Thomas Powell [Sr.]
1667 September 30. Thomas and Mary Powell sold (Ibid., page 317) their interest in 300 acres land to James Coghill for the valluable consideration of nyne barrells of good Indian corne as also for Divers other Considerasions of Sittingbourne Parish, Rappahannock County, Virginia,. The land was "lying in the freshes of Rappahannock River on the North side of the River."
8/11/1655 (Lancaster Co, Virginia Rec. Book, #2, page 104). Francis Place conveyed a tract of land formerly in Isle of Wight County, Virginia containing 300 acres patented by him September 7, 1654, lying on the North side of the "freshes" of the Rappahanncok River about ten miles above Nazemum Town and certain cattle by deed of gift to 'My daughter Mary Place when she arrives at 18 years,' if she dies without heirs, then 'to daughter Margaret Place, my youngest daughter.'" Mary had married Thomas Powell by 1666 when they deeded this same land to James Coghill.
9/30/1667 (Old Rappahannock Co, Virginia Deed Book 3, page 317): "Thomas Powell and Mary, his wife, sell to James Coghill for the valluable consideration of nyne barrells of good Indian corne as also for Divers other Consideracons 300 acres on the North side of Rappahannock River patented September 7, 1654. Mary Powell, daughter to Francis Place, doth appoint her loving friend, Mr. Daniel Gaines her true and lawful attorney to acknowledge said deed." William Wilton witnessed this power of attorney and a few days later bought the land from Coghill. This deed establishes the maiden name and father of Thomas Powell's wife Mary.

Thomas Powell who lived in Sittingburne Parish in Essex County left a Will, written March 2, 1700, stating he was "very sick and weak," which was proved on April 10, 1701 (1701 Essex County Will Book, page 75). He leaves land to be divided equally between his sons, Place and Thomas and his wife Mary, her part at her death to go to son William, cattle to son, William and "these persons that hath the education of my son William till he shall come ot the age of 21 years." He also left bequests to daughters Frances Powell, Elizabeth Salmon, Anne Coffee, and sons, Honours (Honorias) and Place and son-in-law-John Salmon, to be Executors. Signed by mark of Thomas Powell.

1704 Essex County, Virginia. He and brothers, Honor and Thomas, were listed on the Quit Rent Rolls, each having 72 acres.
8/10/1705 Essex County, Virginia. Place put the following on record at the court house:
"Know all men that I Place Powell of Essex Co and Parish of St Anne's do for several threatenings of Mary Powell my wife that she will make away with what I have a-purpose for to ruine me, I do, therefore, forwarne all manner of persons from having any manner of dealing with her and from taking anything of her or entertaining her without my consent." Place signed with an "X". A footnote says she may have been a "she-devil", probably as a result of loneliness.
1/11/1710 St Ann's Parish was still his residence when he leased 300 acres to Augustine SMITH for 99 years, the land was in St Maries, Richmond Co. "whereon George and William Proctor now liveth in the freshes of Rappahannock River in the forks of Lamb's Creek, being the land granted unto Francis PLACE by patent Sept. 1654, relation being had to the records, and now doth of right belong to the said Place Powell, partly to these presents." Witnesses were: John Golding, Cassandra Golding and John Wood. It was not recorded until 1/13/1714, after the next event.
6/3/1713 The previous entry concerned land that Place's parents had sold some 40 years prior and the question arose about the validity of the contract. The matter went to court and the jury's verdict was:
"Francis Place took up the land in question, 300 acres in Sept. 1654; on Aug 11, 1655, he made a deed in tail to his daughter, Mary, and she was thereafter in possession of the land. Mary married Thos. Powell and said Place is their eldest son. Mary died about 3 years ago the middle of December last. On Sept. 30, 1666, Thomas and Mary deed the land to James COGHILL, who, on Oct 11, 1667 deeded it to William Wilton. He took out a new patent for the land on Oct. 3, 1671. 'Wee do not find any patent of the sd land granted to the sd ffrancis Place before that dated in 1654 before cited. Wee find that the sd ffrancis Place was dead long before the date of Wilton's patent. Wee find the said Mary Powell lived a widow' nine or ten years before she died."
There was one final entry concerning Place and this same 300 acres:
9/7/1750 King George Co. "Honorias Powell, of St. Mary's Parish, Caroline Co, as brother and heir apparent to Place Powell, who has removed himself to some remote place out of Virginia, conveys to John CHAMPE, Gent, the land patented Sept, 1654, by Francis Place and leased Nov. 11, 1710 by said Place Powell to Augustine SMITH, Gent, which lease is of record in Essex Co."
It appears that Place left Essex Co but no one knew his whereabouts and so assumed him dead (in 1715) with his property passing to brother, Honorias.
John Golding gave bond as administrator of Place's estate but apparently there was a problem because in July 1716, Augustine SMITH posted 50 pounds bond to administer the estate, "he dying without a will." Inventory and appraisment of Place's estate was recorded in 1717.

BE IT KNOWNE unto all men by these presents that I THOMAS POWELL of the County of Rappa, for the Valluable Consideracon of nyne Barrel's of good Indian Come as alsoe for divers other consideracons by me already received have agreed bargained and sold unto JAMES COGHILL of the Parrish of Sittingbourne in the County aforesaid all my right title and Interrest of three hundred acres of land scituate lying and being in the Freshes of Rappah: River and on the North side of the River as will more playnely appeare by a bearing date the 7th day of 7br 1654 all and every parte and parcell of the wch said land I the said Tho: Powell wth and by the Consent of MARY my Wife doe confirme and make over from us the sd Thomas & Mary our heires and assignes unto him the said Coghill his heires for Ever he the said James Coghill his heirs To Have Hold enjoyn all the premises aforesaid he the said James Coghill yeelding paying all such Rites and Dues wch are accustomed & required unto the the truth of wch Agreemt. wee the parties above menconed have Interchangeably undersett our hands and seales this 30th day of 7br 1666/7.

"Verdict of the Jury inter ALEXANDER DAY, Lessee of PLACE POWELL, Plt. and WILLIAM WILTON by GEORGE and WILLIAM PROCTER, his nearest Friends, admitted Defendts.in the room of PATRICK MAY, Defendt. Wee find FRANCIS PLACE took up three hundred acres of land being the land in question by Patent dated in September one thousand six hundred and fifty four, the copy whereof is hereunto annext. Wee find that on the 11th of August 1655, he made a Deed thereof in tail to MARY, his Daughter, acknowledged and recorded according to the copy of the said Deed hereunto annext and that she was in possession thereof afterwards. Wee find that the said MARY intermarryed with one THOMAS POWELL and that PLACE POWELL, Lessor of the Plt., is Eldest Son and Heir to said MARY of her body. Wee find that the said MARY died three years agoe, about the middle of December last, Wee find that after the said MARY's intermarriage with the said THOMAS POWELL, vizt., on the 30th day of September 1666, they the said THOMAS and MARY made a Deed of the sd. land to JAMES COGHILL acknowledged and recorded acording to the copy thereof hereunto annext. Wee find that on the 11th of October 1667, the said JAMES COGHILL made a Deed of the said Land to WILLIAM WILTON acknowledged and recorded according to the copy of the Deed hereunto annexed. Wee find that the said WILLIAM WILTON took out a new Patent for the same land the 3d day of October 1671 reciting a surrender of a Patent granted the said PLACE ano 1652. Wee do not find any Patent of the sd. land granted to the said FRANCIS PLACE before that dated in 1654. Wee find that the said FRANCIS PLACE was dead long before the date of WILTON's Patent. Wee find that RICHARD WILTON ever since the date of COGHILL's Deed to him has been in possession undisturbed of the said land till the bringing of this suit.
Wee find the said MARY POWELL lived a Widow between nine and tenn years before she dyed. And if upon the whole matter the Law be with the Plt., then wee find for Plt. and one shilling sterling damages, but if the Law be with the Defendt., then wee find for the Defendt. WILLIAM FANTLEROY, Foreman."
And it is ordered that the matters of Law therefrom be referred till next Court to be argued and then to be first called
