MALACHI PEALE a certain tract of land containing Three hundred and fifty acres and do by these presents sell unto the aforesaid Capt. PEALE of STAFFORD County his heirs or assigns the aforesaid Tract of Land it being and lying in the Freshes of Rappa. and on the North side the River, the said land being formerly sold by Mr. JOHN and GEO MOTT unto PETER GALLEN and by the said GALLEN demised unto THO. CHAPMAN and by the said CHAPMAN sold and made over unto JOHN FOSAKER and made over from the said FOSAKER unto the above named JOHN BARTHELEMEW & FLEMING as may by Deeds and Writings more at large appear, the said parcell of land being and lying in the aforesaid County being prt of a Devident formerly belonging to JOHN and GEO: MOTT abovenamed beginning at a corner tree by a PATH side & running North to PASBETANZCE BRANCHES, thence over STONY HILL. West 154 poles, the said Tract of Land being surveyed by Mr. WILLIAM MOSELEY, Surveyor of Richmond County, on the 10th of December 1684 for HENRY ARKHILL of Richmond County aforesaid and by the said HENRY ARKHILL bought and purchased of ADAM WOFFENDALL and HONORIA his Wife as appears by a good and well executed Deed from under their hands and seals for the same bearing date the 2d day of June 1685 and by the said ADAM WOFFENDALL and HONORIA his Wife acknowledged to the said HENRY ARKHILL in the said County Court of RAPPAHANOCK on the 3d day of March 1685, and now since by the said HENRY ARKHILL sold & made over unto me the said JOHN PRATT on the Sixth day of July 1685 and was by the said HENRY ARKHILL acknowledged unto the said JOHN PRATT my heirs and assigns on the third day of March 1685/6, and was recorded the last of March following as relation being had unto the said Survey authentick, Deeds of Sale & Assignments will more fully appear, Together with all manner of housing orchards gardens & fences with all woods trees mines minerals and quarries &c., and all other comodities to the granted premisses belonging, To have and to hold the sd parcel! of One hundred sixty five acres of Land with all the premisses unto the said SAMUEL LUCAS his heirs and assigns forever, for the consideration of the abovesaid Commutation and Exchange of Land made from the said SAMUEL LUCAS to me the said JOHN PRATT and with all the appertinances I have already received of him the which I hold by force of the said Exchange and the said JOHN PRATT for himself & his heirs the said One hundred sixty five acres of Land and all the premisses unto the said SAMLL.       Richmond County Court 6th of June 1700
      - JOSHUA DAVIS of this County brought his action against EDWARD TAYLER of the said County and declared that the said EDWARD unjustly & with force & arms &c. hath possessed himselfe of a certain Plantation Tenement or parcell of land conteyning about fifty acres lying in the FORREST whereon the said Deft, now lives scituate in the Parish of St. Marys & County aforesaid; being part of a tract or divident of land conteyning forteen hundred sixty nine acres as by Pattent granted to ROBERT ALEXANDER, JOHN ALEXANDER JUNR. & CHRISTOPHER LUND bearing date the 23d: day of March 1664 may appeare; And the said ROBERT ALEXANDER surviving the said JOHN ALEXANDER JUNR. & XPHER. LUND & no division of the said land made; the whole right & title of the said Patent and land therein conteyned fell & descended unto ROBERT ALEXANDER aforesaid, And the said ROBERT sold & conveyed all his right & title & interest of the said Patent unto MALLACHY PEALE as by the records of WESTMORELAND COUNTY Court may appears, And that the said MALLACHY PEALE sold & conveyed unto the Complt. Five hundred acres of the land aforesaid as by the records of the said Court of WESTMORELAND may appeare; And that the remainder of the said land conteyned in the Patent aforesaid, the said MALLACHY PEALE, since deced, by his last Will & Testamt. duly proved in STAFFORD COUNTY Court together with all his right title & interest thereunto unto the said Complt. and his heirs did devise & give; Nevertheless the said EDWARD TAYLER upon the land aforesaid & within the bounds of the said Patent hath committed divers trespasses by cutting down the wood, felling & destroying the Timber, breaking up the ground & still doth continue to committ though forewarned therefrom, Whereby the Compy.. saith he is damnified & damage hath suffered to the value of Ten thousand pounds of tobacco & thereupon craves Judgmt. wth: cost as also that his Majties Writt habere facias possessoniem may issue &c.
      And the Deft. by his Attorney, SYMON ROBINS, comes into Court & for Plea saith that the said Declaracon is insufficient in the Law for that there is no time menconed therein when the Trespass was committed & thereof craves Judgmt &c.
      Which plea this Court not allowing, the Deft. by his said Attorney pleaded not guilty in manner & form as in & by the said Declaracon it is put forth & declared; And thereof ffor tryall puts himselfe upon the Country & the Plt. also. Whereupon the Court do order that the Sheriff of this County or his Deputie do summons a good & lawfull Jury of the Neighbourhood to meet upon the said Land on the first day of July now next following being Monday, or upon the next faire day, Together with Mr. CHARLES SMYTH, Survayor, And do then & there survay & lay out the land in difference according to the antient & disputed bounds of the Patent thereof having regard to all elder Patents adjoyning And make report of their proceedings therein unto the next Court held for the said County under their hands in Writing.
      Mr. FRANCIS SLOUGHTER is requested to administer an Oath to the Jury for their true survay as also to all persons that shall then & there appeare as evidence on the part of either Plt. or Deft.

Genl. in virginia The able Petition of JOSHUA DAVIS of Richmond County sheweth that your Petitioner sometime ago for a valuable consideration paid, bought & purchased a certain parcel of land lying at the head of Quanticot Creek in County Stafford together also with one water grist mill and Mill House to the same belonging .. But now so it may please your Excellency that one ABRAHAM FARROW of Stafford County Millwright well knowing the same to be true but enjoying the Petitioners right & Title in & to the mill the said Abraham out of the mill at several set times did take carry & bear away 137 bushels of Indian Corn & 8 bushels of wheat and also the 27th day of Sept. last past in the Mill House with force & arms did enter and then & there made a forcible Entry & detainer and yr. Petr. from his house in manner and form eject expell & remove your Petitioner from his possession thereof doth keep & hold out to the great damage & common hurt of your Petitioner and against the form of several statutes in this behalf made & provided Your Petitioner most humbly prays your Excellency to remove the force & injury of the said offender & to reinstate & establish your Petitioner in the full possession of the house (as formerly he was wont to have) and also treble damages as is allowed by the law together also with such further other Relief in the premises as your Excellency in your abundant wisdom & goodness shall seem most meet. I give unto my Son, JOSHUA DAVIS, a young red Cow called Fortune and her female increase and the Bull calves reserved unto my selfe and Executor for the looking after the said Cow female increase.
