To dau. Elizabeth Joseph and hrs., 400 A., part of "St. Johns" afsd. (For description see will). In event of her death without issue, to pass to on Clement and hrs. and son Thomas and hrs., successively.
To son Luke at 18 yrs. and hrs.., that part of "St. Johns'' on which testator lived (for description see will), at decease or marriage of wife Elizabeth.

This Indenture made this twenty third Day of
Aprill in the year of Our Lord Seventeen hundred and forty six
Between Ignatius Wheeler of Baltimore County Gentleman
of the one part and John Whettenhall of S.t Marys County
Doctor of Physic and Monica his Wife of the other part
Witnesseth That for divers good ^Causes &^ Considerations the partys
hereunto moving It is Hereby Covenanted granted concluded
and agreed upon between the ^said^ partys to these presents for them
and their heirs that it shall and may be lawfull to and for
the said Ignatius Wheeler before the last day of the next
Provincial Court to prosecute out of the high Court of
Chancery one or more Writ or Writs of Entry Sur Disseizin
in the Post against the said John Whettenhall & Monica his
Wife returnable in the Prov.l Court whereby the Said Ignatius
Wheeler shall and may Demand against the Said John
Whettenhall and and Monica his Wife all that Tract or
parcell of land with the appurtenances called that part of
S.t John's that lies in the fork between the two main branches
of the main Swamp and out bounds of S.t John's untill it
meets with the Tract of Land Devised by Luke Gardiner
to his Daughter Eliz.a Joseph's lying and being in S.t
Marys County af.d by such Name or Names Quantity
or Quantities of Acres as shall be thought fit and requisite
To which said Writ or Writs the Said John Whettonhall
& Monica his Wife shall appear in proper person & Vouch
to Warranty the Common Vouchee and the common Vouchee
shall appear and imparle and afterwards make Default
whereby one or more recovery or recoverys Judgment or
Judgments may be had and given for the said Ignatius
Wheeler for recovery for Recovery of the said Tract of Land
and premisses af.d against the said John Whettonhall &
and Monica his Wife to recover over in value against the
said common Vouchee according to the manner and
form of Common recoverys in such cases used and it is
further Covenanted Granted concluded and agreed
by and between all and every of the said parties and the true
intent and meaning of the parties to these presents is that from
and immediately after the said common recovery or recoverys
shall be and enure and shall be construed esteemed adjudged
and taken to be and Enure and are hereby Declared to have
been intended to be and enure that the said Ignatius Wheeler
and all and every other person or persons which shall be seized
of the said premisses or any part thereof by force and Virtue
of the said common recovery or recoverys shall stand and
by seized thereof and of every part and parcell thereof with
its appurtenances to the only use and behoof of the said John
Whettonhall his heirs and assigns and to no other use intent
or purpose whatsoever In Witness whereof the Parties
have hereunto set their hands and affixed their seals the Day

Maryland fs.t April 23.d 1746 then came Ignatius Wheeler
and John Whettinghall and Monica his Wife parties within named
before me one of his Lordships Justices of the Prov.l Court and
acknowledged the within Instrument of writing to be their
Act and Deed and to and for the uses intents and purposes
Therein mentioned and at the same time the same Monica
was privately Examined out of the hearing of her said
husband and acknowledged that she did the same freely &
willingly without the Compulsion of her said husband or
fear of his Displeasure
