fancy & what stock I shall have on the land before given him and all their increase when he shall come to the age aforesaid or have lawfull issue.

      Item I give to my Daughter Sinah and my four grand Sons viz. Jesse Ball son of my Daughter Frances, James Ewell and James Ewell son of Eve Ewell and John Selden and their heirs five thousand acres of land in Prince Wm County to be laid off at the upper end of my mountain tract to them and their heirs equally amongst them. I give to my Daughter Eve one Slave named Sarah and all her Encrease which she has now only the use of.

      Item I give to my daughter Selden and her heirs ye land I bought of Benjamin Taylor. I give to my grand son John Taylor Fifty pounds Sterling to be paid him when he shall come to the age of twenty one but if he should die before that age then I give it to his Mother it being part of her portion. Item I give to my five Daughters all my household goods except my plate. The best bed and furniture which I give to my Son James.

      Item I give to my Grand Son Tobey Downman Thirty pounds to be laid out in land or a Slave and no otherways. Item I give to my grandson James Downman my watch and Silver Buckles. Item I give to my son James the use of all the remainder of my estate including my Slaves in his possession which he has now the use of all during his natural life and at his death to dispose of as he shall think fit.

      Item I do appoint my Son Exr of this my last will and testament and guardian to my grand son Burgess Ball and my will is that my estate be not appraised. In witness my hand and seal this 15th day of July 1754.

      At a Court held for Lancaster County on the 15th day of November 1754 this will was presented in Court by James Ball Gent Excr therein named who made Oath thereto and the same was ordered to be recorded. Teste, Thos Edwards, Jr. C. L. C. A copy Attest Benj'n M. Walker C. C. 1830. Dec 3d.

      In the Name of God Amen I DANIEL McCARTY of Truro Parish and County of Fairfax in the Commonwealth of Virginia being of sound mind and memory do make and appoint this my last Will and Testament. First I resign my soul into the hands of my creator and my body to be decently buried (without any pomp) as to my worldly estate ..
      Imprimis I give unto my dear and loving wife SARAH [Sinah] McCARTY the use of all my estate both real & personal during the term & continuance of her remaining my widow except such legacies as shall otherwise be disposed of in this my Will except also the payment of my just Debts and the tax on the lands and slaves as they shall become due but she is not to rent out anymore of the land either in Fairfax or Loudoun besides what is already rented neither is she to sell or cut down any of the timber except what may be for use of the plantations and that not in waste
      I give unto my son DANIEL McCARTY & his heirs the following slaves Viz; mulatto George Sims and mulatto Spencer & Will Taylor sons of old Hannah.
      Item I give unto my Daughter MARY McCARTY and her heirs the following slaves Viz; Daniel son of Milly, Penny and all her increase already born or hereafter to be born. It is also my will & desire that after my wife's right to my Estate shall cease my son Daniel shall allot and give to my said daughter Mary and her heirs eight other slaves, five of which shall be working hands & that the same time he shall give unto each of my other daughters Vizt SARAH CHICHESTER SINAH WAGENER and ANNE McCLANECHAN and to their heirs one other negroe besides what they have already received,
      Item I give unto my said Daughter Mary and her heirs two feather beds and furniture. I also give unto each of my other daughters one feather bed and furniture but not until my wife's right to my Estate ceases It is also will and desire that my son Daniel do furnish my said Daughter Mary with a plantation sufficient to work her hands on & that my said Daughter Mary be allowed to live on the plantation whereon I now live as long as she shall remain single I also give my said daughter Mary & her heirs after the right of my wife ceases ten head of cattle twenty head of sheep and four good horses Or mares I also give unto my daughter Sarah Chichester six head of young cattle & six sheep, all the remaining part of my Estate of what sort soever it be both real & personal I give unto my son Daniel McCarty & to his heirs after the right of my wife shall cease at the same time it is my will and desire that if his son Daniel do conduct and demean himself in such manner as the son of a Gentleman ought to do that he give unto my said grandson and his heirs or on his attaining the age of twenty one years the plantation and land whereon I now live, Also sixteen hundred acres of land in the County of Loudoun including what is commonly called the Island and the plantation where my quarter in that County is at present and ten slaves mulatto Lett and her increase to be part of them his father to make up the others as he may think proper I also give unto my grandson Daniel McCarty my silver punch bowl and ladle and six silver table spoons, yet if my grandson should become dissipated and betake himself to vitious and ill courses then in that case it is my will and desire that my son Daniel McCarty should give and divide all the estate herein intended to be given to my said grandson among his children & their heirs agreeable to his own discretion and whereas I formerly purchased from my son in law RICHARD CHICHESTER a large studd horse the price of which has not been ascertained and settled and as I have since let the said Richard Chichester have seventy acres of land which was part of the tract whereon I now live, it is therefore my will and desire that my Executors do charge for the above mentioned land as much but not more than the said Richard Chichester charges for the said studd horse Further it is my will and desire that my daughter Mary he maintained out of my Estate as she has been heretofore during the time she may remain single or during the time of her mothers right to my Estate And Lastly I appoint my loving wife and my son Daniel McCarty Executrix and Executor of this my last Will In witness whereof .. this 23d day of August 1792 Presence JOHN HEREFORD JUNR.,

      At Court contd & held for Fairfax County 10th Oct 1792 This Will was presented in Court by Daniel McCarty the Executor therein named who made oath thereto and the same being proved by the oaths of Patrick Keogh and Doddridge Pitt Chichester is admitted to record and the said Executor having performed what the Law requires in such cases a Certificate is granted him for Obtaining a Probate thereof in due form.
